Mullah’s crusade against Fauzia Wahab: Jihadi media at its worst – by Ahmed Iqbalabadi
Jang Group has been running a campaign against the PPP and its leadership for the last two years. At the forefront of this campaign are jihadi mindset reflectors like Ansar Abbasi and pseudo-intellectuals like Shahid Masood and Shaheen Sehbai. Add the mischievous Hamid Mir and the investigative journalism of Kamran Khan, what we have are all the ingredients for trouble.
Ansar Abbasi (a leading member of the Pakistani Taliban Union of Journalists – PTUJ) is at it again. With Asif Zardari being at the receiving end from the very beginning, Ansar Abbasi and his group is now continuously targeting the most vocal supporters of the PPP at the leadership level i.e. Fauzia Wahab and Babar Awan. To their credit, both Fauzia Wahab and Babar Awan have been clear in their support on matters which are most “mind boggling” to Ansar Abbasi. These include the judges restoration, the NRO problem and now the Presidential immunity. Babar Awan has been alleged to have received “bribe” from Harris Steel Mills fraudsters and he has been punched every now and then in the media by Ansar Abbasi and Shahid Masood. As far as Fauzia Wahab is concerned, she has been on the receiving end of the spinning and twisting by Ansar Abbasi for some time now. In December 2009 was the matter of her son’s SMS to Ansar Abbasi which was spun into a “threat” by Ansar Abbasi’s chotu named Ahmed Noorani which was another grand piece of investigative journalism. As it was not a prosecutable offence and that already an apology was tendered, the campaign was made to incite vigilante justice on Fauzia Wahab and her son. Recently in a TV program (Dunya News, 10th May) Ansar Abbasi tried to defame her by saying that “Inn ka bus na chalay to humary garden utar deyn”. What he said came under “slander” of the Defamation Ordinance 2002 and Fauzia Wahab has sent him a notice seeking a public apology else she will file legal proceedings against him. Instead of being apologetic for his mistake, Ansar Abbasi has started using his twisted mind to extract revenge.
In a TV program called “In Focus with Kamran Yousuf” aired on Dawn News on Friday, May 21, 2010, Fauzia Wahab was with Ahsan Iqbal and Ansar Abbasi. Again on the matter of Presidential immunity, Ansar Abbasi was quoting the example of Hazrat Umar (RA) that he was called to the court and that his rule was that of “good governance”. Fauzia Wahab said that at the time of Hazrat Umar (RA) there was no constitution and it was the Quran that was followed. Did she not give a fact? To substantiate her point, she said which was published in Jang but not in The News “Agar Aaien mayn Wirasat (Inheritance) ka koi masla darj hay to hum uss ko issi tarah leyn gay aur iss mayn tabdeeli ki koi gunjaish nahee” but as the Constitution clearly gives out immunity to the President, therefore, the Constitution has to be followed. What followed next was a deliberate campaign led by Jang Group with the impact of Ansar Abbasi clearly visible. Words like “Gunah-e-Kabeera” and at some places “Blasphemous” have been said by the likes of Mufti Munib, Mufti Naeem, Qazi Hussain Ahmed, Hafiz Hussain, Amir Liaquat Hussain etc.
My question is: Has anyone even heard what she has said? How many people have actually watched the program? Have you had all the information to pass a judgment against a person? As far as I know living abroad, Geo is the most popular channel and even educated people do not know much about Dawn News. So whatever judgment people are passing are possibly without the full picture. We as a nation have started believing in what is being shown to us than what we actually see.
As far as Ansar Abbasi is concerned, he has all the reasons to malign Fauzia Wahab. She will hopefully file a suit against him by the end of the month and he would like her to be pressured in not doing so. At the same time, he is thinking that Fauzia Wahab will run away with all the pressure. I hope and pray to Almighty that she remains there to give people Ansar Abbasi a tough time.

ISLAMABAD: Pakistan People’s Party (PPP) Information Secretary Fauzia Wahab has clarified that her statement regarding comparison between the holy Quran and Pakistan’s Constitution has been misquoted.
In a statement issued from the media cell of the PPP Central Secretariat, she said she had never prioritised the Constitution over the holy Quran. She said being a true Muslim, she believed in the holy Quran and the Sunnah as the supreme law. She said she acknowledged Hazrat Umer (RA) as the best reformer in the world.
Fauzia said some people were misquoting her statement in the context that she had prioritised President Zardari over Hazrat Umer (RA). Fauzia said she revered the holy Quran, Sunnah and Hadith of Hazrat Mohammad (PBUH) from the cores of her heart. She said the 1973 Constitution was formed in line with the Islamic injunctions. Fauzia Wahab said her statement was misquoted, reiterating that she considered the holy Quran as the supreme law, and all other constitutions of the world were secondary to the holy Quran.

ISLAMABAD: Amid extremely controversial utterances by PPP leader Fauzia Wahab to justify President Zardari’s immunity, the Law Minister Babar Awan is appearing before the apex court this week to secure Asif Ali Zardari from being tried in corruption cases when the Supreme Court, even in its NRO judgment, has already referred to the personal examples set by the second Caliph Hazrat Umer Farooq (RA) to uphold the principle of accountability for all.
While Fauzia has already badly exposed herself by suggesting that Hazrat Umer (RA) had appeared in the court of law because there was no constitution at that time, it is now Babar Awan’s turn to show his skills.
Awan, who claims to be a religious scholar, would have to innovate something extraordinary to protect his political godfather as the NRO judgment emphasised on the question of equality and even quoted the example of the second Caliph of Islam to ensure that no one was above the law in Islam. It also said there must not be any discrimination between the rulers and the ruled.
“The second Caliph Hazrat Umer Farooq (RA) had a shirt (chogha) on his body. He was asked to explain regarding the cloth of that shirt because the cloth of shirt according to his share — was much less than the body of Caliph. The Caliph replied that he had used the share of his son for making his own shirt,” Justice Ch Ijaz Ahmed wrote in his separate note that was part of the NRO judgment, adding, “This is the type of accountability which we have to follow to save the nation to put on a right path.”
Interestingly, former president General Musharraf’s immunity under Article 248(1) too was denied by the 13-member bench, headed by Justice Khalilur Rehman Ramday, after the Chief Justice of Pakistan lawyers’ referred to the examples of Hazrat Umer Farooq (RA), who had appeared before the courts several times.
It was because of the Islamic foundation of our constitution that the 17-member bench of the Supreme Court, which heard the NRO case and handed down verdict on Dec 16, 2009, unambiguously said that all are equal in Islam. Referring to the teachings of Islam, the SC said, “In His (Almighty Allah) service and obedience, all humans are equal and stand on the same level without any discrimination to all as one race and one people before Him, no one claiming any special privileges and honours.”
Referring to a previous order, the SC also referred to “immunity” as one of the reasons for corruption and said, “The anti-corruption and penal laws have remained ineffective due to their inherent defect in adequately meeting the fast multitudinous growth of corruption and bribery. Corruption in high places has remained unearthed leading to a popular belief that immunity is attached to them. To combat corruption the whole process and procedure will have to be made effective and institutionalised.”
The government reports suggest that Babar Awan is all prepared and well equipped with all possible arguments to change the mind of the apex court from directing the federal government to write to the Swiss authorities. However, the question of “equality” raised in the NRO judgment, is too strong to be contested. Terming equality as an essential requisite of justice, the NRO judgment said that when there is discrimination and partiality between people, there is no justice.
“The Code of Allah demands absolute equality of rights between all people without any discrimination or favouritism between man and man and between man and woman on any count,” said the court order.
Referring to a Quranic verse, the judgment said, “This verse clearly establishes equality of all men and women on the basis of common parentage, and as such discounts all claims of superiority or discrimination for any person or group of persons. There is no rational or logical ground for such claims, and therefore, it is unreal and unnatural to demand discrimination between man and man or between man and woman on any count.”
It added, “Besides’ all human beings are servants (ibid) of Allah and therefore equal. They are all created by Allah and all are His servants alone. As such they are all equal and enjoy equal rights in all areas of life. In His service and obedience, all humans are equal and stand on the same level without any discrimination, all as one race and one people before Him, no one claiming any special privileges and honours.”
For those claiming immunity for a selected few, the SC order rejects all such notions by saying, “This concept of equality bestows equal rights upon all members of the human race and leaves no room for any discrimination of any kind, whether by colour, creed, race or sex. If there is any discrimination anywhere, it is man made, not divinely ordained, and therefore, must be denounced, condemned and discarded. Any such discrimination is unnatural and artificial and goes against the basic doctrine of Tawhid. As such it will endanger the right balance and stability of human social life.”
And where the discrimination is valid, the NRO judgement seems to have not been read by most in the government, said, “If there is any discrimination for any man or woman in Islam, it is on merit and on merit alone. Those who develop their personal relationship with Allah fear Allah, attain degrees of piety and taqwa of Allah, and reach higher stations of excellence in the Sight of Allah. However, even they stand equal with others in the enjoyment of rights in society, and can claim no superiority or favouritism over others so far as social rights are concerned.”
Referring to question of “Equality of Rights”, the judgment said, “It is implicit in the doctrine of Tawhid and is also an essential ingredient of justice and equality that all people must enjoy equal rights without discrimination on any count in all fields and departments of life. In the enjoyment of social, political and religious rights, there must not be any discrimination between ruler and ruled, employer and employee, rich and poor and man and woman: all should enjoy these rights freely, equally and without any check or restriction. Denial of any of these rights to any member would, in fact, be a denial of the doctrine of Tawhid.”
The logical consequences of the above principle in practice, the judgment said, demands absolutely equal treatment of all citizens, without any reservation, in all areas of life.

PESHAWAR/LAHORE: The Ahle Sunnat Wal Jamaat Khyber Pakhtunkhwa (KP) chapter on Sunday demanded Pakistan People’s Party (PPP) Central Information Secretary Fauzia Wahab to tender an apology to the nation for her statement.
The religious group demanded that the PPP should take action against Fauzia over the statement, and told the party to stop her from issuing such statements, otherwise the PPP would be responsible for it.
Former MPA and Ahle Sunnat Wal Jamaat KP Vice President Mohammad Ibrahim Qasmi and City President Maulana Muhammad Ismail issued a statement in which they demanded the PPP central leadership take party action against Fauzia Wahab, as she had hurt the sentiments of Muslims.
According to media reports, the information secretary ‘revealed’ that there was no constitution in the era of Hazrat Omar (RA), as there was only the Holy Quran.
Talking to a private TV channel in a programme convened on the immunity enjoyed by President Asif Ali Zardari, she said that the court of that time subpoenaed Hazrat Omar (RA) for having no constitution, but today’s judiciary could not call Zardari thanks to Article 248-A of the constitution.
The Ahle Sunnat Wal Jamaat leaders lambasted the statement made by Fauzia Wahab. They also demanded that she should immediately tender an apology to the whole nation.

KARACHI: Pakistan People’s Party (PPP) Information Secretary Fauzia Wahab on Saturday served a legal notice on Editor Investigation, The News, Islamabad, Ansar Abbasi under Section 3 (1) of Defamation Ordinance, 2002.
Talking to media persons at the PPP Sindh chapter media cell, she said through her legal notice, she had demanded an unconditional public apology from Ansar Abbasi within 14 days or she would initiate legal proceedings against him for the recovery of Rs 200,000,000 (Rs200 million) as damages. “I am an aggrieved person and justice should be provided to me,” she said.
She said in a TV programme, ‘Dunya Today,’ telecast on 10th of May, Ansar Abbasi, referring to her, allegedly uttered words ‘in ka bus chale to humari gardan utaar dein’, (if it was up to her (Ms Fauzia Wahab), she would slit our throats).
“These words were below the civilisation values and immoral, and tantamount to my insult and insult of my party,” she added. The PPP leader said the media was independent, but it did not mean that ‘irresponsible statements’ should be made. She said she was in politics for the last 30 years but not a single FIR had been registered against her on criminal or corruption charges. She said under these conditions, Ansar Abbasi’s words were allegedly an assault on her integrity.
Fauzia Wahab also distributed copies of her legal notice served through her lawyer ‘Mumtaz and Associates’ to media persons on the occasion.
The legal notice said Ansar Abbasi was a ‘senior and respected journalist’ of Pakistan. As such his (Ansar’s) views and comments influence the general populace. That the media has immense power but with this power also comes certain responsibility which you (Ansar) have ‘blatantly failed’ to discharge by making a ‘deliberate false statement’, defaming Fauzia Wahab in the eyes of public at large.
The legal notice said Ansar Abbasi’s statement sketched a negative picture of Fauzia Wahab and it not only caused mental torture to her but also her family. Additionally, such a statement has painted a gruesome picture of her that she was involved in ‘criminal activities’, which was far away from the reality. The statement has injured the reputation of her and also lowered her reputation in the eyes of the general populace.
The notice warned Ansar Abbasi that if he used this notice for making ‘further defamatory remarks’ towards Ms Wahab, the same shall provide an additional cause of action against him, exposing him to exemplary damages.
Ms Wahab avoided a direct reply to a question as to why the PPP was not extending its reconciliation policy to the media.
A journalist asked as to whether the PPP-led government had launched an assault on the independence of the media as Sindh Katchi Abadis Minister Rafiq Engineer had also threatened a private TV channel with damages suit.
Rafiq Engineer also present on the occasion replied that the TV channel had allegedly indulged in his ‘character assassination’. He said the TV channel had allegedly telecast that he was involved in ‘land grabbing’ in Hawksbay Scheme-42 and was allegedly ‘selling jobs’ to people in Lyari. He said the TV channel was allegedly ‘harassing and blackmailing’ him.
About summoning of Law minister Babar Awan by the Supreme Court, Fauzia Wahab said the judiciary was independent and she respected it. She said the law minister would appear before it. She said it was a ‘strange thing’ that all eyes were focused on ‘one case’, though there were over 14,500 registered cases in the country.
In reply to another question, she said she failed to understand as to why an issue was being created with regard to the PPP’s core committee. She said the core committee was a ‘consultative body’ and it had no legal status.
She said in developed countries, the rulers also depended on their ‘kitchen cabinet’ and tended to make consultations with them. She said the PPP’s core committee was not an unusual thing. About Punjab Law Minister Rana Sanaullah’s criticism of Interior Minister Rehman Malik, she said the PPP still believed in the reconciliation policy towards the PML-N.
Fauzia Wahab, who is also the chairperson of Standing Committee on Finance, said the finance adviser would give a briefing to the committee on May 21st about forthcoming budget. She said they had recommended that a directory comprising names of all taxpayers should be prepared. She opined that the country would not achieve self-reliance until the tax culture was strengthened in the country.
Ansar Abbasi replies: The contents of Fauzia Wahab’s reported legal notice, which I have not yet received, and her subsequent press conference are most puzzling. It appears that on the television programme in question, one of my generalised comments, made in a specific context and that too in the presence of Ms Wahab, has been stretched unnecessarily by the PPP information secretary. I was making a general and sarcastic statement about the attitude of the government/PPP towards certain journalists, who have been receiving threats and death messages from certain members of the PPP and its government. I was in no way implying that Ms Wahab had a criminal record or any personal vendetta against me or intended to harm me personally.
Ms Wahab did not react there and then. I believe what she has now said is either her second thought or the consequence of someone trying to mislead her. Her latest conclusions are simply far-fetched. What I had stated metaphorically — illustrating the present PPP/government’s hostility towards certain journalists — is seemed to have now been taken in a literal sense. This was not my intention. Therefore, the question of defaming her or casting any aspersions on her character simply does not arise.

Some day we need to stop scoring political mileage in the name of Islam. Pakistan’s problem is not Islam; it is these fanatical half wits who exploit Islam for their personal gains. What Fauzia Wahab has said is a historical truth and nothing else. If Pakistan does not want to accord constitutional immunity to its president then Parliament should amend the constitution. It cannot be done away because some Sheikh, some Saddiqi, some Abbasi, some Bokhari or some other similar kind says so.
Quran considers Fitna worse than a murder. Pakistan is an organised society and its unifying force is its constitution. Some semi literate should not disrespect the constitution. There is nothing in the Quran that is un-islamic. Our constitution holds together and Islamic nation where other nationalities are also living peacefully with full religious, political and social rights.
Islam is not a static religion. It provides answers to all the evolving questions and can face all emerging challenges. Mullah is not getting along with Islam. He wants to turn the tide of time full circle back and wants to live in the past. Pristine glory of Islam is not in its past; it is in its present and future. Islamic past is to be respected and lessons are to be learnt for the present and the future.
To read between the lines so that some laboured arguments can be constructed only to defame a person is a highly dishonest and irreligious act. These so called champions of Islam do a great disservice to Islam itself by invoking Islamic principles for petty gains.
This is the problem with a mindset. Who said that the Quran is a history? The Quran is a ‘living’ book and will remain living and relevant to all times till the judgement day. Mullah and their fanatical followers are not the only believers in Pakistan. Pl understand the agenda of the enemies of Islam and Pakistan.
According to the teachings of the Quran we should be very careful in our conduct so that we do not disrupt an Islamic society.
Some so-called Islamists even among Journalists while talking about people in authority simply forget that they are also Muslims and they may have fear of God in them. They paint them as mere devils out there to destroy the country.
We will have to shun this extremism so that the society is provided an opportunity to flourish on normal lines. It is so boring to hear the same thing over and over again in a TV programme in the name of freedom of speech. It is an insult to people in total disregard to common sense.
In the small chequered history of Pakistan two groups have destroyed Pakistan: overambitious generals and fanatical, halfwit Islamists.
Ansar Abbasi and his jihadi links are seeking to create a lot of nuisance for the PPP leadership.
Fauzia Wahab is their latest target. Sipah-e-Sahaba and other sectarian and jihadi organisations have been mobalised by Ansar Abbasi in order to exert negative pressure on Fauzia Wahab.
It appears to be a very careful ploy crafted by the Jang Group for damage control in the aftermath of the (1) Hamid Mir saga, and (2) Legal notice to Ansar Abbasi.
Jang Group is playing a very dangerous game.
Mir Shakilur-Rehman must be careful in playing with fire through hate speech and disinformation. In the end, the people of Pakistan will have no option left but to boycott Jang Group’s newspapers and TV channels.
Another interesting episode in this context is the recent victory of the PPP’s controversial former minister, Jamshed Dasti, in a by-election in Muzzafargarh. The media had been running an aggressive campaign against what it termed Dasti’s controversial and confrontational style of politicking and his fake degree. But the voters thought otherwise, wilfully sending the politician back to parliament with an impressive 55,364 votes.
The media in most countries (especially India and Pakistan) has become a vivid reflection of urban middle-class sentiments and aspirations. These sentiments have increasingly become a strange mixture of political conservatism, religious pretensions and economic liberalism. But as the media (especially electronic) in these two countries now squarely bases its policies and agendas, ‘analysis’ and predictions on such neo-conservative middle-class sentiments, it consequently misses out on recognising and understanding the core economic, political and cultural drivers behind the voting habits of people from semi-urban and rural areas. These two still constitute a majority of voters in both India and Pakistan.
Thus, at least in the context of Pakistan, whereas the mainstream electronic media fails miserably to influence the figurative masses’ political orientation and voting habits, it is, however, successfully cultivating and catering to the already conservative and quasi-reactionary bearings of the Pakistani middle-class. It is pulling this class away even further from matters such as populist democracy and a healthy appreciation of the land’s traditional pluralistic polity based on sectarian and ethnic diversity that can only be maintained through democracy.

She said nothing which can be termed as blasphemous, she just stated a fact i.e. there was no constitution at the time of Caliph Umer !
Moreover it was Ansar Bakwasi who cited Caliph Umer and Fouzia Wahab told him not to cite Caliph Umer’s example as that’s irrelevant !
In the end of the program, yellow-journalist Ansar Bakwasi uttered the words “you have hurt feelings of many”, which sounded like a threat and the day-long propaganda campaign later materialise Ansar Bakwasi’s threat to Fouzia Wahab !!!

1. What is ‘the constitutional procedure’ for the selection of a Caliph according to the Quran?
2. If there is any such procedure, why do we witness four different ‘constitutional procedures’ in the selection of the first four caliphs of Islam after the Prophet’s (pbuh) death?

Dear All; Ref Ms Fouzia Wahab Statement in legal terms Constitution of the Country reflects the collective thoughts of the people of that Country expressed through the wisdom of its chosen representatives. In Pakistan collective thinking of the people of Pakistan as expressed in the constitution demonstrate that people of Pakistan have chosen to limit their sovereignty within the limits prescribed by Holy Quran and Sunnah. So Art 2-A read with other Islamic provisions clearly says that chosen representatives shall legislate only within the boundaries prescribed by Allah. Now here we may have a query who has the power to interpret or define the term ‘Limits prescribed by Allah”? For examle Parliamentary system is Islamic or unislamic even State is an Islamic concept or not? Banking is Hilal or Haram and so on; answer to this query is that the interpretation and definition of Islam is sole prerogative Chosen representative(s) of People only they have the right to define the limits and this principle is recognized by SC in Hakim Khan case (PLD 1992 SC 595).
Here comes another theoretical preposition what if People of Pakistan take a decision to become a secular state and withdraw the limits prescribed on the chosen representatives to legislate within the boundaries prescribed by Islam. Again my Answer is yes people of Pakistan can surely decide and implement their will through their representatives. We have seen this transformation in west where people of Europe tranformed their concept of sovereignty and religious domination has eclipsed.
I hope this note will add a little in this otherwise superb talk that is going on.

Muhammad Ovais Khan, if that’s the case then shouldn’t the entire Supreme Court (which is simply an infidel system) step down and be replaced by Qazi court. Since Iftikhar Chaudhry is not trained in islamic law he should voluntarily give up his (unislamic) position and offer it to someone with religious authority.

LAHORE: A local court on Monday put off till May 27 the hearing of an application seeking registration of a case against PPP MNA Fauzia Wahab for her remarks on Quran and the constitution.
The applicant, Mehwish Chaudhry, argued Fauzia’s remarks have hurt the sentiments of Muslims. Therefore, the court should order the Nishtar Town Police Station to file an FIR against Fauzia under Section 295-A and C.

Shibli Naimani in Al Farroq compiled many incidents based on false narrations. I have read History by Ibn Khaldun, History by Tabaqat Ibn Saad, and Al Bidaya Wal Nihaya and haven’t found any such narrations. As per Hujjatul al Baligha by Shah Waliullah: For more than 2 centuries Muslims used to follow Quran and Sunnah directly without any Fiqh interpretation. Fiqh comes much later. Fiqh means understanding of Deen not Maslak like Fiqh Hanafi etc.etc. GEO TV, Ansar Abbasi and Aamir Liaquat Hussain should be ashamed of themselves before quoting False Narration on Hazrat Omar [May Allah be pleased with him] – Ansar Abbasi, Ahsan Iqbal and Aamir Liaquat have all committed Blasphemy by narrating a Lie and False Narration upon Hazrat Omar that he was [Allah forbid] was called by Qazi 10 times [where is the reference]. Shame of Jang Group who is not only indulged in Lies but Blasphemy and Tabbarra on Sahaba Kiram as well. Many of the narration regarding Hazrat Omar facing courts are false. ask for the reference from where they quote and then if it is Tabari then please ask about narrators.

Prophet Mohammad [PBUH]’s Hadith is as under:
On the authority of Abu Sa’id (may Allah be pleased with him), who said that the Messenger of Allah (PBUH) said: Let not any one of you belittle himself. They said: O Messenger of Allah, how can any one of us belittle himself? He said: He finds a matter concerning Allah about which he should say something, and he does not say [it], so Allah (mighty and sublime be He) says to him on the Day of Resurrection: What prevented you from saying something about such-and-such and such-and-such? He say: [It was] out of fear of people. Then He says: Rather it is I whom you should more properly fear. [Sunnan Ibn Majah with a sound chain of authorities]

BLASPHEMY LAW AS PER QURAN AND HADITH AS UNDER:

The scholars are unanimously agreed that a Muslim who insults the Prophet (peace and blessings of Allaah be upon him) becomes a kaafir and an apostate who is to be executed. This consensus was narrated by more than one of the scholars, such as Imaam Ishaaq ibn Raahawayh, Ibn al-Mundhir, al-Qaadi ‘Iyaad, al-Khattaabi and others.
Al-Saarim al-Maslool.
This ruling is indicated by the Qur’aan and Sunnah.
In the Qur’aan it says (interpretation of the meaning):
“The hypocrites fear lest a Soorah (chapter of the Qur’aan) should be revealed about them, showing them what is in their hearts. Say: ‘(Go ahead and) mock! But certainly Allaah will bring to light all that you fear.’
If you ask them (about this), they declare: ‘We were only talking idly and joking.’ Say: ‘Was it at Allaah, and His Ayaat (proofs, evidences, verses, lessons, signs, revelations, etc.) and His Messenger that you were mocking?’
Make no excuse; you disbelieved after you had believed” [al-Tawbah 9:64-66]
This verse clearly states that mocking Allaah, His verses and His Messenger constitutes kufr, so that applies even more so to insulting. The verse also indicates that whoever belittles the Messenger of Allaah (peace and blessings of Allaah be upon him) is also a kaafir, whether he was serious or joking.
With regard to the Sunnah, Abu Dawood (4362) narrated from ‘Ali that a Jewish woman used to insult the Prophet (peace and blessings of Allaah be upon him) and say bad things about him, so a man strangled her until she died, and the Prophet (peace and blessings of Allaah be upon him) ruled that no blood money was due in this case. Shaykh al-Islam Ibn Taymiyah said in al-Saarim al-Maslool (1/162): This hadeeth is jayyid, and there is a corroborating report in the hadeeth of Ibn ‘Abbaas which we will quote below.
This hadeeth clearly indicates that it was permissible to kill that woman because she used to insult the Prophet (peace and blessings of Allaah be upon him).
Abu Dawood (4361) narrated from Ibn ‘Abbaas that a blind man had a freed concubine (umm walad) who used to insult the Prophet (peace and blessings of Allaah be upon him) and say bad things about him. He told her not to do that but she did not stop, and he rebuked her but she did not heed him. One night, when she started to say bad things about the Prophet (peace and blessings of Allaah be upon him) and insult him, he took a short sword or dagger, put it on her belly and pressed it and killed her. The following morning that was mentioned to the Messenger of Allaah (peace and blessings of Allaah be upon him). He called the people together and said, “I adjure by Allah the man who has done this action and I adjure him by my right over him that he should stand up.” The blind man stood up and said, “O Messenger of Allaah, I am the one who did it; she used to insult you and say bad things about you. I forbade her, but she did not stop, and I rebuked her, but she did not give up her habit. I have two sons like pearls from her, and she was kind to me. Last night she began to insult you and say bad things about you. So I took a dagger, put it on her belly and pressed it till I killed her.” Thereupon the Prophet (peace and blessings of Allaah be upon him) said: “Bear witness, there is no blood money due for her.” (Classed as saheeh by al-Albaani in Saheeh Abi Dawood, 3655)
It seems that this woman was a kaafir, not a Muslim, for a Muslim could never do such an evil action. If she was a Muslim she would have become an apostate by this action, in which case it would not have been permissible for her master to keep her; in that case it would not have been good enough if he were to keep her and simply rebuke her.
Al-Nasaa’i narrated (4071) that Abu Barzah al-Aslami said: A man spoke harshly to Abu Bakr al-Siddeeq and I said, ‘Shall I kill him?’ He rebuked me and said, ‘That is not for anyone after the Messenger of Allaah (peace and blessings of Allaah be upon him) .’” (Saheeh al-Nasaa’i, 3795)
It may be noted from this that the Prophet (peace and blessings of Allaah be upon him) had the right to kill whoever insulted him and spoke harshly to him, and that included both Muslims and kaafirs.
The second issue is: if a person who insulted the Prophet (peace and blessings of Allaah be upon him) repents, should his repentance be accepted or not?
The scholars are agreed that if such a person repents sincerely and regrets what he has done, this repentance will benefit him on the Day of Resurrection and Allaah will forgive him.
But they differed as to whether his repentance should be accepted in this world and whether that means he is no longer subject to the sentence of execution. Maalik and Ahmad were of the view that it should not be accepted, and that he should be killed even if he has repented.
They quoted as evidence the Sunnah and proper understanding of the ahaadeeth:
In the Sunnah, Abu Dawood (2683) narrated that Sa’d ibn Abi Waqqaas said: “On the Day of the Conquest of Makkah, the Messenger of Allaah (peace and blessings of Allaah be upon him) granted safety to the people except for four men and two women, and he named them, and Ibn Abi Sarh… As for Ibn Abi Sarh, he hid with ‘Uthmaan ibn ‘Affaan, and when the Messenger of Allaah (peace and blessings of Allaah be upon him) called the people to give their allegiance to him, he brought him to stand before the Messenger of Allaah (peace and blessings of Allaah be upon him). He said, “O Prophet of Allaah, accept the allegiance of ‘Abd-Allaah.” He raised his head and looked at him three times, refusing him, then he accepted his allegiance after the third time. Then he turned to his companions and said: “Was there not among you any smart man who could have got up and killed this person when he saw me refusing to give him my hand and accept his allegiance?” They said, “We do not know what is in your heart, O Messenger of Allaah. Why did you not gesture to us with your eyes?” He said, “It is not befitting for a Prophet to betray a person with a gesture of his eyes.” (Classed as saheeh by al-Albaani in Saheeh Abi Dawood, 2334)
This clearly indicates that in a case such as this apostate who had insulted the Prophet (S), it is not obligatory to accept his repentance, rather it is permissible to kill him even if he comes repentant.
‘Abd-Allaah ibn Sa’d was one of those who used to write down the Revelation, then he apostatized and claimed that he used to add whatever he wanted to the Revelation. This was a lie and a fabrication against the Prophet (peace and blessings of Allaah be upon him), and it was a kind of insult. Then he became Muslim again and was a good Muslim, may Allaah be pleased with him. Al-Saarim 115.
With regard to proper understanding of the ahaadeeth:
They said that insulting the Prophet (peace and blessings of Allaah be upon him) has to do with two rights, the right of Allaah and the right of a human being. With regard to the right of Allaah, this is obvious, because it is casting aspersions upon His Message, His Book and His Religion. As for the right of a human being, this is also obvious, because it is like trying to slander the Prophet (peace and blessings of Allaah be upon him) by this insult. In a case which involves both the rights of Allaah and the rights of a human being, the rights of the human beings are not dropped when the person repents, as in the case of the punishment for banditry, because if the bandit has killed someone, that means that he must be executed and crucified. But if he repents before he is caught, then the right of Allaah over him, that he should be executed and crucified, no longer applies, but the rights of other humans with regard to qisaas (retaliatory punishment) still stand. The same applies in this case. If the one who insulted the Prophet (peace and blessings of Allaah be upon him) repents, then the rights of Allaah no longer apply, but there remains the right of the Messenger of Allaah (peace and blessings of Allaah be upon him), which still stand despite his repentance.
If it is said, “Can we not forgive him, because during his lifetime the Prophet (peace and blessings of Allaah be upon him) forgave many of those who had insulted him and he did not execute them?” The answer is:
The Prophet (peace and blessings of Allaah be upon him) sometimes chose to forgive those who had insulted him, and sometimes he ordered that they should be executed, if that served a greater purpose. But now his forgiveness is impossible because he is dead, so the execution of the one who insults him remains the right of Allaah, His Messenger and the believers, and the one who deserves to be executed cannot be let off, so the punishment must be carried out. Al-Saarim al-Maslool, 2/438
Insulting the Prophet (peace and blessings of Allaah be upon him) is one of the worst of forbidden actions, and it constitutes kufr and apostasy from Islam, according to scholarly consensus, whether done seriously or in jest. The one who does that is to be executed even if he repents and whether he is a Muslim or a kaafir. If he repents sincerely and regrets what he has done, this repentance will benefit him on the Day of Resurrection and Allaah will forgive him.
Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) wrote a valuable book on this matter, entitled al-Saarim al-Maslool ‘ala Shaatim al-Rasool which every believer should read, especially in these times when a lot of hypocrites and heretics dare to insult the Messenger (peace and blessings of Allaah be upon him) because they see that the Muslims are careless and feel little protective jealousy towards their religion and their Prophet, and they do not implement the shar’i punishment which would deter these people and their ilk from committing this act of blatant kufr.

Ansar Abbasi is like a rabid dog and does not miss any chance of biting any one who has a rational approach. Fauzia Wahab didnt compare anyone with anyone. She just told the truth. With Quran to be followed in all matters at the time of Caliphate there was no such document known as Constitution. But here in Pakistan the matters are governed by The Constitution of Pakistan. Every institution has been assigned its function in this document.
It was rather Ansar Abbasi who refferred the time of Caliph Omar and the reply was according to the history.

WASHINGTON/ISLAMABA D: The US capital and the world is watching for the ultimate battle on the D-Day on Monday in what has now turned into a fatal fight to the finish between two personalities — President Asif Zardari and Chief Justice Iftikhar Muhammad Chaudhry. Only one will survive.
Zardari has all the power that anyone can muster in any country, but he also has the biggest stakes on line. His power grab in the last few months is not helping him and he is fighting a losing battle.
Iftikhar Chaudhry has no powers but he has the entire country behind him and that makes him the most powerful commander leading his troops to ultimate victory. His troops, Nawaz Sharif, Ali Kurd, Aitzaz Ahsan, the media, lawyers, politicians, rights activists and the people at large have been deceived so many times that no more promises or assurances of the Zardari camp carry any weight. Thus foreign guarantors are being sucked into the equation.
The Army, the ultimate protector of the external and internal security fronts, has been caught in a dangerous bind. While it was hard pressed fighting the terrorists and their creeping coups, President Zardari has opened a much wider and a potentially suicidal confrontation which had brought the entire country to a standstill, even before the long march could start or converge at a point.
The Army is in no position to fight such a divisive and extended war with its own people, for the interests of a few misguided and incompetent leaders who failed to grow into the large shoes they landed in, by the stroke of luck after the ultimate sacrifice of Benazir Bhutto.
While leaders like Maulana Fazlur Rehman are, in sheer desperation, trying to give the phenomenal rising of the people for a national cause the colour of a possible threat to the federation, all those leading the movement have repeatedly said the objective of their struggle is to attain the objective of reinstatement of Nov 2 judiciary and not to dislodge the present PPP government.
Mian Nawaz Sharif, Qazi Hussain Ahmad, Imran Khan and the lawyers’ leadership have said in one voice that the government must listen to what the nation demands. The Jamaat-e-Islami chief has even asked Army chief Gen Ashfaq Parvez Kayani to use his pressure on the government to meet the public demand for the independence of judiciary instead of exploiting such a situation for a military intervention to grab power, a la Ziaul Haq or Musharraf.
Given the public mood and the thinking of the political leaders military intervention is not possible and would be strongly resisted if foolishly resorted to. Critical mistakes have been made by Zardari-controlled war room, set up in the bunker inside the presidency.
When Punjab was forcibly taken over by the governor to physically stop the long march and the entire transport system, official and private, was hijacked to block every road, two days before the D-Day word was sent out that the Shahbaz Sharif government was being restored in a few days.
Given our bureaucratic mindset, the entire Punjab administration was paralysed that very moment because no officer, junior or senior, would take action against an ousted chief minister or his party, if he was to regain power in a few days.
Hence there are numerous reports that the Punjab police and the administration was helping the Sharifs break the barriers or even smuggle them in police vehicles to dodge orders of a governor who was about to be sacked. It is simple logic.
A senior government official, who drove to Islamabad from Lahore hours before the long march started towards Islamabad, reported the mood of the civil administration and the police in Punjab had changed altogether. He said officials were no more inclined to block the long march because they themselves had felt the change in the wind.
He claimed if a police force of 23,000 and other security personnel deployed in Lahore could not prevent the Lahorites from coming out on the streets despite the use of brutal police force and teargas, the long march would smoothly move toward Islamabad as the other districts do not have enough force to face huge crowds.
According to a report, high-ranking police officers, of SSP rank and above, rushed inside the Lahore High Court and made speeches, apologising to the lawyers and the civil society. They said whatever had happened was wrong and from now on they won’t be a part of it. Rich traders of Lahore also come to the high court and categorically blamed it all on President Zardari. People were not chanting ‘Zardari ko jana hoga!’, rather they were saying, ‘Zardari to gaya!’
Asif Zardari has always been in a hurry to blow up the system that he suddenly inherited 14 months ago. He has overstretched his desire to become ‘General’ Asif Zardari, following in the footsteps of Gen Musharraf, for whom he still carries a soft spot.
Zardari began where Musharraf had peaked in terms of power. He had everything going for him, a supportive people, a unanimous parliament, a friendly opposition, a lovable media, a world ready to help. But he could not grasp the opportunity or even fathom the critical role he had been swept in. His destructive politics has led him to the present pass.
The last card he has, and he has been saying this in private for some time, is the ultimate “Sindh card” which had been used off and on by Sindhi leaders when they were in trouble or cornered because of their failed policies or strategies. Zardari using the Sindh card would be an ultimate joke with the people.
Why this appears a last ditch desperate effort is obvious as his cronies and loyalists like Rehman Malik and the foxy Maulana Fazlur Rehman have started raising this bogey. Malik has been referring to the “East Pakistan like” situation whereas nothing like it exists on the ground.
Even in Sindh all the nationalists led my Mumtaz Bhutto, GM Syed Group, Rasool Bux Paleejo, the nationalists of other provinces including the Bizenjos, Mengals, Marris of Balochistan and even the coalition partners Bilors of Peshawar have been looking at the situation as a fight for an independent judiciary and not a threat to the federation. Most have been very vocal in support of the judges.
Zardari does not realise that he has pushed himself to the wrong side of the political, civil and intellectual spectrum. While everyone is clamouring for judicial independence, and everyone includes top judges, lawyers, politicians, journalists, even generals and bureaucrats, using the Sindh card would be nothing but an act of desperation signalling acceptance of defeat.
The argument that the PPP was being victimised once again will hold no water as the present shape of the Zardari-led PPP is not what Benazir Bhutto’s PPP looked like and stood for. Benazir Bhutto’s jiyalas are no longer jiyalas of Zardari, they have been sidelined and it has been proved beyond doubt that Zardari does not stand for what Benazir wanted or struggled for.
Thus all the Sindhi PPP and non-PPP stalwarts, including even Makhdoom Amin Fahim, Nawab Yousuf Talpur, the Jatois, Bhuttos et al, will not let Zardari use the Sindh card. It is in fact no card at all.

KARACHI, March 10: One of the counsel for Nawaz Sharif in the plane conspiracy case, Iqbal Raad, and two others were gunned down by three unidentified people at his practice chambers on Friday afternoon. Shahzad Adil Khatri, son of the late Sindh High Court judge Adil Khatri, and an office peon were also killed with Iqbal Raad in his office in the multi-storey Paradise Chambers near the High Court building on Shahrah-i-Iraq. The peon, Ghulam Abbas, who hailed from Ranipur, had joined Iqbal Raad only three days ago. Iqbal Raad, from whose office a some unknown persons had stolen the fax machine and other equipment a fortnight ago, died of a kalashnikov burst while he was in his seat, and the bodies of Khatri and Ghulam Abbas lay just outside the internal door of Raad’s offices. Iqbal Raad, in his mid-50s, who has left behind his wife, three sons and one daughter, had been holding the post of advocate- general of Sindh until the Nawaz Sharif government was dismissed last year. Before being appointed AG, Mr Raad had showed interest in organizing the lawyers under the PML’s legal wing. According to witnesses, three men went up to the office of Mr Raad on the second floor, after alighting from an beige-coloured Alto car, and sprayed all the three with Kalashnikov and TT pistol shots. The witnesses said that soon after they had completed their operation, the killers climbed down the stairs and pulled up the car to flee the scene. KARACHI: Iqbal Raad, one of the counsel for deposed prime minister Nawaz Sharif in the plane conspiracy case, was gunned down in his office at Saddar along with two others on Friday. The other two victims were identified as Shahzad Adil Khatri, son of Justice (retd) Hussain Adil Khatri, and Ghulam Abbas, an office boy of Iqbal Raad offices in Paradise Chambers, situated behind the Sindh High Court Building and near Passport Office. The killings took place at about 1:30 pm when former advocate general of Sindh Iqbal Raad had arrived in his chamber a little while ago. At that time, most of the area people had gone to Masjid-e-Khizra to offer Friday prayers. According to eyewitnesses, four commuters of a beige-coloured Alto car (ABZ-947) came outside Paradise Chambers, where Raad’s offices are located on the second floor. One remained in the driving seat with the vehicle’s engine start, while three others got off and entered the building. The gunmen stormed into the offices of Iqbal Raad and opened indiscriminate fire, killing Shahzad Adil Khatri, 23, and Ghulam Abbas, 18, in the front room. They then barged into Raad’s chamber where he was sitting on his revolving chair. The killers sprayed a volley of bullets, targeting the upper portion of his body. Iqbal Raad, the 53-year-old lawyer, sustained multiple bullets and died instantly. After completing their operation, the killers fled in the awaiting vehicle. An eyewitness, who saw the assailants rushing out of the building, told The News that two of them were wearing Shalwar Qameez and were armed with TT pistols in both hands, while the third gunman, who was wearing a shirt and trouser, was armed with a Kalashnikov rifle. Iqbal Raad received six bullets in the left of his upper thorax and hand. Five bullets pierced through his body while the sixth bullet was retrieved by a medico-legal officer from Raad’s shoulder blade. Eyewitnesses said that the prayers had concluded in the nearby Masjid-e-Khizra at the time of shooting. SP Aslam Soomro was also attending the prayers and his two police guards were standing outside the chambers of the slain lawyer. The bodies of the victims were shifted to the Civil Hospital for autopsies.
A large number of lawyers rushed to the hospital. Due to power failure at the Civil Hospital mortuary, the postmortem was conducted with a delay of about half an hour. “Raad’s collarbone was broken,” said an MLO, who conducted the postmortem. Peon Ghulam Abbas received a single bullet below his right ear and Shahzad sustained a bullet in his skull, he added. An advocate, on condition of anonymity, told The News that he had just taken his seat in his third floor office when he heard the gunshots. “I looked down from my window and saw three gunmen getting into a a beige-coloured Alto. I had seen that car parked right in front of the building’s gate with the driver in his seat. I also managed to see its registration number as ABZ-947,” he added. Another advocate, who shared Raad’s office on the same floor, told The News that he rushed to the scene on hearing the firing and saw the victims in a pool of blood. “I then telephoned the police on Emergency No 15. But they told me to inform the concern police station. Finally I called the Edhi Foundation’s volunteers,” he added. Shahzad Adil Khatri, who was also killed in the attack, had sold his offices to Raad a couple of months ago and was preparing for his CSS examinations in another office adjacent to that of Iqbal. Shahzad, eyewitnesses said, had come to Raad’s offices because his library was still there and he wanted to take some books. The young peon, Ghulam Abbas, was hired a couple of days ago. When contacted, a senior police official said that the car (ABZ-947), used in the incident, had a fake number plate. “It was a beige-coloured Alto car carrying the number allotted to Surrayia wife of Nazimuddin,” said one of the police investigators. When contacted, SSP South Iqbal Mehmood said: “We are still investigating that to whom the vehicle belongs.” Meanwhile, the acting police chief, SSP West Akhtar Gorchani, constituted a high-level team to probe the incident. WASHINGTON/ISLAMABAD: The US capital and the world is watching for the ultimate battle on the D-Day on Monday in what has now turned into a fatal fight to the finish between two personalities — President Asif Zardari and Chief Justice Iftikhar Muhammad Chaudhry. Only one will survive. Zardari has all the power that anyone can muster in any country, but he also has the biggest stakes on line. His power grab in the last few months is not helping him and he is fighting a losing battle. Iftikhar Chaudhry has no powers but he has the entire country behind him and that makes him the most powerful commander leading his troops to ultimate victory. His troops, Nawaz Sharif, Ali Kurd, Aitzaz Ahsan, the media, lawyers, politicians, rights activists and the people at large have been deceived so many times that no more promises or assurances of the Zardari camp carry any weight. Thus foreign guarantors are being sucked into the equation. The Army, the ultimate protector of the external and internal security fronts, has been caught in a dangerous bind. While it was hard pressed fighting the terrorists and their creeping coups, President Zardari has opened a much wider and a potentially suicidal confrontation which had brought the entire country to a standstill, even before the long march could start or converge at a point. The Army is in no position to fight such a divisive and extended war with its own people, for the interests of a few misguided and incompetent leaders who failed to grow into the large shoes they landed in, by the stroke of luck after the ultimate sacrifice of Benazir Bhutto. While leaders like Maulana Fazlur Rehman are, in sheer desperation, trying to give the phenomenal rising of the people for a national cause the colour of a possible threat to the federation, all those leading the movement have repeatedly said the objective of their struggle is to attain the objective of reinstatement of Nov 2 judiciary and not to dislodge the present PPP government.
Mian Nawaz Sharif, Qazi Hussain Ahmad, Imran Khan and the lawyers’ leadership have said in one voice that the government must listen to what the nation demands. The Jamaat-e-Islami chief has even asked Army chief Gen Ashfaq Parvez Kayani to use his pressure on the government to meet the public demand for the independence of judiciary instead of exploiting such a situation for a military intervention to grab power, a la Ziaul Haq or Musharraf. Given the public mood and the thinking of the political leaders military intervention is not possible and would be strongly resisted if foolishly resorted to. Critical mistakes have been made by Zardari-controlled war room, set up in the bunker inside the presidency. When Punjab was forcibly taken over by the governor to physically stop the long march and the entire transport system, official and private, was hijacked to block every road, two days before the D-Day word was sent out that the Shahbaz Sharif government was being restored in a few days. Given our bureaucratic mindset, the entire Punjab administration was paralysed that very moment because no officer, junior or senior, would take action against an ousted chief minister or his party, if he was to regain power in a few days. Hence there are numerous reports that the Punjab police and the administration was helping the Sharifs break the barriers or even smuggle them in police vehicles to dodge orders of a governor who was about to be sacked. It is simple logic. A senior government official, who drove to Islamabad from Lahore hours before the long march started towards Islamabad, reported the mood of the civil administration and the police in Punjab had changed altogether. He said officials were no more inclined to block the long march because they themselves had felt the change in the wind.
He claimed if a police force of 23,000 and other security personnel deployed in Lahore could not prevent the Lahorites from coming out on the streets despite the use of brutal police force and teargas, the long march would smoothly move toward Islamabad as the other districts do not have enough force to face huge crowds. According to a report, high-ranking police officers, of SSP rank and above, rushed inside the Lahore High Court and made speeches, apologising to the lawyers and the civil society. They said whatever had happened was wrong and from now on they won’t be a part of it. Rich traders of Lahore also come to the high court and categorically blamed it all on President Zardari. People were not chanting ‘Zardari ko jana hoga!’, rather they were saying, ‘Zardari to gaya!’ Asif Zardari has always been in a hurry to blow up the system that he suddenly inherited 14 months ago. He has overstretched his desire to become ‘General’ Asif Zardari, following in the footsteps of Gen Musharraf, for whom he still carries a soft spot.
Zardari began where Musharraf had peaked in terms of power. He had everything going for him, a supportive people, a unanimous parliament, a friendly opposition, a lovable media, a world ready to help. But he could not grasp the opportunity or even fathom the critical role he had been swept in. His destructive politics has led him to the present pass. The last card he has, and he has been saying this in private for some time, is the ultimate “Sindh card” which had been used off and on by Sindhi leaders when they were in trouble or cornered because of their failed policies or strategies. Zardari using the Sindh card would be an ultimate joke with the people. Why this appears a last ditch desperate effort is obvious as his cronies and loyalists like Rehman Malik and the foxy Maulana Fazlur Rehman have started raising this bogey. Malik has been referring to the “East Pakistan like” situation whereas nothing like it exists on the ground. Even in Sindh all the nationalists led my Mumtaz Bhutto, GM Syed Group, Rasool Bux Paleejo, the nationalists of other provinces including the Bizenjos, Mengals, Marris of Balochistan and even the coalition partners Bilors of Peshawar have been looking at the situation as a fight for an independent judiciary and not a threat to the federation. Most have been very vocal in support of the judges.

In fact when I asked the Sindhi politician what may happen in Sindh, and the heart of PPP country, if Zardari and his 12 friends were removed from their offices, the answer was: “Only these 13 people will protest, no one else will. ” He explained that there are no PPP cadres with fires in their belly left in the interior of Sindh who would rise for Zardari. There is a growing sense of hatred because the Zardari clan has taken over all what was loved by the Bhutto jiyalas. “If today Nawaz Sharif stages a public meeting in Larkana, the country will be surprised at the turnout,” the mainstream Sindhi politician belonging to the PPP told me. – The feeling in some PPP circles is that if the NRO strikes at Zardari and his cronies, rural Sindh, where the PPP has grass root support for the Bhuttos, would not react as fiercely as many predict it would. This may be so because Zardari and his Sindhi friends, who were never part of the Benazir circle, have generated enough ill will and animosity in the last 18 months. Some have been forced to recall the funny story of the coffin thief of a village and his son. It is better not to repeat that story. Deviant Mawdudi [A Lethal Mix of Rafizis and Khawarij] and has left a gift for those who are inspired by him in the shape of a book “Khilafat O Malookiat – Caliphate and Kingship” and that book has instigated every worker, supporter and sympathizer of Mawdudi and Jamat-e-Islami to insult Companions [May Allah be pleased with all of them] of Prophet Mohammad [PBUH] and discuss them in bad light and that too through False and Concocted Narrations compiled in Islamic History and without any check quoted by Mawdudi in his so-called Magnum Opus i.e. “Khilafat O Malookiat – Caliphate and Kingship”. Muhammad Bin Ubaidullah Asadi, Abu Abdullah Hasan Bin Ali [both are unknown – Majhoolul Hal] and last narrator died 126 Hijri. Saeed Bin Masrooq was a pupil of Imam A’amash and Father of Sufiyan Thauri, never saw or met any Companion of Prophet Mohammad [PBUH], and Chain of narration is missing in the start rather broken. Sufiyan Thauri was an Scholar of Kufa, a Traditionalist (Muhaddith) and expret on Hadith and also an expert of Asma-ur-Rijal (the unique art of research on people). Another narrator is Abdul Quddus Bin Hajjaj who narrated it through Safwan and narrators are Kazzab (Flagrant and Ppathological Liars) and not even worth to be quoted for any narration. Assalamualaykum,
You have a high regard for Maulana Sayyid Abdul Aa’la Maududi. This question may be surprising and shocking to you that why the respected elders of the Ummah are up in arms against Janab Maulana Sayyid Abdul Aa’la Maududi and his ‘Islamic Movement’. I ask you that why did the Ulama oppose Sir Sayyid Ahmed Khan’s ‘Islaah Islam’ movement, Abdullah Chackralwi’s ‘Qur’aanic Movement’, Ghulam Ahmed Parvez’s ‘Tulu Islam’ movement, Dr. Fazkyrragnab’s renewal of Islam movement and the progressive Islam movement of the socialists?
In answer you will say that each of these, according to their understanding, created a blueprint in their minds and made this their basic standard and foundation. Thereafter, whatever suited and met their standards from the Islam of Muhammad Sallallahu alaihi wa Sallam was incorporated into it, and whatever was unsuitable or against their mode of thinking was either abused, ridiculed, jeered, made a joke of and explained away or far-fetched meanings and interpretations were given so that the original meaning was erased. Obviously their thoughts, senses, feelings, and hearts were not subordinate to Islam, but rather the acceptance or rejection of the tenets of ‘Islam’ was at the mercy of their set-standards. It was incumbent upon the Ulama to tear apart this ‘Is- lamic Talisman’ and bring forward the original Islam of Muhammad SallalLahu alaihi wa Sallam, which has been preserved for the last fourteen hundred years in people against this new calamity of ‘Islamic Thinkers’. You know that the Ulama of this Ummah have carried out their duties whilst disregarding all obstacles. They have been sworn at; they have been painted with all types of labels; they have been ridiculed; they have been pierced with the arrows of accusations; but they (the Ulama) had to carry out their duty, and have verily tried to do so. As long as they have life and the power of speech in them, it must not be expected that they will refrain from committing the “offence” of calling a spade a spade, or day a day, and night a night.
Now listen! In the same manner Janab Maududi Saheb conceived and created a blueprint, which he presented as the ‘Islamic Movement’, and on which foundation the ‘Jamaat Islami’ came into existence. Today his ‘Jamaat Islami’ has an imprint on the big and small. Allah forbid, my intention is not to convey this, that the law that applies to the previously mentioned individuals also applies to Janab Maududi, as there is a difference in rank and grade. The reason for giving the examples of ‘layer upon layer of darkness’ is only to stress that these people fail to understand the True Islam.
They are unanimous in creating a new path and a new map for Islam. It is a different question that the path of some are totally different from the teachings of Muhammad Sallallahu alaihi wa Sallam and some have a few differences. What doubt is there in this that all of them have, through the medium of their understanding and thinking, put forward ‘their Islam’ to the masses. They have proclaimed it to be the truth and have invited the people towards it.
There is a proverb in Arabic: ‘For everything that falls, there is one who will find it’. Everyone surely finds someone with whom one shares common ideas and thoughts. This is a brief answer to your Question. But I feel this will not satisfy you, hence I will have to elaborate on it. In today’s discussion I invite you to think and ponder on one point only. You must have read in the constitution of the Jamaat Islami this sentence from the pen of Janab Maududi Saheb:
“No human should be made a ‘Measure of Truth’ besides Rasulullah Sallallehu alaihi we Sallam, no one should be regarded as free from ‘criticism’, no one should be engrossed in the ‘mental slavery’ of anyone. As Allah has shown, everyone should with a complete standard examine and inspect every person, and according to that measure, whatever grade befits a person, that person should be regarded as such”.
In this constitutional belief, Janab Maududi Saheb has induced every member of the ‘Jamaat’ – whatever position one holds – not to think that any human Is above criticism besides Rasulullah Sallallahu alaihi wa Sallam, nor should one fall under the sway of another’s ‘mental slavery’, and with the examining powers that Allah Ta’aala has given Maududi Saheb and his ‘Jamaat’, everyone should be pecked at and examined. After attaining the results, whatever grade one attains should be conferred on that person. Now let us read from the ‘Maududi Mazhab’ and see that while criticizing, how Maududi Saheb has peeled and skinned the Salaf (pious predecessors). Listen, Maududi Saheb says that:
1. The example of Moosa Alaihis salaam is of that hasty victorious commander, who marches forward without strengthening and estabilishing his authority, and behind him mutiny spreads in the conquered lands like wild fire in a jungle. (Maududi Mazhab, page 23)
2. The danger of the highway robbery of a mischievous soul also confronts the Ambiyaa. An illustrious Prophet like Dawood Alaihis salaam was warned on an occasion that.”..and follow not desire that beguile thee from the way of Allah’. Surah Saad: 27 (Ibid page 21)
3. Dawood Alaihis salaam became influenced with the customs of the Israeli society of his time and requested Orya to give a divorce. (Ibid page 24)
4. Dawood Alaihis salam had a speck of carnal desire in his deeds. (Ibid Page 25)
5. Human weaknesses overcame Nuh Alaihis salaam snd he became a prey to the passion of Jahiliyyah. (Ibid page 26)
6. Actually Ismat (chastity) is not a requisite with the soul of the Ambiyaa. This is a Lateef (delicate) point. Allah Ta’aala had intentionally lifted His protection at some time or the other from every Nabi, so that one or two trangressions are committed, hence the people may not regard the Ambiyaa as gods, and will know that these are human too. (Ibid page 30)
7. The Ambiyaa trangress too, they are even punished. (Ibid page 31)
8. Younus Alaihis salaem committed a few deficiencies in the fulfilling of the Faraa’id of Risalat, and probably became impatient and left his position before time. (Ibid page 35)
9. The Sahaabah were at times overcome with human shortcomings; they reviled one another (read the balance of this paragraph on page 56. I am ashamed of copying it further).
10. The Sahaabah Kiraam many a time erred in understanding the original spirit of Jihaad fi Sabilillah. (Ibid page 59)
11. Once a humble person like (Abubakr) Siddique Akbar who was immersed in Lillahiyyat (the way of Allah) erred (blundered) in fulfilling a delicate demand of islam.
12. Personal greatness overcame and made Umar Radhiallahu Anhu helpless for a few moments at the time of the demise of Rasulullah Sallallahu alaihi wa Sallam. (Ibid page 60)
13, Hazrat Uthman, on whom the burden of this great duty (of Khilafat) was placed, did not possess the qualifications that were granted to his noble predecessors. Therefore, Jahiliyyah found an inlet to creep into the social code of Islam. (Ibid page 65)
14. The verdicts of the Khulafaa Raashideen, which they issued as Qadis, did not become law in Islam. (Ibid page 66)
15. Hadhrat Uthman, one after the other, appointed his relatives to high posts, and gave them other such concessions, which generally became a source of criticism among the people. (Ibid page 71)
16. For example he bequeathed on Marwan one fifth (5 lakh Dinars) from the booty of Africa. (Ibid page 71)
17. History reveals, and it truly shows, that Marwan and Yazeed are despised personalities among the Muslim Ummah. These are the softest words that could be said regarding Marwan and Yazeed. (Faraan monthly September 1976, page 42)
18. These policies of Uthman Radhiallahu Anhu are without doubt, erroneous. A wrong will remain a wrong, irrespective of who commits it. To try and prove it correct by oratory or fabrications is not the demand of logic and justice, nor is it the requirement of the Deen, that an error of a Sahaabi should not be called an error. (Maududi Mazhab, page 73)
19. One very despicable Bid’ah began during the reign of Hadhrat Mu’aawiyah, that he himself, and by his orders, all his governors, while delivering Khutbas on the minbars reviled Hadhrat Ali Radhiallahu Anhu. To revile and swear a person after his demise, forget the Shari’ah, it was against human etiquette to do so, and especially to soil the Jum’ah Khutbah with such filth is a very debased act according to the Deen and etiquette. (Ibid page 75)
20. The effort of joining together (Istilhaaq) Ziyaad bin Simayyah are also among those acts of Hadhrat Mu’aawiyah Radhiallahu Anhu, wherein because of political reasons he contravened an accepted law of the Shari’ah. (Ibid page 76)
21. Hadhrat Mu’aawiyah Radhiallahu Anhu in trying to make him (Ziyaad) his supporter and helper took evidence on the adultery of his father (Abu Sufyaan). And after concluding proof therof, made Ziyaad his (Abu Sufyaan’s) illegitimate son, and on that source made him his brother and a member of the family, This and in whatever manner it may be despised morally, is evident. But according to law, this is an illicit thing, because in the Shari’ah paternity is not proven from adultery. (Ibid page 77)
22. Amr bin Al’aas committed two such acts, that there is no way out but to call it wrong. (Ibid page 84)
23. Hadhrat Ali appointed Malik bin Haarith and Muhammad bin Abu- bakr as governors, whereas, these two people had a hand in the murder of Unman. This is known to everybody. During the entire reign of Ali Radhiallahu Anhu this is the only deed that it seems, cannot be called anything else but wrong. (Ibid page 85)
24. Hadhrat Aysha Radhiallahu Anha and Hafsah Radhiallahu Anha became bold, and began to ‘stretch their tongues’ in the presence of Rasulullah Sallallahu alaihi wa Sallam. (Ibid page 88)
25. After studying History it is found that until now, no thorough Mujaddid was born. It was near that Umar bin Abdulaziz attained that position, but he was not successful. (Ibid page 91)
26. In the reviews of Immam Ghazali, there are a few Ilmi and Fikri flaws, and that may be distributed into three portions. One type is those flaws, that resulted in his works due to the poor knowledge of Hadith, the second type from among those flaws is due to the Aqliyyah overpowering his mind and the third type from among these flaws is his leening towards Tasawwuf more than that which was necessary. (Ibid page 92)
27. And we note this ‘Jahalah’ – with the exception of a very small Jamaat – among the general Muslims from East to West, be they from illiterate public; or graduate Ulama; or mendicant Mashaa’ikh; or graduates of colleges or universities. The thoughts, ways and manners of all these are different, but they are unanimous in not knowing the truth and soul of Islam. (Ibid page 19)
I have presented a few drops from the enraged ocean of Janab Maududi Saheb’s criticism. All this, according to his own assertion, is written after examining by the ‘standards’ shown by Allah. I do not wish to discuss or debate each point. Think for yourself that after all these criticism what picture is formed of Islam in the mind. Nevertheless, I feel that for your convenience a few basic points should be presented
The instruction of Janab Maududi Saheb that besides Rasulullah Sallallahu alihi wa Sallam no human is above Tanqeed (criticism). Before thinking of its outcome, first ponder that what is Tanqeed (criticism)? (The Oxford dictionary says it is judging of merit; critical observation). Tanqeed is an Arabic word which means to gauge, assay, examine, inspect, test and to ascertain the truth from untruth. In the Urdu asuage it means to be catious, seize on trifling faults, reveal shortcomings: i.e. Tanqeed will mean that after examining a thing, an error is ascertained, then its weak precints are proclaimed. When we say that a certain person criticised someone, then nothing else will be understood besides that the weak points of the person criticised are brought to light. That person was examined and all faults and shortcomings were revealed.
Whatever thing or person that is the centre of criticism, the first picture that comes to mind regarding that thing or person is that it or that person is not reliable, hence it or that person needs examining. Only after an examination could it be ascertained whether this thing or person is reliable, because that which is hundred percent reliable does not necessitate an examination. I am sure you have not yet seen a wise person in this world, who goes around examining reliable things. It is an accepted fact that, there is no necessity to test or inspect reliable things or personalities. Those things that are wothy of criticism, are not reliable. For example, regarding weights and measures that are stamped by the government and used in commerce, one will not find people while purchasing articles going around, asking merchants: “Mister, are these measures and weights used by you correct or not?”. After being stamped by the government these weights and measures are above criticism, and do not need any further examination. After all this, if one is found to do so, what shall be said of him?
Now, when Maududi Saheb tells us that no human besides Rasulullah Sallallahu alaihi wa Sallam is above criticism, then, nothing else is meant, but, that save Rasulullah Sallallahu alaihi wa Sallam, no human is reliable before us. Janab Maududi Saheb labels this reliability as ‘mental slavery’, and that none should be influenced by the ‘mental slavery’ or any human besides that of Rasulullah Sallallahu alaihi waSallam.
For this reason, according to his own picture of Islam, he has not granted the verdicts of the Khulafaa Raashideen as legally lawful, whereas, Rasulullah Sallallahu alaihi wa Sallam has in strong terms advised his Ummah to strongly hold onto the Sunnahs of the Khulafaa Raashideen. You must have read this Hadith in the Mishkaat Shareef:
‘Irbaad bin Saariyah Radhillahu Anhu reports: “Rasulullah Sallalla- hu alihi wa Sallam after leading the salaah, turned his face towards us, and delivered a very dynamic lecture, (as a result of which) tears flowed from the eyes, and hearts were moved. (Thereafter) a person said: “0 Messenger of Allah, this was like a farewell lecture, please advise us.” He said: “I advise you to fear Allah, and obey and accept (your leaders), even if he be a Habshi slave, because the one among you who will live after me, shall witness many discords. It is incumbent on you (to hold fast) onto my Sunnah and the Sunnah of the Guided Khulafaa Raashideen. Hold fast unto it, and keep it tight with the teeth. Beware and stay away from new (modern) ideas and acts. For every new act (that is thought to be a part of religion) is Bid’ah, and every Bid’ah (leads) astray”. (Musnad Ahmad, Abu Dawood, Tirmizi; Ibn Majah, Mishkaat page 29)
Do you know that when one criticises another, what is meant by this? Listen, if the knowledge of a person is criticised (even if it is regarding one Mas’alah or an affair), it will mean that in this Mas’alah the opposite person’s view is incorrect, or the knowledge of the criticiser is superior. If the understanding of one is attacked, it will mean the criticiser’s understanding is superior. If the deeds of a person are attacked, it will mean that the deeds of the criticiser is of a higher standard. In short, for whatever reason the next person is criticised, it will mean that the knowledge, deeds, intelligence and understanding of the criticiser is superior.
At times the criticiser is truly better than the opposite, but the criticiser in self vain imagination and aggrandisement regards himself to be superior. In Islam this is called ‘Kibr’ or ‘Takabbur’. This is the same ‘Kibr’ which overtook Iblis, and through this wrong self aggrandisement, instead of being a ‘Muallim Malakut’, he was cursed till the day of Qiyaamah. Now put these Usul (principles) before you, and ponder over the criticism, and the Usul of Maududi Saheb’s criticism. He gives every Tom, Dick and Harry the right to criticise everybody from among the Salf Saaliheen except Rasulullah Sallallahu alaihi wa Sallam. You tell me what would this be called? According to Maududi Saheb, does every member of his Jamaat have better knowledge and understanding than the Salaf Saaliheen? If not, then what else can his motive be besides self conceited imaginations and notions? When Maududi Saheb says that Younus Alaihis salaam committed a few errors in fulfilling the Risalat, at that time his claim would tantamount to this, that he understood the responsibilities of the Risalat more than Younus Alaihis salaam, and possibly (Nauzubillah) more than Allah, because the least, that is expected from Maududi Saheb is that he will not confer an important post In his Jamaat to someone that he knows will not diligently carry out the duties. But according to Maududi Saheb Allah Ta’aala conferred the Risalat on Younus Alaihis salaam and did not take this precaution. In like manner when he says that the passion of Jahiliyyah overcame Younus Alaihis salaam, then it is, as if he is claiming that his foresight on the passions of Jahiliyyah is greater than that of Younus Alaihis salaam, and that he has the strength to withstand the passions of Jahiliyyah. He says regarding himself:
‘It is Allah’s faith that I did not commit any deed or say any word under the influence of my passions, nor did I commit it. Every word that I uttered in my lectures, I measured each one of them before saying them, remembering that I would have to account for it before Allah and the creation. Therefore, I am assured in my position that I did not utter a word against Haq’. (Maududi Mazhab, page 29)
When he says that Dawood Alaihis salaam was influenced by the customs of the Israeli society and committed certain acts, he forgets that the one that is captivated by the ‘mental slavery’ of one’s society can never be a Nabi. With all this, it gives one the impression that if Hazrat Maulana Abdul Aa’la Maududi was in the place of Dawood Alaihis salaam, he would never had asked 0rya to divorce his wife.
When he says that in certain matters Hadhrat Mu’aawiyah Radhiallahu Anhu did not even take into consiaeration human morals, at that time he thinks of himself as a greater Aalim in human morality than Mu’aawiyah Radhiallahu Anhu. When he says that Mu’aawiyah Radhiallahu Anhu openly disobeyed a certain fundamental of the Shari’ah, at that time he presents himself as a greater Aalim of Shari’ah than Hadhrat Mu’aawiyah Radhiallahu Anhu.
When he says that from the time of Umar bin Abdulaziz Rahmatullahi alaih till the time of Sayyid Ahmed Shahid Rahmatullahim, there was a shortcoming in the Tajdeedi missions of all the Mujaddids, at that time he tries to make believe that he understands Tajdeed and revival of the Deen more than all those pious elders. And when he very proudly claims this:
‘Instead of understanding the Deen from the present or previous personalities, I have always tried to understand it from the Qur’aan and Sunnah. Therefore, always when trying to know what the Deen of Allah wants from me and every Mu’min, I never try to see what certain Buzrugs have said, but rather, I try to see what the Qur’aan says and what Rasul says’.* (Maududi Mazhab, page 98)
* [Who taught you the Quraan and Sunnah? People of the present or the past! The Angels of the Mala Aalaa? or like Ghulam Ahmed Qadiani, he came with it from the stomach of his mother? It is the height of ungratefullness. Those through the Barakah of whom a few correa or incorrect words were learnt, are being rejected and discarded. Fundamentally, these are the same viewpoints of Mirza Ghulam Ahmed Qadiani and Ghulam Ahmed Parwez]
He is actually trying to show to the people that in the long History of the Ummah there was not born anyone besides himself who understood the Deen. Well, this is a different subject, on which Insha’Allah, when time permits, I will say something. Briefly, I would say this, that the mo- tive of criticism is always that one feels ‘Ana khayrum minhu’ (I am better than him). It one is really superior to another in knowledge, understanding, deeds and morals, then verily one has the right to criticise another who has a lower standard. If one on his own accord feels superior, and if this is his motive, then every Mu’min should beseech Allah for His protection.
Now in reality if Janaab Maududi Saheb is superior in knowledge, understanding, deeds, Taqwa etc than these whom he has criticised, then, without doubt he has the right to cirticise them, But if in comparison to these gentlemen, he really is lower, and has the urge to criticise, then what can his motive be besides high mindedness, arrogance, self-conceit and Takabbur?
According to the viewpoint of Janab Maududi Saheb, when no individual of the 1400 year old Ummah is above criticism, nor can anyone be relied upon, and according to the standards shown by Allah, it is incumbent to examine every person, then this question arises, that the Deen that has reached the Ummah of today through the Naql Riwaayah, knowledge and deeds of the Salaf Saaliheen, could it be relied upon? Do you know that the proofs and arguments of our Deen are taken from four sources:
(a) The Kitaab of Allah
(b) The sunnah of Rasulullah Sallallahu alaihi wa Sallam
© The Ijmaa of the Ummah
(d) and the Qiyaas of the Mujtahideen.
The Fiqhi Masaa’il of the A’immah Mujtahideen have been abrogated in such a manner, that Mashaa’Allah, Maududi himself is a Mujtahid Mutlaq. He is not in need of benefitting from any present or past tutor to understand the Deen. When the whole Ummah is in need of a critical examination and are thought to be unreliable, then it is clear that Ijmaa will be of no value. The dependance of the Kitaab and Sunnah are on Riwaayat and Diraayat, especially when according to the research of Janab Maududi Saheb the Sahaabah Kiraam Radhiallahu Anhum attacked one another and (Nauzubillah) called one another liars. If in reality, Nauzubillah, the Sahaabah Kiraam Radhiallahu Anhum were as pictured by the criticism of Maududi Saheb, then it is evident that the Ummah that will come after this will be even worse The result will be that beginning from the Qur’aan and Hadith till the Ijmaa and Qiyaas, everything will be doubtful and will be regarded as unreliable, until Maududi Saheb will show us through the standards shown to him by Allah, that how reliable a certain thing is and how unreliable others are. In all fairness, please tell us, what else besides this did Mirza Ghulam Ahmed Qadiani and Mr. Ghulam Ahmed Parvez say? Where did Maududi Saheb attain this ‘Allah’s Standard’, in the light of which every individual from the Salaf Saaliheen have been examined and graded’ What! will Wahi again be revealed to him, or will he leap back fourteen hundred years and personally hear the Qur’aan and Sunnah from Rasulullah Sallallahu alaihi wa Sallam? When he does not accept the connections of any personality of the past or present, nor is he prepared to shoulder the ‘mental slavery’ of anyone, then from which cave will he receive the ‘Standards of Allah’?
You may also know that Allah Ta’aala has taken upon Himself to safeguard this last Deen of ours till the Day of Qiyaamah. The Deen can only be safeguarded when the words of the Nusus of the Deen are preserved without any changes. Its meanings are also preserved. Then the manner in which Rasulullah Sallallahu alaihi wa Sallam had practised and demonstrated it himself, and how the Sahaabah Kiraam Radhialiahu Anhum practised these in his presence, should also be preserved Then through these deeds the proficiency in Islamic thought are pleasure; the path of Ihsaan; and the understanding of the Deen that is created, should also remain preserved. Briefly, four things are mentioned here: words, meanings, deeds and Islamic thought. We who are engrossed in ‘mental slavery’ do not think, but it is our belief that Allah Ta’aala has without any break or interruption preserved these four things, and we are indebted to those through whom these were preserved. They are our guides and leaders. We have complete reliance on them. We are their ‘mental slaves’, and we are thankful for their kindness and benevolence. If hypothetically these great personalities are removed from in between, and is thought that in a certain period of words, meanings, deeds and Islamic thought could not have been preserved, or it could not be relied upon, then, because of this, the entire structure of the Deen is being put into a negative light. But, according to the viewpoint of Maududi Saheb, not one of the four things mentioned remains credible, because the disgrace of being ‘mentally enslaved’ to the personalities of the past or present periods is totally unacceptable in his lofty court, nor will he accept in any way. Even if we give him the benefit of the doubt, that the words of the Qur’aan and Sunnah are preserved, then too the stages of interpre- ting the words and giving them their proper meanings, and through practising them, for one to reach the stage of Islamic thought, will yet have to be covered. Since Maududi Saheb does not accept the ‘mental slavery’ of any human, therefore he will have to traverse this whole path on his own, and in the same manner he will also have to cover the path through his own intellect and understanding. The result that will ensue and the picture that one will form of the Deen needs no comments. It is a fact that a person that wants to remain in the Deen of Muhammed Sallallahu alaihi wa Salam, will have to become a ‘mental slave’ of those Salaf Saaliheen who had upheld the Deen. The person that cannot withstand this ‘disgrace’ or does not want to follow it, cannot attain true Islam (The Islam brought by Muhammed Sallallahu alaihi wa Sallam), even if one reaches the highest of positions. After refuting the reliability of the sayings and conditions of the Salaf Saaliheen and not becoming engrossed in their ‘mental slavery’, if Janab Maududi Saheb has invented some scientific way, we will be looking forward to know about it, on condition that it is a bit different from the styles and modes of Mr. Parvez and Mirza Qadiani.
I accept that Janab Maududi Saheb is a good author and has a flowing pen, but I feel that he in his lofty thoughts, sometimes uses such words that according to the situation are utterly out of context. For example, take the words ‘above criticism’ and ‘mental slavery’. These, according to their coherence are meaningless. Ponder, that if ‘mental slavery’ is not a shortcoming in the Islamic religion, but is a thing to be proud of a thousand times, then should one not be proud of following the path of the Salaf Saaliheen and those who have shouldered the burden of Islam? What shall be the meaning of this saying of Rasulullah Sallallahy alaihi wa Sallam.:
‘That my Ummah will never unite on falsehood’.
Picture a child of the grades who went to Madrasah or school for the first time. The Ustaaz began teaching him the alphabets, and taught him that this is ‘Alif’ and that is “Ba’. In reply to this the pupil says: ‘Sir, I am a thinker of the fourteen century (or nineteen century AD.), why should I accept your ‘mental slavery’? It is apparent what type at education this ‘thinker’ will attain. We do not even hold this position in relation to the Sahaabah and Salaf Saaliheen, as the relation of the modern ‘thinker’ had with his Ustaaz. We learned the rudiments of Deen from these noble personalities. The result of the revolt against conforming to their ‘mental slavery’ is not different from that pupil who claimed to be a ‘thinker’. may Allah forgive me. I am of the opinion that those who severe their links from the Salaf Saaliheen, and throw off the yoke of their ‘mental slavery’, and are trying to map out a new path of Islam, in essence they do not acknowledge Islam, but repeatedly use the words of the Qur’aan and Sunnah, because there is no other way to spread their Kufr and disbelief among the Muslim public. I do not regard Janab Maududi Saheb among. them, but it is regretted that he has, by rejecting the ‘mental salvery’ of every personality among the Salaf Saaliheen, given preference to the ‘mental slavery’ of the orientalist western disbelievers, and he has adopted the ‘mentality of the free thinkers’ after whom the modernists of today are running.
Janab Maududi Saheb has satirized and ridiculed the following of the path of the Salaf Saaliheen as ‘mental slavery’ which the Qur’aan proclaims as ‘Sabilul Mu’mineen’ (a way for the believers) and has warned those who disregard it of a severe punishment in Jahannam. This is the same ‘mental slavery’ that the Qur’aan describes as “As Siraatal Mustaqeem’ (The straight path), and instructs one to supplicate for its guidance. Also, this is the same ‘mental slavery’ for which the Muslims rub their noses five times a day and make du’aa. What a bad and distateful interpretaiton this is, that the path on which countless caravans of pious people have trodden, the following of whom is today labelled as ‘mental slavery’.
If you have studied the emergence of all the false sects dunng the Islamic period, then this truth will dawn upon you that the foundation of all these sects are on “Ana wala ghayri” (Me and no one besides me) All these heve felt ashamed of the ‘mental slavery’ of the Salaf Saaliheen, and have floated their lofty thoughts in the jungles of their own intelligence and understanding. Thereafter, whichever way their heads rose their thoughts began to float in that way.
The first fitnah in Islam was introduced by Abdullah bin Saba, a Jew, whose basic thinking was founded on that no one is above criticism besides the noble personality of Rasulullah Sallallahu alaihi wa Sallam. Then from the stomach of this Saba’iyyah the fitna of of the Khawaarij was born, who exclaimed aloud that Ali Radhiallahu Anhu and the other Sahaabah did not understand Islam “We understand more than them”. Then on the same basis the sects of Mu’tazilah, Murjiyyah, Qadriyyah, etc took root. Each one of them potrayed! the following of the Salaf as ‘mental slavery’. They went astray and led others astray. In our modern times the new sects that emerged, although their basis and viewpoints differ, you will find that they are more or less unanimous on the above point. It is fashionable today to satirize the Salaf Saaliheen; to extract worms from their deeds; injure their personalities; shoot arrows of criticism at them; and label their following as, revisionism, out moded, obsolete, orthodoxy, mental slavery, etc. etc It is sad that Janab Maududi Saheb has also based his ‘Islamic Movement’ on these lines. When we read the history of the Khawaarij, we were surprised at their boldness. They claimed to understand the Deen more than such a personality who had seen with his own eyes the Sun of Islam rise, and who had been an associate and confidant of Rasulullah Sallallahu alaihi wa Sallam during his 23 year period of Nubuwwat, who had eye witnessed every incident of the Nazule Wahi; who had spent his whole life from childhood till old age in the service of Islam. We fail to understand what has happened to their senses? They vehemently criticise his religious understanding. History repeats itself. Today the criticisms of Janaab Maududi Saheb (his attack on Uthman Radhiallahu Anhu and other Sahaabah) has removed our astonishment and surprise regarding the Khaarijis. Maududi Saheb tries to make us understand that Uthman Radhiallahu anhu was not able to upkeep the ‘Islamic system’, nor did anyone after him have the guidance and power to do so. Now Janab Maududi Saheb’s ‘Islamic movement will spear the Islamic System.
‘In hiya illa Khaarijiyyatun Jadidatun’ (Verily it is a new Khaariji order), even the angels of Allah are modest in presence of Uthman Radhiallahu Anhu.
Rasulullah Salallahu alaihi wa Sallam says: ‘Should I not feel modest before that person, in the presence of whom the Malaa’ikah feel modest’ Muslim. (Mishkat page 56).
Maududi Saheb does not feel a jerk by this, but showers licentious criticism on him. Rasulullah Sallallahu alaihi wa Sallam in recognising the great sacrifices of Uthman Radhiallahu Anhu says: ‘Whatever Uthman Radhiallahu Anhu does after this, there shall be no accusation upon him’ (Tirmizi, Mishkat)
But Maududi Saheb feels it an honour to heap accusations on him
Rasulullah Sallallahu alaihi wa Sallam advises the Ummah: ‘Fear Allah regarding my Sahaabah (companions), fear Allah regarding my Sahaabah. Do not make them a source of criticism after me. That person who has loved them, has loved them because they love me, and those who hate them, have hated them because they hate me’. (Tirmizi)
But Maududi Saheb deems it important to criticise them by sifting them all through a sieve. It grants every Tom, Dick and Harry the right to criticise. By criticising them it instructs the Ummah to despise and hate them, so that people may keep away from becoming their ‘mental slaves’. This is the same Khaarijiyyah in a new colour, which surfaced during the time of Sahaabah It is stated in the Hadith that the ‘Later one’s among this Urnmah will curse its forebearers’.
I end this letter, by mentioning the command of the Faqihul Ummah, Abdullah bin Mas’ud RadhiAllahu Anhu. You may compare the ‘standard of truth’ between that of this great Sahaabi and that of Maududi Saheb.
He says: ‘If you wish to follow anyone, then follow the path of those who have passed away, because one is not safe from the fitnah of a living person. I mean those who are among the Sahaabah of Muhammed Sallallahu alaihi wa Sallam. They were the best among this Ummah; they possessed the clearest of hearts; they attained the deepest of knowledge; and had the least formalities. Allah Ta’aala had chosen them as companions of His Nabi and to up- keep His Deen. Therefore, recognise their virtues, and follow their footsteps. As far as possible hold fast unto their characters and qualities, because they are on the straight path’. (Razeen)

ISLAMABAD: Action to seize the assets of President Asif Ali Zardari began on Wednesday when NAB asked the Islamabad capital territory (ICT) administration to freeze his assets and restore the pre-Oct 5, 2007 position. A similar letter was ready to be sent on Friday to chief secretary Sindh. The major development came when NAB issued the letter to the Islamabad administration to freeze all assets under its jurisdiction. Besides other properties, NAB’s latest order would immediately hit the 2,460 kanals of Sangjani land, which was a frozen asset before the NRO but was unfrozen in early 2009 and transferred in the name of a private company owned by President Zardari, his son Bilawal Zardari and others. The NAB spokesman Ghazni Khan when approached did not deny or confirm this major development. He, however, said that NAB is acting strictly in accordance with the law and the Supreme Court’s decision and weekly progress reports is regularly being submitted to the Supreme Court. A credible source in NAB told The News here on Thursday that NAB’s latest order has been dispatched to the Islamabad administration. The NAB letter while giving reference to its post-2008 unfreezing order issued in the case of the President Zardari’s assets in Islamabad directed the ICT administration to proceed in line with the Supreme Court’s order dated December 16, 2009. Copy of the SC’s short order on NRO was also attachedwith the NAB letter. The source said that a similar letter would be issued to the Sindh Government on Friday. “It is relevant to mention that I am an established business man from an established business family of Islamabad, having a blotless record over the past four decades and have never been involved in any illegal business transactions. “It is further clarified that details given in the story by Ansar Abbasi about me in a neat, clean and professional business transaction from my lawful resources well within the framework of law of the land have been twisted by Ansar Abbasi for the satisfaction of his own motives best known to him.” He stated, what he called the ground realities as under: (i) The land subject matter of the news item is neither acquired nor owned by CDA. (ii) The entire land is located in Zone-III of the Master Plan for Islamabad, its use is restricted strictly to set up recreational facilities. No housing society can be established in this zone and thus its price cannot be compared with adjoining areas meant for residential purposes particularly when the entire land is also still in the occupation of original owners of the area. (iii) In the news item, a reference has also been made to me being a member of the Islamabad Development Steering Committee, which is patently irrelevant and has clearly been made to confuse the readers into believing as if the mentioned deal had something to do with CDA, which is not the case at all. I am no doubt member of the said Committee but it has no nexus whatsoever with the purchase and sale of the land, which is owned by private owners not the CDA and which is subject matter of the news item designed to damage my reputation. ISLAMABAD: The National Accountability Bureau (NAB) has admitted that the pre-NRO situation vis-a-vis President Asif Ali Zardari has not been restored and his cases remained closed while there are no freezing orders issued regarding his bank accounts and the moveable and immovable assets. This is apparently a glaring violation of the Supreme Court order but NAB insists that in its legal view the president under Article 248 of the Constitution enjoys immunity that bars NAB to restore the pre-NRO position in case of Asif Ali Zardari. The Constitution envisages that no criminal proceedings whatsoever shall be instituted or continued against the president or a governor in any court during his term of office, NAB has gone an extra mile in favour of the president as it has simply refused to act in any manner. Practically, owing to the NAB’s interpretation of the Constitution, the president continues to be an NRO beneficiary despite the condemnation of the law by the apex court. NAB spokesman Ghazni Khan, when approached, confirmed to The News that the NAB cases against President Zardari have not been reopened. He also disclosed that the Bureau did not issue any orders to freeze the assets and bank accounts of the president. The NAB spokesman said the Bureau, in its letter addressed to the accountability courts, had sought the reopening of the NAB cases against all NRO beneficiaries to the Oct 4, 2007 position. ISLAMABAD: A surgical operation has been launched in the National Accountability Bureau (NAB) as the government has forced its chairman to remove its most important officials, including the DG operations, who has been targeted for issuing the order for the immediate implementation of the Supreme Court order on the
NRO. Sources said some key provincial officials of the NAB, including its provincial director generals, were also on the hit list and expected to be changed and replaced by those loyal to the government. The Law Ministry, these sources said, had also sought details of the vacant posts from the NAB chairman, who under the NAB law is the competent authority for all internal appointments and postings. The sources said that the NAB chairman Navid Ahsan had been pressurised to remove its DG operation Lt Col (retd)) Shahzad Bhatti, who on December 17, the very next day of the Supreme Court short order on the NRO, had issued a letter to all concerned to immediately implement the apex court’s order. ISLAMABAD: The Swiss-carton scandal has raised in-house fears in the National Accountability Bureau (NAB) about the safety and security of the bulk of original evidence concerning high profile cases, settled under the controversial NRO, and presently protected in the bureau’s headquarter in Islamabad. Already, the NAB was warned by a leading intelligence agency of the country of the possible sabotage effort to destroy such evidence. A credible NAB source said that some months back, the Bureau’s director general HR had received a verbal warning from an official of the Interior Ministry, conveying that the highly critical original evidence about the high profile corruption cases settled under the NRO could be destroyed by saboteur’s fire, which could be later described as a mere accident. The Interior Ministry official also shared the name and telephone number of the intelligence officer, a serving brigadier, who contacted the Interior Ministry to pass on a proper warning to the NAB. After receiving the Interior Ministry’s verbal warning, the NAB official also contacted the intelligence brigadier, who confirmed the report and recommended the Bureau to take all possible steps to ensure the protection of the valuable documentary evidence. Following this warning, the NAB improved its record room through renovation and turned it into a strong room by removing all its windows, tiling the walls and disconnecting electricity connection, to pre-empt any chance of saboteur fire. The record room has also been secured through multiple lock system and not many know in the Bureau as to who has got the keys to get access to the record room. When contacted, NAB spokesman Ghazni Khan though confirmed that foolproof arrangement were recently made to protect the NAB record, he denied to be in knowledge of any intelligence warning issued to the Bureau about a possible sabotage effort to destroy the crucial evidence. “It is well protected now,” the spokesman said. However, a source in the NAB said that Wajid Shamsul Hasan-led sneaky operation, which was caught red-handed by Geo News, to secure 12 cartons of evidence relating to the Swiss money laundering and kickback cases against President Asif Ali Zardari and others, has raised fears within the NAB about the safety of its available record. The source said a lady consultant and a joint secretary of a ministry, which was headed by a powerful minister, who later reached an elevated position, had also made an effort to take away certain original files but a retired colonel, serving in the Bureau, retrieved these files from the lady consultant’s car before she could take them away. Maulana Sufi Muhammad’s demands for an Islamic justice system have been met but his latest edicts against the country’s judicial, parliamentary and constitutional system may deprive him of the fruit of his life-time achievement. What Maulana Sufi Muhammad has uttered were his already known views but by expressing them in a public gathering at this crucial juncture of the Swat peace process the Tanzim Nifaz Shariat-e-Muhammadi (TNSM) chief has acted as a spoiler. His decades long struggle for Islamic justice system in Swat and Malakand Division is in sight but now he himself has threatened the achievement of his life’s goal. Now many fear that after the implementation of the Nizam-e-Adl Regulation in Swat and the Malakand region, he would possibly try to extend his struggle to other parts of the country. Maulana Sufi Muhammad’s statement that Pakistan’ democracy, its laws and judicial structure all are un-Islamic was rarely welcomed by any political leader, including even those belonging to religious political parties. While the ANP, the PPP and the PML-N deliberately did not show any strong reaction to Sufi’s declaration perhaps to save the peace process from being ruined, it was the Jamaat-e-Islami chief Syed Munnawar Hasan and JUI-F’s Maulana Fazlur Rehman who clearly rejected the TNSM chiefís interpretation of Islam vis-‡-vis Pakistan’s democracy and judicial system. Several Ulema from different schools of thought also argued against Sufi’s remarks.

ISLAMABAD: After the Pakistan People’s Party (PPP), now apprehensions are also being expressed by the PML-N about some alleged conspiracy being hatched by certain elements belonging to the Army and intelligence agencies. Though it is whispered and not publicly said in so many words, in their off-the-record discussions with media persons, some PML-N leaders express their fears that the third force is preparing the ground to do something extra-constitutional.
Ahsan Iqbal is on the record as having said on Saturday that a third force wants a clash between the judiciary and parliament. He did not name the third force precisely in the same fashion as has been done repeatedly by President Asif Ali Zardari during the recent months.
According to a PML-N leader, the Army is trying to pitch the judiciary against parliament and for this purpose it is using certain elements in the media. The N-leader, however, did not have anything concrete to support his argument. After the recent bloody riots in Abbottabad and Hazara, another PML-N leader told this correspondent strictly off-the-record he believed that some intelligence agencies had played tricks to trigger violence in the area.
When asked if he says this on the basis of some solid information or it was just based on his analysis or calculation, he said it was his educated guess. However, in the same breath, he contradicted himself by saying that the PML-N Hazara leadership had told him that the Hazara-based PML-Q leadership and the champions of the Hazara province, who led the recent movement there, were given a shut up call by the military. He said that the violent riots ended after the likes of Haider Zaman, Gohar Ayub and others were asked to stay peaceful.
Retired Lieutenant General and former ISI chief Hameed Gul was asked on Saturday by Dr Shahid Masood in his programme, Meray Mutabiq, if he sees the possibility of the Pakistan Army getting into politics at a time when there are fears of a clash between the two main pillars of the state.
Gul said that the military had learnt lessons from its past mistakes. He added that the military had no interest in getting into politics or pushing institutions into a clash with each other. The Pakistan Army and the ISI were already put on the defensive after being repeatedly but subtly blamed of conspiring against democracy by no less than the president. At that time, there were not many even among the politicians to believe this but now such apprehensions have started being raised by the Leaguers.
If there is any truth in such apprehensions, then it is vital to understand the fact that parliament has done its work by producing the 18th Amendment and now it is the judiciary’s turn to do a judicial review of some of the 101 amendments, which have been challenged in the apex court.
The Army or intelligence agencies have no business to get worried or do anything on issues which clearly fall in the domain of either parliament or the judiciary. Out of the 101 constitutional amendments, only a few have been challenged, meaning thereby that generally and mostly parliament has done good work. In other cases, now it is for the apex court to do its work and decide the cases on merit and in line with the Constitution and law.
With the exception of a few controversial amendments, parliament has done well. The judiciary is doing extraordinarily and enjoys the complete support of the masses. It is supposed to continue adjudging the cases placed before it in line with law and the Constitution without any fear or favour.
It should not be bothered about the negative propaganda unleashed by anyone against the judiciary or those threatening it that it should keep its hands off the constitutional amendments, already challenged, to avoid a possible confrontation.
An evolution of institutions in this evolutionary process is going on and the military should remain focused on its soldiering matters and must stay away from politics, say analysts.
In a surprising move, Jamia Binoria’s Mufti Mohammad Naeem who had branded Fauzia Wahab’s statement as Gunah-e-Kabira, has issued a press release which was published in Ummat, Karachi, which was published today. Mufti Naeem suggests that after her clarification, it is ethically, socially and legally wrong to issue statements on the matter.

The ruling party’s spokesperson, Ms Fauzia Wahab, an active student and practitioner of politics since her student days and now a member of parliament, is being discussed right, left and centre. It is tragic that the three political sides, namely the right, left and centre, have competed against each other to vehemently ask for an apology. The honourable parliamentarian was quoted by the media as having stated, “During the times of Hazart Umar (RA), there was no constitution, there was only the Quran. Now there is a constitution that gives immunity to the president.” For this remark she has been asked to apologise as it has been taken to be disrespectful to the spirit of religion. Religious, political and constitutional experts have come forward to condemn the statement and have been at pains to explain that the Quran is superior to the constitution and that Fauzia Wahab has attempted to equate the two. Hence the call for an apology for the alleged blasphemy. I suggest that Fauzia Wahab does not apologise.

The constitution is the mother of all laws. All man-made laws that is. Fauzia, in her statement, has essentially pointed out that now we are governed by a framework of laws that are man-made. According to the Objectives Resolution of 1949, it is stated that no law will be enacted in Pakistan that will be against the spirit of Islam. Thus, all our laws, as well as the mother of all laws, will have to be within the broad framework prescribed by Islam. However, within that framework, we will draft constitutions and will make amendments, for it is man-made.
The very act of framing a constitution is, in fact, a secular act that is political in nature. According to religious scholar Dr Jamal Badawi, “The Quran and prophetic tradition are the ultimate constitution, which is different from the secular constitution because it cannot be changed. In the secular system the constitution can be changed whenever needed because it is human-made and there may be better words than the ones that were put in the first place. Whereas, in the case of divine constitution, one cannot say, ‘I know more than God’. In addition, it is quite clear that democracy seems to go with systems that are basically secular, where the legislation of churches or temples or any religious body has nothing to do with the actual political system.” The fact that we have a constitution means that we are actually governing ourselves according to a secular tradition.
If students of religion believe that there is no immunity in Islam, then let there be a change in the country’s constitution for the constitution clearly lays down presidential immunity. The Council of Islamic Ideology (CII) should take up the issue and give its judgement accordingly and parliament can make the necessary changes.
However, to blast a politician for correctly differentiating between man-made political law and divine law is to actually exhibit an irrational extremist mindset that is quick to judge and slow to act. What is the difference between the mentality of the Taliban and our intelligentsia who have been quick to judge, condemn and execute Fauzia? This is ironic as the religion that is being defended itself cautions against being judgmental and overly critical. Our beloved Prophet Muhammad (PBUH) said, “Should you become eager to mention another’s faults, recall your own” (Ar-Rafi). He also warns us, “O you who believe! Shun much suspicion; for lo! Some suspicion is a sin” (Surah al-Hujurat:12). Ali ibn Abi Taalib (may Allah have mercy on him) said, “If the people knew what is involved in judging, they would not judge concerning the price of a piece of camel dung.” Al-Dhahabi, speaking about the mistakes of the scholars, said the following in Siyar al-A’lam al-Nubala (14/374), “If we were to discredit every person who made mistake in judgement or declare those people as innovators — people who are essentially of good faith and sincerely seek the truth — then scarcely would any of our scholars be spared.”
In fact, if extrapolated further, one would like to caution the people who have taken it upon themselves to call for apologies after terming it as a slight against Islam. There is no monopoly over Islam. Everyone, including Fauzia, according to their personal interpretations has the freedom and responsibility to understand, interpret and, to an extent, defend religion. According to Dr Jamal Badawi, “The political system of Islam is not theocratic because the term theocracy implies two basic elements. The first element is the assumption or acceptance of the principle that God alone is the Sovereign of ultimate power. The second part of the definition of theocracy is the assumption that there is a certain priestly class or clergy who claim to be representatives of God on earth, who alone have the right to interpret the will of God, and who, in some certain cases, are the ones who are supposed to enforce the divine law.”
Religion consumes us. It is devouring our political, social, economic and even personal lives. While we plummet in terms of development, we hang on to religion oblivious of future needs. Instead of defending ourselves against poverty, illiteracy and terror we are defending a religion that has God Himself as the ultimate defender. Pakistan is the only country that has infringed on its citizens access to information, entertainment and ever-personal freedom by blocking social networking and other sites. This is because of the alleged slight on Islam. The militant and extremist websites that propagate hate speech, intolerance, radicalisation bigotry and misinterpretation of Islam are active and easily accessible. These websites, with their incorrect interpretations of religion, are not blasphemous but a statement differentiating between political and religious lives is. I am no fan of Fauzia but have to admit, knowingly or unknowingly, that she has spoken sense. Apologising for a sensible understanding of religious-political life would be cause for an apology.
