CJ Gate: For Pakistan’s Chief Justice Chaudhry, the wheel comes full circle – by Ayaz Amir

Caesar’s wife and the burden of suspicion

So does My Lord the Chief Justice, on whose side emotionally guys like me will always gravitate, realise how the wheel comes full circle? He was our St George pursuing the dragon of corruption and wrongdoing in high places. And since the stars are not without their share of irony, sharp and interested eyes are seeing the footprints of the dragon reaching up to his own front door.

It doesn’t matter whether young Arsalan, his son, was the beneficiary of gifts coming from the generous hands of Malik Riaz, arguably the most powerful person in Pakistan today, more powerful in my opinion than the commander-in-chief of the Pakistan Army. Former generals and admirals are in his pay. Islam may be our avowed faith but the passion which really sways our good and great is connected to the holy kingdom called real estate, whose crowned head is Malik Riaz.

What matters is that Arsalan has been touched by the breath of suspicion and when it comes to Caesar’s wife, or son as in this case, that is enough. Both, if the state of the Republic is to be counted as healthy, must be above suspicion.

There is another irony at work here. The same media forces which gifted us Memogate, making a fireworks out of a molehill, are behind this latest scandal. Not a shred of evidence has been produced showing the money connection between Arsalan and Malik Riaz. It may well exist but we could have done with some evidence and investigative reporting. The commentaries could have come later. But it has been the other way around here, the Supreme Court calling for details and everyone concerned earnestly engaged in scurrying for cover.

This is exactly what happened in Memogate, the media blitz so strong that the CJ and the army chief both fell for it. This time there’s been no blitz, just a whispering campaign. But so insidious that CJ Chaudhry felt constrained to act. But, I fear, he may have acted in haste. After all, this was a matter involving his son. As a trained lawyer, a former advocate general of Balochistan, it should not have been difficult for him to get at the truth, sitting Arsalan across the table, and then, if any impropriety was established, deciding what to do.

Even if there is any truth to the worst of the allegations about Arsalan, he is guilty of impropriety. A son of My Lord Iftikhar Chaudhry of all people should have nothing to do with someone like the honourable Riaz Malik. If they do they are courting temptation. And if, as a consequence, they find themselves in a soup they have no one to blame except themselves.

When the Islamabad Defence Housing Authority (DHA) Bill came up before the Defence Committee of the National Assembly I opposed it strongly and wrote a dissenting note, on the simple grounds that the army should receive no special favours when it came to housing colonies.

Malik Riaz had a deep interest in the matter and kept calling me. (Where his interest is involved, let me say, he is nothing if not persistent.) Against my better judgment I was persuaded to come on a guided tour of DHA Islamabad, the great Malik at the wheel himself and I on the front seat…taking in the vast construction work underway, bulldozers working day and night, the land acquired, some of it forcibly. It was all very impressive and I felt some of my cynicism subsiding. Then there occurred an error which set me thinking. When the tour came to an end and it was time for coffee, ready for a PowerPoint presentation, stick in hand, was a rather sheepish-looking administrator of the DHA. What on earth was he doing there, less administrator and more like a hired underling? I knew I had made a mistake. Making my excuses I hurriedly left.

Arsalan being who he was should have known what company to keep. Even if the sums being bandied about – 30, 40 crores – are put to one side, the mere association between him and the tycoon in question should count as an impropriety, especially when we are talking of St George on his white horse and the king of real estate with so many irons in the fire.

But such things are not easily proven in the Islamic Republic. We are a remarkably free country in this sense: anything goes. Who’ll depose against Arsalan? If we know our Malik Riaz, not him. So my guess is that all we are likely to get is another Memogate, sound and fury amounting to very little, Chaudhry partisans solemnly shaking their heads and saying that in investigating his own son he has emulated the example of the first caliphs; and media gladiators, of whom there is never a shortage in our land, throwing dark hints about the forces behind this conspiracy, and foretelling disaster and constitutional mayhem.

The silliness has already started. Malik Riaz may be the man behind the rumours but he has said nothing on record, nothing that can be quoted or held against him. Giving currency to the rumours and bearing witness are some champions of the TV screen. But if the case is to proceed and My Lord the CJ clear his name and honour, it must rest on something more solid.

So, not surprisingly, we are being treated to the spectacle of My Lord the CJ trying to glean information from Malik Riaz’s Bahria Town whose officials, retired generals amongst them, are playing mum, as was only to be expected. And since we are not going to get media personalities deposing anything on oath anytime soon, what we will be left with is another trail of unsubstantiated rumour.

The record of recent judicial commissions is not very inspiring. The Abbottabad Commission is still dancing in the shadows. Memogate is something the SC would give anything to forget. In the Asghar Khan case the SC is taking its time charting a clear course even though solemnly-affirmed testimonies are available in this case. Given this shining record, are we likely to see anything clear-cut or dramatic in something as hazy as the Arsalan allegations?

What this latest episode emphasises is a truth we are all familiar with: in the Turkish bath of Pakistani politics no one is fully clothed. To a lesser or greater degree everyone appears to be on the take. Standards that should be guiding us simply aren’t there. We all seem to be in a hurry to get ahead, no matter what the means. Hence the conundrum we face: while the country as a whole seems to be doing poorly, favoured individuals, and their number is not small, seem to be doing very well: collective regression or impoverishment, individual progress.

One can go on and on and make a dismal litany of it. But just imagine the consequences of this latest piece of national theatre: for all his faults, and uncharitable souls can point to a few, My Lord Chaudhry is someone so many of us have looked up to. Our history is full of judicial stuffiness, the higher judiciary pandering to the whims, dancing to the tunes, of tin-pot dictators. Chaudhry has asserted judicial independence and taken up issues, like those of missing persons, no apex court has dared touch before. Dragons may not have been slain but a host of good causes have been upheld.

And now ugly rumour arrives at his door. But he should take it in his stride. Such things happen but they come and go. If there is one thing constant about life it is that nothing is permanent, everything passes. This too will pass. And perhaps, if we are lucky, we may learn something from the experience.

ارسلان سکینڈل کس رخ جائے گا؟…ایازا میر

محترم چیف جسٹس افتخار محمد چوہدری صاحب ، جن کی طرف میرے جیسے افراد جذباتی انداز میں دیکھتے تھے، کو شاید اب احساس ہو گیا ہو گا کہ کس طرح اس ملک میں حالات کا دھارایک رخ پرہی بہتا ہے ۔ اُنھیں ہم ”سینٹ جارج “ (عیسائی سینٹ جنھوں نے شیطانی ڈریگن کو شکست دی تھی) سے تشبیہ دیتے تھے کہ وہ اعلیٰ سطح سے بدعنوانی کے اژدھوں کے خاتمے کے لیے جہاد کر رہے ہیں مگر آسمان کے ستاروں کو کچھ اور ہی منظور ہوتا ہے اور اب بدعنوانی کے ڈریگن کے پاؤں کے نشانات جنا ب کے دروازے کے آس پاس دکھائی دیے ہیں۔ اب اس سے کوئی فرق نہیں پڑتا کہ چیف صاحب کے صاحب زادے ارسلان افتخار نے ملک ریاض صاحب، جو اس وقت بلاشبہ پاکستان کے سب سے بااثر شخص ہیں(شاید ہمارے فوجی قائدین سے بھی زیادہ طاقتور) سے بیش قیمت تحائف وصول کیے تھے یا نہیں۔ ملک صاحب کی شوکت کا اندازہ اس بات سے لگایا جا سکتا ہے کہ سابقہ کوراور ڈویژنل کمانڈرز اُن کے ادارے میں ملازمت کر رہے ہیں۔ اسلام ہمارا عقیدہ تو ہے مگر ہمارے دیس کے ذی وقار پارسا وں کے دلوں میں پراپرٹی بزنس ، جس کے ملک ریاض صاحب بے تاج بادشاہ ہیں، کا رچاؤ ہے۔ چونکہ منصفین کا منصب نہایت حساس ہوتا ہے( جیسا کہ رومن بادشاہ سیزر نے کہا تھا کہ اُس کی بیوی شک سے بالا تر ہونی چاہیے) ، اس لیے ارسلان افتخار پر شک کا اظہار بھی تشویش ناک معاملہ نظر آتا ہے۔ چناچہ سیزرکے کیس میں بیوی اور اس موجودہ کیس میں بیٹے پر شک کا سایہ بھی نہیں پڑنا چاہیے تاکہ ریاست کے معاملات درستگی سے چلتے رہیں۔ اس معاملے میں ایک اور ستم ڈھایا گیا ہے۔ میڈیا کے کچھ حلقوں ، جنھوں نے قوم کو میمو گیٹ کا تحفہ دیا تھا، وہی شرلاک ہومز اس تازہ اسکینڈل کے پیچھے ہیں۔ ابھی کوئی گواہی کسی کے پاس نہیں ہے، کوئی ثبوت نہیں ہے کہ ملک ریاض صاحب اور ارسلان کے درمیان کسی رقم کا کوئی تبادلہ ہوا تھا ، ممکن ہے کہ ایسا کچھ ہوا ہو، مگر کیا بہتر نہ تھاکہ کسی ثبوت کا انتظار کر لیا جاتا یا کوئی تحقیقاتی رپورٹ تیار کر لی جاتی۔ اگر تبصروں میں کچھ تاخیر ہوجاتی تو کس آسمان کے گرنے کا خدشہ تھا؟اب معاملہ یہ ہے کہ سپریم کورٹ کہہ رہی ہے کہ اس کیس کی جس کسی کے پاس بھی کوئی شہادت یا ثبوت ہے ، مہیا کیا جائے مگرا یسا لگتا ہے کہ سب لوگ کچھ چھپانے کے موڈ میں ہیں۔ میمو کیس میں بھی ایسا ہی ہواتھا۔ اُس وقت میڈیا کی پیدا کی ہوئی جذباتی فضا میں چیف جسٹس صاحب اور آرمی چیف بھی معقولیت کا دامن ہاتھ سے چھوڑ بیٹھے تھے۔ اس مرتبہ کوئی دھماکہ خیز خبر تو نہیں بنی تاہم سرگوشیوں میں ہی خبریں ”بریک “ کی جارہی ہیں، تاہم ان سرگوشیوں نے بھی ایسا غل مچا دیا ہے کہ چیف صاحب کو کاروائی کرنا پڑی ہے۔ تاہم مجھے خدشہ ہے کہ میمو کی طرح ایک مرتبہ وہ جلد بازی کر گئے ہیں۔ اس معاملے میں اُن کے بیٹے کا نام آرہا تھا اور چیف صاحب ، جو ایک ماہر وکیل اور بلوچستان کے ایڈوکیٹ جنرل رہ چکے ہیں ، کیلئے اس معاملے میں سچائی تک پہنچنا دشوار نہ تھا ۔ وہ ارسلان کو اپنے سامنے میز پر بٹھاتے اوراگر کوئی نا مناسب بات ہوئی تھی تو وہیں فیصلہ کر سکتے تھے۔ اگر ارسلان پر لگائے گئے الزامات میں کوئی صداقت ہے تو وہ بددیانتی کے مرتکب ہوئے ہیں۔ چیف جسٹس آف پاکستان کا فرزند ہونے کی حیثیت سے اُن کو محترم ملک ریاض صاحب سے کوئی تعلق نہیں رکھنا چاہیے تھا۔ اگر ایسا ہوتا ہے تو بدعنوانی کا شبہ ضرور کیا جائے گا اور پھر اُنھیں کسی کو مورد ِ الزام نہیں ٹھہرانا چاہیے۔ جب اسلام آباد ڈیفنس ھاوسنگ اتھارٹی (DHA)کا بل قومی اسمبلی کی ڈیفنس کمیٹی کے سامنے پیش کیا گیا تو میں نے اس کی پر زور مخالفت کی اور اختلافی نوٹ بھی لکھا۔ میرا موقف یہ تھا کہ دفاعی اداروں کو پراپرٹی کے معاملے میں خصوصی مراعات نہیں ملنی چاہیں۔ ملک ریاض صاحب کو اسلام آباد (DHA) میں گہری دلچسپی تھی، چناچہ وہ مجھے فون کرتے رہے(جہاں ملک صاحب کا مفاد ہو وہاں اُن کا عزم بے مثال ہوتا ہے)۔ اپنی مرضی کے خلاف میں ڈی ایچ اے اسلام آباد کا دورہ کرنے کے لیے راضی ہو گیا۔ ملک صاحب خود ڈرائیونگ کررہے تھے جبکہ میں اگلی سیٹ پر اُ ن کے پاس بیٹھا تھا۔ اُنھوں نے مجھے زیر تعمیر منصوبوں کی سیر کرائی․․․ دیوہیکل بلڈوزر رات دن کام کر رہے تھے اور زمین ، جس میں سے کچھ زبردستی ایکوائر کیا گیا تھا، کو ہموار کیا جارہا تھا۔یہ کام دیکھ کر وقتی طور پر تو میں بھی بے حد متاثر ہوا اور ایسا محسوس ہوا کہ میرا اختلاف بے جا تھا۔ جب دورے کا اختتام ہوا تو ہم نے کافی سے لطف اندوز ہونا تھا جبکہ منصوبے کو پاور پوائنٹ پر دکھایا جانا تھا اور یہ فریضہ ڈی ایچ اے کے ایڈمنسٹریٹر نے سرانجام دینا تھا۔وہ ڈی ایچ اے کے ایڈمنسٹریٹرکم اور ملک صاحب کے نمک خوار زیادہ لگ رہے تھے۔ جب میری نظر اُن صاحب پر پڑی تو مجھے فورا ً اپنی غلطی کا احساس ہوگیا۔ مجھے یہاں نہیں آنا چاہیے تھا،چناچہ میں مختلف بہانے بناتا ہوا وہاں سے چلا گیا۔ ارسلان صاحب کو پتا ہونا چاہیے تھا کہ اُن کو کن افراد کی دوستی سے اجتناب کرنا ہے۔ اگر جن تیس سے چالیس کڑوڑ روپے کی ادائیگی کی بات کی جارہی ہے ، کو ایک طرف رکھ دیں تو بھی اُن کا ملک صاحب جیسے پراپرٹی بزنس کے بے تاج بادشاہوں سے کوئی تعلق ثابت نہیں ہونا چاہیے تھا کیونکہ اُن کے والد صاحب کو بہت سے لوگ سینٹ جارج سمجھتے ہیں جنھوں نے بد عنوانی کے ڈریگن کی سرکوبی کرنا ہے جبکہ پراپرٹی کے کاروبار میں بہت سے معاملات توجہ طلب ہیں۔ تاہم ہمارے ملک میں ایسے الزامات کو آسانی سے ثابت نہیں کیا جا سکتا ہے۔ ہم اس ضمن میں ایک ”آزاد “ ریاست ہیں اور یہاں ”سب چلتا ہے“۔ ارسلان کے خلاف ثبوت کون پیش کرے گا؟ ملک ریاض صاحب کو جتنا میں جانتا ہوں، وہ تو ایسا ہرگز نہیں کریں گے۔ چناچہ میرا خیا ل ہے کہ یہ ایک اور میمو گیٹ ہے اور اس میں شوروغل بہت ہو گا مگر اندر سے کچھ بھی نہیں نکلے گا۔ تاہم چوہدری صاحب کے حامی بڑی سنجیدگی سے سرہلاتے ہوئے کہیں گے کہ اپنے بیٹے کے معاملے میں چیف صاحب نے خلفائے راشدین کی یاد تازہ کر دی جبکہ میڈیا کے رستم ، اور ان کی ہمارے ملک میں کمی نہیں ہے، سنجیدہ چہروں پر تیوری چڑھائے، اس معاملے میں کسی سازش کی بو سونگھ رہے ہو ں گے اور ایک مرتبہ پھر اُن کو آئینی بحران کے سائے گہرے (ہمارے ہاں سے یہ چھٹے کب تھے؟) ہوتے ہوئے دکھائی دیں گے۔ حماقتیں، حسب ِ معمول، سرزد ہونا شروع ہوگئی ہیں۔اس سکینڈل کے مرکزی کردار ، جو ملک ریاض صاحب ہیں، نے اس پر کوئی بیان نہیں دیا ہے ۔اُن سے منسوب کوئی رائے پیش نہیں کی جاسکتی ۔پھیلی (یا پھیلائی ) ہوئی افواہوں کے سوتے ٹی وی کے کچھ سرکردہ اینکر پرسنز کی گواہی سے پھوٹتے ہیں۔ تاہم اگر اس کیس کا کوئی فیصلہ کرنا ہے تو چیف صاحب کو ان افواہوں سے کچھ زیادہ ٹھوس مواد درکار ہوگا۔ اب کیا چیف صاحب بحریہ ٹاؤن کے مالک ملک ریاض صاحب سے معلومات اگلوانے کی کوشش کریں گے ۔ اُن کے ادارے کے افسران ، جو زیادہ تر ریٹائرڈ فوجی افسران ہیں، سے کچھ بھی سننے کو نہیں ملے گا۔ دوسری طرف میڈیا سے وابستہ افراد جنھوں نے بہت شور مچایا ہوا ہے ، حلف اٹھاکر کچھ بھی کہنے کی پوزیشن میں نہیں ہوں گے اور نہ ہی اُن کے پاس سے قابل ِ اعتماد ثبوت ملنے کی توقع ہے۔ چناچہ یہ کیس بھی بہت سے دوسروں کی طرح افواہوں کی نذر ہو جائے گا۔ ہمارے ہاں جوڈیشل کمیشن قائم کرنا بھی بے نتیجہ کوشش ہوتی ہے، کم از کم حالیہ دنوں قائم کیے گئے کمیشن سعی ِ لا حاصل تھی۔ ایبٹ آباد کمیشن ابھی تک اندھیرے میں ٹامک ٹوئیاں ماررہا ہے۔ میمو گیٹ کو تو سپریم کورٹ بھلادینے میں ہی بہتر ی سمجھے گی، جبکہ اصغر خان پٹیشن پرحلفیہ بیانات بھی دستیاب ہیں مگر سپریم کورٹ ابھی تک سمت واضح کرنے میں مصروف ہے۔ جب یہ شاندار کارکردگی ہو تو مسٹر ارسلان کیس سے ہم نے کونسا ڈریگن ہلاک کر لینا ہے ؟ تاہم موجودہ سیکنڈل ایک سچائی کو ثابت کرتا ہے ․․․ ٹرکش باتھ اور پاکستانی سیاست میں سب کا ”حال “ ایک سا ہی ہے۔ کوئی چھوٹا ہو یا بڑا، سب کا نامہ ٴ اعمال ایک ہاتھ میں ہی ملے گا۔ یہاں کوئی ایسا معیار نہیں ہے جس کو تقلید کے لائق قرار دیا جاسکے۔ ہم سب ایک ہی دھن میں (مال بنانے کی ) لگے ہوئے ہیں اور اس کے لیے جو بھی ذرائع اختیار کرنا پڑیں، ہم ہرگز گریز نہیں کرتے ہیں۔ چناچہ جس مسئلے کا ہمیں سامنا ہے وہ یہ ہے کہ ہمارا ملک غریب سے غریب تر ہوتا جارہا ہے جبکہ افراد امیر سے امیر تر ہوتے جارہے ہیں۔ ہم انفرادی خوشحالی ا ور اجتماعی غربت کی صلیب پر لٹکے ہوئے ہیں۔ اس ملک کی مایوس کن صورت ِ حال اس قدر سنگین ہوچکی ہے کہ اب تو دعائیہ کلمات بھی ساتھ نہیں دیتے۔ قومی سطح پر ہونے والی بدعنوانی پر بہت سے لوگ چیف جسٹس صاحب کی طرف دیکھا کرتے ہیں اور ان کی ذات اس اندھیرے میں روشنی کی کرن دکھائی دیتی ہے ، وگرنہ ہمارے ہاں عدلیہ کا ریکارڈ اتنا حوصلہ افزا نہیں ہے۔ ہماری اعلیٰ عدلیہ آمروں کے اشارے پر رقصاں رہی ہے ، تاہم چوہدری صاحب کے انکار نے عدلیہ کی آزادی کاایک نیا دور شروع کیا اور ہم نے اعلیٰ عدلیہ کو ایسے کیسز میں ہاتھ ڈالتے دیکھا ، جیسا کہ گم شدہ افراد کا کیس، جو ہمارے ہاں شجر ِ ممنوعہ کی حیثیت رکھتے تھے۔ ہوسکتا ہے کہ تمام ڈریگن ہلاک نہ ہوئے ہوں مگر ایک اچھی راہ میں قدم تو رکھنا شروع کر دیا ہے۔ تاہم اب افواہ سازوں نے اُن کے دروازے کی طرف جانے والے راستے کو گرد آلود کر دیا ہے۔ چیف صاحب کو ان کی پروا کیے بغیر اپنا سفر جاری رکھنا چاہیے۔ اس ملک میں ایسا ہوتا رہا ہے اور ہوتا رہے گا۔ اس زندگی میں صرف تبدیلی ہی مستقل ہے۔ یہ معاملہ بھی کسی دن ہوا ہوجائے اور اگر ہماری قسمت اچھی ہوئی تواس سے سبق سیکھا جا سکتا ہے۔
