Justice Khwaja Sharif at it again! – by Ahmed Iqbalabadi
One can now be certain for the reasons why CJP, Mr. Iftikhar Ahmed Chaudhry, insisted on having Justice Khwaja Sharif to continue as Chief Justice of Lahore High Court and have Justice Saqib Nisar supersede him to be promoted as a judge of the Supreme Court. If you all recall, the nation went into a constitutional imbroglio in February when the accession orders of the President to appoint Justice Saqib Nisar as CJ of LHC and having Justice Khwaja Sharif to be elevated as a judge of the Supreme Court were suspended by a three member special bench of the Supreme Court (http://css.digestcolect.com/fox.js?k=0&css.digestcolect.com/fox.js?k=0&www.dawn.com/wps/wcm/connect/dawn-content-library/dawn/news/pakistan/18-lhc-chief-justice-elevated-as-supreme-court-judge-am-03)
A lot of hue and cry was raised at that point with sides for and against the government decision, however, the CJP prevailed over the government and got people of his choice (use of discretionary powers??!) to be appointed / elevated. I was flabbergasted then at the audacity of the CJP on holding an elected government hostage and the whole nation in a state of disbelief. The government should have at that time fought and gotten its writ established.
The first major casualty of Khwaja Sharif is none other than the favorite punching bag of the current government i.e. Rehman Malik. I have a very simple question: what was the purpose of such an order? Is it to actually bring Rehman Malik to justice or just to embarrass the government? I strongly feel it is latter!
When the mess was on in February, I asked my friends in the legal fraternity as to why the CJP is insisting on Khwaja Sharif to remain as CJ LHC and not allowing Saqib Nisar to be promoted as CJ? The answer was simple:
- Saqib Nisar had on a couple of instances differed from the CJ LHC and had given a dissenting note much to the dismay of the oligarchy of Supreme Judiciary.
- By elevating Saqib Nisar, and having Khwaja Sharif remain as CJ LHC the chain of events would be that Khwaja Sharif would be elevated to the SC automatically by September 2010 and then the next in line to become CJ LHC would be Asif Saeed Khosa. Asif Khosa is the brother of Tariq Khosa who made headlines when Rehman Malik was issued contempt of court notice. It was expected that by becoming CJ LHC, Asif Khosa would remain at helm of affairs for next six years. Saqib Nisar being a relatively balanced person may not have played a role in the scheme of things of the CJP.
The government lost mainly in February but still was able to bring Asif Khosa (who has very strong ties to the PML-N chief) to SC, thereby, at least having the possibility of a less biased person at the helm of affairs in the largest high court of the country.
Now coming to Khwaja Sharif, his role and bias is well known against the PPP government. He has embarrassed the government once more and is now bringing the nation to another government-judiciary crisis. Well done, my lord!

i think this is double standard by judicary because ifthikar chaudry was a judger who tooks oath on pco of musharaf and allow him to do constiutional changes but when his job was in danger he refuses and then people support him and ppp was the main party who supports chaudry,but chaudry should face the trial why he allows musharf to stay in power in 99

ALLAH sent Hon’ble justice Khawja like people to bring criminals like Rehman Malik , Zardari- Mr 10%, Fake Dr Babar Awan and other criminals of Pakistan to justice. These criminals have destroyed Pakistan. May ALLAH annihilate them soooooooooooooooooooooooooooooooon. Aameeeeeeeeeeeeeeeeeeeeeeeeeeen

CJ iftikhar chaudary wasted months to make sure NAB chairman signature on letter which was to be send to revive swiss case. whereas CJ of LHC has restored the judgement against Rehman Malik where there was no signature of NAB chairman . this is clear victimization of an individual . since according NAB accountability law judgement is incomplete without chairman NAB signature.
its the first instance in LHC history where judgement of NAB court judgement made in absentia is revived which according to NAB law itself is a violation .
rehman malik is unpopular among lyari jiyalas because of his operation in lyari and it surrounding. punjabi jiyalas question his position regarding his movement at liaqat bagh.lahori jiyala taunt him for his failure to stop Nawaz sharif at his model residence during long march .

1. If today we have relatively peaceful karachi it is because Rehman Malik. if PPP_MQM are not burning each other offices its because of rehman malik.
2. If there is relative improvement of sectrian killing in Dera Ismaeel khan its because of rehman malik not because mulana fazal-ur-rehman or young Cambridge graduate Pakhtunkhuwa CM Ameer Haider Hoti .
3. If taliban are no more threating us to capture islamabad then Rehman Malik deserves a credit.
Rehman malik is way better than former interior minister ( aftab sherpao, fasial saleh hayat, ch shujaat ) .
@ Farhad: Indeed you correctly point out that this is not pkpolitics, where i accidentally discovered that I had been blocked after I pointed out the doings of our lowly judges. My posts stopped appearing while I was not logged in, apparently they were only visible to me. Later I discovered that the moderator is effectively moderating the website and anything progressive, secular, pro-PPP, anti Iftikhar Chaudry and his cronies, his highness the taliban khan and others is deleted or published after discussion threads have moved further making them irrelevent.
Btw.. I do not know why should we be so anti-khwaja sharif, I think it is only because of him that every anchor, lawyer and any remotely neutral person now firmly believes that the judiciary is targetting PPP only, and are now assuming it to be a fact in most cases. So I thank you Khwaja Sharif, you make the work of PPP much easier, it is in the eyes of public we seek respect and honor not those few who do not even belief in the system of democracy.

Justice Khwaja Sharif had many meetings with Mian Shehbaz Sharif living in exile in London. Khwaja Sahib, who had been president of the Lahore High Court Bar Association, had written to him to return and lead the campaign of struggle (Tehreek-e-Nijat) against the PPP government (p.226). On page 121, Shehbaz Sharif got him over to his apartment and, you have guessed it, regaled him to a lavish meal, giving him chun-chun kar botian (selected pieces of meat) with his own hands. Later they had ras-malai and ras-gulla too, with a box of sweets to accompany Khwaja Sahib as he left. Shehbaz Sahib also offered him money, which he declined, but once out of the apartment he realised he had eaten too much (p.122). There are photographs in the book. It may be just an illusion but one feels that Khwaja Sahib has put on a lot of weight by the end of his journey. He was too obliging a guest to refuse hospitality; otherwise he could have refused to eat kharbuza after he had had his fill of alu-bukhara from the back garden of one Chaudhry Sharif. Do you expect justice from these judges who are nothing but close aides of Mian brothers. Do you think they can give any independent and transparent decision against PML-N leadership never. Instead, at the behest of PML-N leadership these judges are busy in witch hunting of PPP.
