Nawaz Sharif is proving himself that he is not a democratic leader but he is a son of a military dictator who played a big role to ruin Pakistan’s sovereignty and its youth. General Zia-ul-Haq was the man behind Nawaz Sharif’s political career and yes of course Nawaz is paying regard in his honour by threating democracy and trying to de-stabilize the current democratic system.
Few days back president of Nawaz League and CM of Punjab had given a shameful statement which was only to save Punjab from Talibanization, while showing little regard for other provinces of Pakistan. We can see many cases of N-League in the past few weeks or months which suggest their connection with Taliban and other similar jihadi and sectarian organizations which are banned by the Federal Government of Pakistan. Where is N-League going and what is their agenda?
Today, in a surprise move, Nawaz Sharif decided against supporting a constitutional reforms package that envisaged a major overhaul of the country’s constitution and undoing constitutional changes made by former military rulers. The package, which was slated to be introduced before the country’s parliament on Friday, sought to amend one-fourth of the constitution’s articles.
Sharif said he had taken the decision at the eleventh hour, as the country’s superior judiciary wasn’t taken into confidence regarding the procedure of the judges’ appointment. Earlier, the government claimed to have developed a consensus over the constitutional reforms. The package also sought to transfer powers from the president to the prime minister in line with the Pakistan’s 1973 constitution.
The former military rulers — General Zia ul Haq and General Pervez Musharraf — made changes to the constitution through various legal framework orders and later got them endorsed by their rubber stamp parliaments. An all party Parliamentary Committee on Constitutional Reforms has suggested more than 100 amendments to over 70 articles.
For the first time in the country’s history, the committee has also suggested some major changes in the constitution to give more administrative, financial and political autonomy to the provinces. The reforms committee was formed last year in the light of ruling PPP’s promise to repeal the controversial 17th amendment that gave country’s president extraordinary powers.
In order to stop military interventions in the future, the committee has suggested an amendment to the Article 6, proposing that any person validating military takeovers will also be charged with treason. With few exceptions, judges of the superior judiciary in the past validated military interventions.

ISLAMABAD: The PML-N leaders are said to have conveniently let down Prime Minister Yousuf Raza Gilani on Thursday as he had signed two official summaries — first to officially invite President Asif Zardari to address the joint sitting of Parliament and secondly to lay the 18th Amendment draft — after duly consulting the Nawaz camp about the official business of the National Assembly today (Friday).
Prime Minister Gilani was said to have been caught off guard when he came to know about the decision of the PML-N to back out from its earlier commitment given to him that its leaders were fully satisfied with the outcome of the almost year-long deliberations of the Parliamentary Committee on Constitutional Reforms (PCCR).
Giving inside information, the sources said, actually one top leader of the PML-N who was also member of the PCCR had created this whole mess as he had given his consent to the government to summon the joint session today (Friday) so as the constitutional package could be tabled followed by the address of President Zardari. After getting satisfied with the response of the PML-N camp, Prime Minister Gilani informed President Zardari to get ready to address the Parliament today (Friday).
The sources said this was also the idea of members of the PML-N to call the final meeting of the constitutional committee on Thursday evening in the Parliament House to sign the constitutional reform document so as no party could back out from the agreed changes in the clauses. But, the sources said, to much surprise of members of the committee, Senator Ishaq Dar representing the PML-N in the committee did not turn up for the meeting. These members were said to have smelled something foul in the meeting when they were informed that Dar would not be available to sign the document.
The sources said the mystery behind the absence of Dar was soon resolved when news television channels started live coverage of extraordinary press conference by Nawaz Sharif.
The sources said, Prime Minister Gilani had been accommodating the concerns of the PML-N at every stage and had even played a major role in convincing President Zardari to implement the Charter of Democracy (CoD) and shift his sweeping powers to the prime minister. These sources said unlike the public perception that Zardari would not give up his powers, he had ultimately agreed to hand over his powers to appoint chief of army staff to his own hand-picked prime minister. But, the sources said, this time government was in a serious mood to table the constitutional bill in the House today (Friday) to put an end to long controversy, when suddenly it was revealed that this time none other than the PML-N leaders themselves were not ready to back those proposals on laughable excuses. The sources said the new stance of Nawaz about process of judges’ appointment did not carry weight particularly when Chief Justice of Pakistan Iftikhar Muhammad Chaudhry during a course of hearing of one case the other day had appreciated the idea of parliamentary commission to evaluate and confirm the appointment of judges in the light of recommendation of judicial commission headed by Chief Justice of Pakistan himself. One source said the irony was that in the last one year the PML-N never missed a chance to blast Asif Zardari for applying delaying tactics to finalise the constitutional bill. But, when the time came to table these reforms in the House after a general consensus among all the parties, it was revealed that this time the PML-N leaders were not serious in bringing about much talked reforms in the constitution for some “unknown reasons” trigging new speculation about their intentions.

Moments before the scheduled signing of the amendment bill by the all-party Parliamentary Committee on Constitutional Reforms, the Pakistan Muslim League-N on Thursday backtracked from its stance on the issue of judges’ appointment and renaming of the NWFP, stalling the much-awaited reforms package for an indefinite period.
At a time when the nation was eagerly waiting for a happy conclusion, PML-N chief Nawaz Sharif dropped a bombshell that the mechanism agreed for judges’ appointment was not acceptable to his party.
“I have talked to Prime Minister (Yousuf Raza) Gilani on phone and asked him to consult the chief justice and then decide the mechanism with us,” Mr Sharif said at a news conference after presiding over a meeting of the party’s central organising committee and its leaders from the NWFP at the Punjab House. His appeal to the government to delay the constitutional reforms package and consult the judiciary on judges’ appointment before presentation in parliament shocked the whole nation and political parties across the divide.
This is despite the fact that the procedure for judges’ appointment is the same as that drafted under the Charter of Democracy signed by Mr Sharif and Benazir Bhutto in May 2006. Just a couple of days ago, the reforms committee had even agreed to reconstitute the proposed judicial commission on PML-N’s calls for adding a retired judge of the Supreme Court as its seventh member.
Mr Sharif’s remarks also contradicted the admission by all sides that the reforms package has been finalised with consensus.
Even PML-N members of the committee found it extremely difficult to defend the party’s somersault on a matter already agreed upon.

It is a sad development.
According to a news report, Mian Nawaz Sharif took this surprise decision after receiving some telephone calls. It is getting murkier.
Apparently, the real challenge facing Nawaz Sharif is about changing the name of the NWFP to Pakhtunkhwa. Is he scared of displeasing his voters in Hazara Division, his only vote base outside certain urban centres in the upper and central Punjab?
By backtracking on the constitutional package, Nawaz Sharif has proved to be, at least morally, not much superior to Zardari when Zardari backtracked from his written promise of the restoration of Ifitikhar Chaudhry and other judges.
If Sharif thinks there are certain flaws in the constitutional package then he is not doing a great job in explaining as to what is wrong with the procedure for appointment of judges. By merely demanding that Prime Minister should speak to Chief Justice, Sharif is proposing something which is ridiculous as well as ultra-constitutional.

If it was a case of appointment of judges, then his demand to include a retired judge in the judicial commission was acceded to the very next day by the reforms committee, then why is he still complaining, asked a political observer.
To put forward another of his lame excuses, Mian Sahib mentioned the differences with the Awami National Party over renaming NWFP. But when his kitchen-cabinet was asked about the same issue, they all sounded quite hopeful that after meeting with the ANP leaders, the issue would be resolved amicably. Why has Mian Sahib taken all this burden of proving that he belongs to the same old hands, which nurtured him in politis and then booted him out of it, remained on every legislators’ mind.

Mystery of last minute phone call

Meanwhile, sources privy to developments said while Senator Ishaq Dar and Nawaz actually assured Prime Minister Yousaf Raza Gilani a day before the press conference on Thursday that they would not create any hurdles in the way of the reforms package, a phone call by “certain quarters” prompted Nawaz to change the script of his speech. “Nawaz was warned by those quarters that his own future, his brother’s future and the entire PML-N’s future would be in jeopardy,” they said.
It has been learnt that Nawaz has now asked Ishaq Dar to calm down the PML-N ranks and seek time from the chairman of the constitutional reforms committee, Raza Rabbani, for consultations.
The sources said Dar had conveyed Nawaz’s message to Rabbani, and asked the committee chairman “not to play up” the issue in the media and give the PML-N leadership time for damage control within the party. They said Dar had assured Rabbani that the PML-N would renegotiate with “those who called Nawaz before the press conference” and reach a consensus.
As the fate of the bill is connected to the Sharifs and several of their party stalwarts, the sources said the issue would likely require intervention by “some authorities” from Rawalpindi.
Party sources confirmed that a large number of PML-N parliamentarians had expressed dismay over the unexpected change in the stance of their party leader, and “they have made their feelings known to the party leadership”.
At the same time, the sources said Dar had leaked a letter to the media in a bid to salvage the heavily-dented pride of the PML-N chief. Dar is citing the letter by the PML-N’s organising committee in NWFP as the “reason” behind Nawaz’s change of mind.
According to the letter, the organising committee has objected to a hyphenated name for NWFP, as “it can damage the party structure further”. The letter describes the Awami National Party as “a stooge of Pervez Musharraf”, and calls on Nawaz to “play politics on issues related to renaming NWFP” until the local bodies elections as part of efforts to rebuild the party.
However, the sources said Nawaz knew about the letter in the days leading up to the press conference. And he was not ready to stall the introduction of the 18th Amendment Bill in parliament on the basis of the NWFP organising committee’s objections, as “all other proposals by the PML-N – especially the one related to the bar limiting tenures in the prime minister’s office to not more than two – had been incorporated in the Rabbani-led committee’s recommendations, said the sources.
“While Dar and Nawaz had even thanked the prime minister for including a retired judge in the judicial commission on the appointment of judges… that last-minute call prompted Nawaz to change his speech,” they said.

Prime Minister Syed Yousuf Raza Gilani conferred the Nazria-i-Pakistan (posthumous) award on the late Lt-Gen Mujibur Rahman, one of Zia-era tormentors of the PPP. Gen Mujib was information secretary in the Zia regime and was accused of using his expertise in psychological warfare against the PPP after Zia had toppled the democratically elected government of Zulfikar Ali Bhutto. He was also accused of being instrumental in victimising, including torturing and flogging anti-regime journalists. Mr Gilani listened to the adulatory citation about Gen Mujib whose award was received by his daughter. The citation said Gen Mujib stood first in the psychological warfare training in the United States and was responsible for making the ‘Sada-i-Kashmir radio’ an effective tool against India during the 1965 war. Mujibur Rehman (the firstarmy officer to be appointed to this post in the history of Pakistan) under General Zia In his book “Press in Chains”, senior journalist Zamir Niazi said «.,that between 1948 and 1985, a total of 183 newspapers and periodicalswere the victims of punitive action taken in the form of total closure, demand for security deposit, issuance of show cause notices, curtailment or total withdrawal of government advertisementand newsprint quota or officially sponsored mob attack on their offices. Zamir Niazi in his book Press in Chains (1986) wrote: “May 13th was the blackest day in the history of journalism in the subcontinent, when four newsmen were ordered to be flogged by summary military courts. Those ordered to be whipped were, Masudullah Khan (Pakistan Times, Rawalpindi), Iqbal Ahmed Jafri (Sun), Khawar Naeem Hashmi (Musawat, Lahore), and Nisar Zaidi (Nawa-I-Waqt) . Their offence included: ‘organizing meetings at open public places, raising slogans, displaying banners and starting hunger strike.’”

Perhaps the worst the press suffered was during the Martial Law administration of General Zia-ul-Haq legitimised under a Supreme Court judgment in the name of the so-called ” Law of Necessity.” But while this period may be remembered for its oppressive measures including long spell of censorship banning of independent and dissenting newspapers, arrest of editors and journalists , sentencing them to rigorous imprisonment under Martial Law regulations and even whipping them, it was also marked by memorable resistance put by the journalists and press workers led by the PFUJ and APNEC. This great struggle unprecedented in the annals of the Fourth Estate the world over began towards the end of November 1977 in Karachi only about five months following the advent of Gen. Zia’s Martial Law. The PFUJ’s struggle was triggered by the government’s ban on publication of Daily ” Musawaat”, Karachi. After the failure of efforts to convince the Martial Law authorities to lift the ban , the PFUJ and APNEC launched a campaign of hunger strike in Karachi from first of December 1977 o And within eight days of the struggle in which journalists and press workers from all over the country participated the government surrender and lifted the ban.
Egged on by its oppressive nature, the government again took recourse coercive methods against the dissenting press and banned the daily ” Musawat”, Lahore , and weeklies like ” Al-Fatah” and ” Meyar” and others, critical of the Martial Law regime. After the failure of protracted negotiations with the Government the national executives of PFUJ and APNEC decided to launch countrywide hunger strike movement from Lahore commencing from 30th April, 1978. The charter of demands included restoration of banned newspapers, release of “Musawat” editors, Messers Badaruddin and Zahir Kashmiri, and the paper’ s printer, Mir Jamilur Rahman, and reinstatement of dismissed journalists including office-bearers of PFUJ and APNEC employed in the government controlled NPT newspapers.
The historic movement was spread over two stages: one beginning in Lahore from April 30 and ending on May 30 and, the second beginning in Karachi from July 18 and ending on October 10, 1978. The two had their own distinct and memorable features marked by common inspiring spirit and enthusiasm. In the first phase’ in Lahore, the journalist and press workers who joined the hunger strike were arrested and sentenced under Martial Law Regulations from six months to one year rigorous imprisonment including three who were ordered to be flogged (Nasir Zaidi, Khawar Naeem Hashimi and Iqbal Jaferi were in fact flogged. The fourth, Masoodullah Khan was spared on the intervention of the doctor in view of Mr. Masood’s disability. It was during this stage that after having failed to suppress the movement for press freedom the military regime picked up the four renegades from the PFUJ and APNEC to create parallel PFUJ and APNEC pocket organisations known as ” Rashid Siddiqui Group”.These renegades who were given full publicity on official media supported the government and condemned the PFUJ’s struggle for press freedom exposing their true colours. As a result of the movement the government was forced to lift the ban on ” Musawat ” Lahore and release the arrested Journalists and Press workers by May 3oth but refused to reinstate the dismissed newsman from NPT papers. In addition, the government again banned ” Musawat ” Karachi. The PFUJ then at its meeting on June 12 at Karachi decided to resume the struggle from July 18, 1978.
The resumed struggle which started in Karachi with the arrest of PFUJ and APNEC President continued until 10th of October (almost two months and 25 days) had its own memorable features. For besides the journalists and press workers who came from all over the country to court arrest, scores of trade union workers, students and militant haris from interior of Sindh joined the movement and filled almost all the jails of Sindh. (During the Lahore struggle the arrested journalists and press workers were disbursed to almost all the jails of the province of Punjab). The Sindh phase of movement would also be remembered for the mass hunger strike unto death inside the jails. The hunger strike culminated in the acceptance of most of the APNEC-PFUJ demands by the Government. As a result “Musawaat” Karachi resumed its publication, arrested persons were released, and most of the 30 dismissed journalists of the NPT papers (Pakistan Times and Imroze) were reinstated (only four including the President of the PFUJ and APNEC were not taken back).
It was also during Gen: Zia-ul-Haq’s regime that ten senior journalists and office-bearers of the PFUJ belonging to the NPT papers – the Pakistan Times, Imroze and Mashriq – were similarly dismissed from service because they signed an appeal for ” Peace in Sindh ” when the government repressed and persecuted the people indiscriminately during the 1983 MRD Movement. The signatories to the appeal also included some 50 writers and poets on whom the doors of Radio and Television were closed as punishment. The journalists who were punished included Masood Ashar , Shafqat Tanvir Mirza , Azhar Javed , Mrs. Rakhshinda Hasan , Badarul Islam Butt, Aziz Mazhar , Aurangzeb, Mumtaz Ahmad , I.H. Rashid and Riaz Malik(late). This clearly proved that the Zia Government was callous and insensitive to the basic human rights of the people notwithstanding with its claim for Islamic justice . It was during this period that a most abominable version of the press censorship was imposed on newspapers wherein even Quranic verses and Prophet’s hadiths used to be censored if they reflected in any way on the person of Gen. ‘Parliament should not have a say in judges’ appointment’
ISLAMABAD: Parliament should not play any role in the appointments of judges and the Judicial Commission should solely be comprised of judges and non-political civil society, Pakistan Tehreek-e-Insaaf (PTI) Chairman Imran Khan said on Sunday.
Khan said this while addressing a press conference.
“We wonder why the issue of judges’ appointments was brought up in the 18th Amendment. It seems as if the Pakistan People’s Party (PPP) and the Pakistan Muslim League-Nawaz (PML-N) are playing a dual game and they want to drag the issue of constitutional reforms to divert the attention of the public from real issues”, said the PTI chairman while talking to media after the meeting of PTI’s Central Executive Committee (CEC). PTI announced that they have decided to file a case with the Election Commission of Pakistan (ECP) against rigging of the by-elections in Lahore and other constituencies. “We might consult the Supreme Court if necessary”, Imran Khan said.

The whole country is abuzz with the strong believe that ‘pressure’ on Nawaz Sharif emanated from judicial quarters. Whether this is true or not can only be ascertained once Mr Sharif comes clean about it. So far, he has not been forthcoming on this aspect of the matter. If true, it indicates that somebody tried to interfere in the functioning of parliament. This directly challenges the sovereignty and supremacy of that august body. For the first time in our history, parliament is trying to establish its supremacy. It cannot, and should not be held hostage by anyone, be it the judiciary or the executive. In the light of the past, it could be that the forces inimical to strengthening democracy are up to their old tricks. There have been many hurdles in the path towards democracy and Pakistan’s history is full of the immense struggle waged by the people against military dictatorships and authoritarian rule. Whenever there has been a coup by the military, it has always been supported by other state institutions, especially the judiciary that has regularly endorsed martial laws over the years.
In a press conference on Saturday, Nawaz Sharif denied the rumors about receiving a phone call from unknown quarters. Either Mr. Sharif did not think it through before he decided to speak up against the constitutional reforms and did not expect such a strong reaction, or he was under so much pressure that despite knowing that this would not go down well, he had no choice. This obviously leads one to speculate where that pressure came from?. In wake of recent nexus between Judiciary and PML-N, this is not a tough arithmetic question to be solved. Furthermore, Shehbaz Sharif’s meeting with COAS could not be ignored. PML-N is very much part of troika, how long it deny.

So, we should not expect anything “revolutionary” from “PPP Lite” of today. ZAB’s followers must have hung their heads in shame when “Shahji” conferred the award on LT.General Mujeeb. Did you know that Shahji’s forefathers issued a Fatwa declaring the 1857 uprising Haram? Of course they were handsomely rewarded with huge chunks of land for their “service”. I wonder whatever happened to those land holdings as poor Shahji doesn’t even own a car today!
