اگر یہ توھین رسالت ہے تو اس مولوی کو موت کی سزا کیوں نہیں سنائی گئی ؟

امام مسجد کوتوہین رسالت میں عمر قید
ملزموں کے وکیل کا کہنا ہے کہ انہوں نے سزا کے خلاف اپیل کی تیاری شروع کردی ہے اور ایک دو روز میں یہ اپیل لاہور ہائی کورٹ میں دائر کردی جائے گی۔
پنجاب کے ضلع ڈیرہ غازی خان کی انسداد دہشت گردی کی عدالت نے توہین رسالت کے الزام میں امام مسجد اور ان کے بیٹے کو عمر قید اور جرمانے کی سزا سنائی ہے۔
کرسچن ڈیموٹیک الائنس کے صدر جوزف فرانسس کے بقول یہ پہلا موقع ہے کہ جب توہین رسالت کے مقدمے میں کسی ملزم کو سزائے موت کی جگہ عمر قید کی سزا سنائی گئی ہے۔
انسداد دہشت گردی کی عدالت کے جج راؤ ایوب خان مارتھ نے یہ حکم مظفر گڑھ کی تحصیل کوٹ ادو کے رہائشی امام مسجد محمد شیفع اور ان کے بیٹے اسلم کے خلاف درج مقدمہ پر فیصلہ سناتے ہوئے دیا۔
وکیل صفائی کے مطابق تعزیرات پاکستان کی دفعہ دو سو پچانوے سی کے تحت توہین رسالت کے مرتکب کو سزائے موت یا عمر قید کے علاوہ جرمانہ بھی کیا جاسکتا ہے۔
عدالت نے حکم دیا کہ ملزمان کو جرمانے کی عدم ادائیگی کی صورت میں مزید چھ ماہ قید بھگتنا پڑے گی۔
وکیل صفائی عارف گورمانی کے بقول مدعی اور ملزم دو مختلف مسلک سے تعلق رکھتے ہیں اور فرقہ واریت کی وجہ سے یہ مقدمہ درج ہوا ۔وکیل کے مطابق مدعی کا تعلق بریلوی جبکہ ان کے موکلان دیو بند مسلک سے تعلق رکھتے ہیں۔
عدالت نے دونوں ملزموں کو مذہبی عقائد کی توہین کرنے کے الزام میں دس دس برس جبکہ انسداد دہشت گردی ایکٹ کی دفعات کے تحت پانچ ، پانچ سال قید کی سزا بھی سنائی ہے۔
عدالت نے حکم دیا کہ ملزموں کو سنائی جانے والی سزاؤں پر عمل درآمد ایک ساتھ ہی شروع ہوگا۔ عدالت نے یہ بھی ہدایت کی کہ ملزمان نے اپنے خلاف مقدمہ کے دوران جو عرصہ جیل میں کاٹا ہے وہ ان کی سزا میں شامل ہوگا۔
دونوں باپ بیٹا اپنے مقدمے کے اندراج کے بعد سے جیل میں ہیں اور عدالت نے آٹھ ماہ میں اس مقدمے پر کارروائی مکمل کی ہے۔
وکیل صفائی عارف گورمانی نے بی بی سی کے نامہ نگار عبادالحق کو بتایا کہ محمد شیفع اور ان کے بیٹے اسلم کے خلاف اس سال اپریل میں توہین رسالت کے الزام میں مقدمہ درج کیا گیا تھا۔
مقدمے کے اندراج کی درخواست پھول خان نامی شخص نے دی تھی۔
وکیل صفائی کے مطابق محمد شیفع اور ان کے بیٹے اسلم پر یہ الزام ہے کہ انہوں نے اپنی کریانے کی دکان کے سامنے برآمدے میں لگا میلاد اور مصطفیْ کانفرنس کا پوسٹر پھاڑ دیا تھا جو بقول استغاثہ توہین رسالت ہے۔
پولیس نے مقدمے میں مذہبی عقائد کی توہین کرنے اور انسداد دہشت گردی ایکٹ کی دفعات بھی شامل کی تھیں۔

ماہرین قانون کے تحت انسداد دہشت گردی کی عدالت کی سزا کے خلاف سات دنوں میں متعلقہ ہائی کورٹ کے روبرو اپیل دائر کی جاسکتی ہے جس پر ہائی کورٹ کے دو ججوں پر مشتمل بنچ سماعت کرے گا۔

MULTAN: A Pakistan court has jailed a Muslim prayer leader and his 20-year-old son for life on controversial blasphemy charges in the rural centre of the country, court officials said Tuesday.
The case follows the killing of Punjab provincial governor Salman Taseer by his bodyguard last Tuesday, after the outspoken politician called for reform of the law that was recently used to sentence a Christian woman to death.
Mohammad Shafi, 45, and his son Mohammad Aslam, 20, were arrested in April last year for removing a poster outside their grocery shop advertising an Islamic event in a nearby village which allegedly contained Quranic verses.
Judge Mohammad Ayub, heading an anti-terrorism court in the central Pakistani town of Muzaffargarh, handed down a life sentence to the pair on Monday, his assistant Faisal Karim told AFP by telephone.
The prosecution alleged organisers of the event, which commemorated the anniversary of the Prophet Mohammad’s birth, said the pair had “pulled the poster down, tore it and trampled it under their feet,” Karim said.
“The judge sentenced them to life imprisonment on charges of blasphemy and ordered them to pay a fine of 200,000 rupees ($2,350) each,” he said.
Liberal politicians and human rights activists in Pakistan say the blasphemy law, which carries the death penalty for the worst offences, is sometimes used to settle personal scores and encourages extremism.
Defence counsel Arif Gurmani vowed to challenge the verdict in the high court because “it has been given in haste” and was the result of inter-faith rivalries, he said.
“Both are Muslims. The case is the result of differences between Deobandi and Barelvi sects of Sunni Muslims,” he said.
“Shafi is a practising Muslim, he is the imam of a mosque and he had recently returned from a pilgrimage to Saudi Arabia…. I am defending them because I am convinced they are not guilty of blasphemy,” he said.
Nobody has been executed in Pakistan for blasphemy and those given the death penalty have so far had their sentences overturned or commuted on appeal.
Since Taseer’s assassination, right-wing religious clerics have heaped praise on his killer and stoked controversy over reform of the law. The government has said it has no plan to reform the law.
The controversy was sparked when former information minister Sherry Rehman tabled a private member’s bill in November, seeking to abolish the death penalty for blasphemy.

LAHORE: Two Christian women were beaten and publically humiliated by an angry mob over apparently frivolous blasphemy allegations and they and their family are now in hiding for fear of being killed, The Express Tribune has learnt.
“None of our relatives is ready to let us stay with them. They fear the wrath of the extremists, particularly after the assassination of Salmaan Taseer,” a male member of the family said over the phone from an undisclosed location.
The family and a non-governmental organisation that is helping them asked that their identities not be revealed, lest it put them in further danger. The names mentioned here are fictitious.
According to the family, the allegations stem from a dispute between Amina, a Muslim, and her sister-in-law Zahira, a Christian, in an East Lahore locality. The two got into an argument on Tuesday night and though it appeared to have been settled, on Wednesday morning, after her husband Zahid had gone to work, Amina walked out onto the street and started shouting that Zahira had abused the Holy Prophet (pbuh).
A short while later, a group of men led by Muhammad Sameer, a member of a religious organisation keen on raising its sectarian profile, forced their way into the house and started slapping Zahira, said another of her brothers, Sohail. “Other men and women from the neighbourhood started gathering at the house too and they beat up my sister and mother. They were the only people in the house,” he said.
“We tried our best to get her to confess her crime,” Sameer told The Express Tribune. As a member of the religious organisation, he said he could not tolerate any derogatory remarks about the Holy Prophet (pbuh).
Sameer added that he was very proud of his wife’s performance during the mob beating. “She beat Zahira more than anyone else. Her hand is so swollen that she hasn’t been able to make rotis since the day of the incident. I’ve been getting my meals from a restaurant,” he said.
Malik Mumtaz Qadri, the self-confessed assassin of Salmaan Taseer, is a member of the same group as Sameer. The group also runs a twenty-four hour cable TV channel.
Khadim Hazoor, Sameer’s son-in-law and another participant in the beating, said that the women’s faces were blackened and they were made to wear necklaces of shoes and paraded around the locality on donkeys to humiliate them. He said the women denied blaspheming and repeatedly touched their feet seeking mercy.
He said the people of the locality would not allow Zahid or his family to return to their house, which he lives next door to. He claimed that the fight between Zahira and Amina the night before the incident revolved around the upbringing of Zahid and Amina’s 18-month-old daughter. Amina had wanted to raise her daughter as a Muslim, but Zahira wanted her niece to be raised as a Christian, he said.
Hazoor accused Zahid of “cheating Islam” by pretending to convert from Christianity to Islam so he could marry the Muslim girl. “We will not let them live in this house. He has not only cheated Amina but also Islam,” he said.
Zameer Khan, an NGO worker, helped the family flee the locality after they were attacked. “Apparently there was no blasphemy, just an argument between two women,” he said.
He said after hearing of the incident, he had reached the scene to find the women being attacked. He said he had asked the mob if anyone had heard Zahira utter any blasphemous remarks, to which they all replied in the negative. He said he persuaded them to let the women go while he investigated the matter. He then helped relocate the family temporarily. He said he had also convinced the mob not to involve the police.
