Leaders of lawyers’ movement oppose the strike call by Qazi Mohammad Anwar
Aitzaz Ahsan termed the decision for a strike premature, warning that it would divide the lawyers’ community. He said the decision had been taken in spite of PM Gilani’s assurance that the NRO judgment would be implemented.
ISLAMABAD: A number of senior lawyers who were at the forefront of the movement for the independence of judiciary have opposed the strike call given by the National Coordination Council (NCC) for Jan 28, warning that the move would harm democracy and constitutionalism and divide their community.
“This is premature and we are not going to boycott courts on Thursday,” Sindh High Court Bar Association president Rasheed A. Razvi told Dawn.
Mr Razvi was the petitioner in the case in which a 14-judge Supreme Court bench had declared Gen Pervez Musharraf’s second coup through the emergency order of Nov 3, 2007, unconstitutional and held appointment of Justice Abdul Hameed Dogar as the chief justice illegal. The verdict had also determined that Justice Dogar’s appointment was in defiance of a stricture issued by a seven-judge bench the same day.
On Sunday, the Supreme Court Bar Association’s president Qazi Mohammad Anwar, claiming to be the new chairman of the council, had issued a call for a countrywide lawyers’ strike on Jan 28 to press for implementation of the apex court’s verdict on the NRO.
During the two-year struggle for an independent judiciary, lawyers used to boycott court proceedings and hold demonstrations every Thursday.
“We had a meeting of the SHCBA on Monday. Although we believe that all the decisions of the Supreme Court, especially on the NRO, should be implemented by the executive in all sincerity and seriously, we will not boycott court proceedings on Thursday,” Mr Razvi said.
He said the association had also endorsed his demand that seniority should always be the criteria for elevating a judge to the Supreme Court.
“Therefore, Justice Saqib Nisar of the Lahore High Court should be appointed as the LHC chief justice and Chief Justice Khawaja Mohammad Sharif should be elevated as a Supreme Court judge,” he said.
Aitzaz Ahsan, the pioneer of the NCC, told a television channel that he still was the chairman of the council and he had not been invited to the meeting.
None of the senior members of the council, including former SCBA president Ali Ahmed Kurd, Tariq Mehmood, Muneer A. Malik and Anwar Kamal, was asked to attend the meeting.
Mr Ahsan termed the decision premature, warning that it would divide the lawyers community.
He said the call would not even get a positive response in the NWFP from where Qazi Anwar had succeeded as the SCBA president with a very thin margin.
“We used to announce decisions after holding detailed discussions and consulting all members of the council and every bar association of the country,” he said.
He said Sunday’s decision had been taken in spite of Prime Minister Yousuf Raza Gilani’s assurance that the NRO judgment would be implemented.

سپریم کورٹ بار ایسوسی ایشن کے صدر علی احمد کُرد کا کہنا ہے کہ عدلیہ کی آزادی کے باوجود ابھی تک کچھ نہیں بدلا اور حالات اُسی طرح کے ہی ہیں جو نو مارچ سنہ دو ہزار سات سے پہلے تھے۔
علی احمد کرد نے عدالتی سال شروع ہونے کی تقریب سے خطاب کرتے ہوئے کہا کہ ایسا محسوس ہوتا ہے کہ ’فرعونوں‘ کےسامنے پیش ہو رہے ہوتے ہیں جو کیس کو ختم کرنےکو زیادہ اہمیت دے رہے ہوتے ہیں بجائے اس کے کہ انصاف کی فراہمی کی جائے۔
انہوں نے مزید کہا کہ یہی رویہ نو مارچ سنہ دوہزار سات سے قبل اعلٰی عدلیہ کے ججوں سے لےکر مقامی عدالتوں کے ججوں کا تھا۔
واضح رہے کہ سابق ملٹری ڈکٹیٹر جنرل ریٹائرڈ پرویز مشرف نے نو مارچ کو چیف جسٹس افتخار محمد چوہدری کے خلاف سپریم جوڈیشل کونسل میں ریفرنس بھیجا تھا۔
ماتحت عدالتوں کے فیصلوں کے خلاف ایک سو پچاس کے قریب پٹیشنز ریلیف کے لیے دائر کی جاتی ہیں جس میں سے بہت کم کو سول یا فوجداری اپیلوں میں تبدیل کردیا جاتا ہے جبکہ باقی رد کردی جاتی ہیں

یہ پہلی مرتبہ ہے کہ ججوں کی بحالی کی تحریک کی کامیابی کے بعد وکلاء کے کسی سرکردہ رہنما نے کُھل کر ججوں کے رویے کے بارے میں تنقیدی کلمات کہے ہیں۔
علی احمد کُرد نے کہا کہ ججوں کی بحالی کے لیے شروع کی جانے والی تحریک میں نہ صرف وکلاء نے ان کا ساتھ دیا بلکہ سول سوسائٹی اور انسانی حقوق کی تنظیموں نے بھی اس میں بڑھ چڑھ کر حصہ لیا۔
انہوں نے کہا کہ اس تحریک میں وکلاء نے اپنی قیمتی جانوں کے نذرانے بھی پیش کیے۔ سپریم کورٹ بار کے صدر کا کہنا تھا کہ لوگ اُن سے یہی سوال پوچھتے ہیں کہ اس تحریک کی کامیابی کے کیا اثرات سامنے آئے ہیں۔
انہوں نے کہا کہ مشاہدے میں آیا ہے کہ وکلاء نے جو پٹیشنز دائر کی تھیں اُن میں سے بہت کم درخواستوں کو دیوانی یا فوجداری اپیلوں میں تبدیل کیاگیا ہے۔ انہوں نے کہا کہ ماتحت عدالتوں کے فیصلوں کے خلاف ایک سو پچاس کے قریب پٹیشنز ریلیف کےلیے دائر کی جاتی ہیں جس میں سے بہت کم کو سول یا فوجداری اپیلوں میں تبدیل کردیا جاتا ہے جبکہ باقی رد کردی جاتی ہیں۔

Pandemonium mars LHCBA meeting

LAHORE: A meeting of the Lahore High Court Bar Association (LHCBA) called on Monday to discuss the implementation of the NRO verdict was disrupted by the slogan shouting pro-PPP lawyers.
The situation was so tense that the office bearers of the Lahore High Court Bar had to seek shelter at the Committee Room.
Earlier, the meeting presided over by LHCBA President Nasira Javed Iqbal commenced at the Kayani Hall, where Nasim Bajwa presented a resolution calling for implementation of the Supreme Court’s ruling on NRO.
The move angered the PPP lawyers, who were gathered there in a large number led by Peoples Lawyers Forum President Sardar Khurram Latif. They started chanting slogans in the support of President Asif Ali Zardari and against SCBA President Qazi Anwar.
The lawyers then climbed the chairs and created complete disorder.
On this, LHCBA President and other office bearers immediately left the hall and went to the Committee Room.
The PPP lawyers claimed that the strike call given by lawyers for Sunday has also been rejected besides resolution. They also expressed their non-confidence on Nasira Javed Iqbal.

Lawyers strike a conspiracy, says PLF

KARACHI – People’s Lawyers Forum has declared the decision taken by lawyers of Lahore on 24th January for the countrywide strike a great conspiracy to divide the lawyers community for the political motives.
These views were expressed by the president People’s Lawyers Forum, Muhammad Ashraf Samoo, during a Press conference at Karachi Press Club on Monday.
Samoo said that the call of the strike was unnecessary and unreasonable that would cause harm to the democracy.
He mentioned that PPP government had restored the judiciary on the position before November 3, adding that if lawyers start another campaign, the democratic setup would be at stake.
He said that the strike call was neither given by the Pakistan Bar Council nor Supreme Court Bar Association; rather a small group of so-called lawyers in Lahore ignited this move.
He appealed that the strike call must be taken back before 28th January, otherwise they would bound to make strategy for countermovement.
Abdus Samad, Muhammad Saeed Abbasi, Choudhry Muhammad Nawaz, Abdul Karim Memon and others also attended the conference.

The decisions of Darbar e Uzma Pakistan have always been political. The constitutional petitions decided by successive Chiefs of Darba r e Uzma have been a mockery of the constitution of Pakistan. The Darbar e Uzma under the present chief has done the greatest crime against the constitution by beating about the bush during the hearings of various cases. Hearing means hearing not talking and talking and talking which the chief is very fond of. He unnecessarily took up the Geneva case, which was in the news because of the folly of someone more loyal than the King himself. The chief acted as if he were an anchor person on a private TV channel. The question was whether NRO was against the Basic Rights given in the constitution. There was no need whatsoever to have the record of cases decided on the basis of NRO. The “Chief” wanted to create a Hype in the media and he succeeded in his effort.
PBC rejects SCBA strike call

It is nothing short of peculiar: a section of the lawyers’ community has called for a countrywide boycott of the courts on Jan 28 to protest the ‘anti-judiciary’ moves of a ‘civilian dictator’. The crux of these lawyers’ complaint against the government/President Zardari is: one, that the NRO judgment has not been ‘implemented’; and two, that the government is ‘interfering’ in judicial appointments by disagreeing with Chief Justice Iftikhar Chaudhry’s recommendations. But on neither count is there a consensus even within the legal community.
There has been no ‘violation’ of the NRO judgment as yet, according to some very eminent jurists; indeed, from the prime minister downwards, government officials have all pledged to implement the NRO judgment. Some may have reservations about the government’s ‘true intentions’ but the law doesn’t deal with hypotheticals — if/when the government is in violation of the NRO, then can it be accused of ‘undermining the rule of law’.
Second, as yet the disagreements between the judiciary and the presidency over judicial appointments have not risen to the level of illegalities. As it stands, Chief Justice Iftikhar Chaudhry has made some recommendations, the president has declined to make the appointments and given his reason for doing so and that’s it. No side has violated the constitution and if anything, the executive is on the right side of the law as interpreted historically by the judiciary itself.
Given these facts, a court boycott cannot be justified, and raises the suspicion that politics may be involved. The lawyers’ movement was born of a desire to save the polity and the constitution from the depredations of a military dictator. To now invoke that spirit in a fight against a constitutionally elected president who is part of a system of electorally legitimate assemblies is bad enough. To do so on grounds that are weak and based on suspicions about what the presidency or the government may or may not do in the future is to destroy the very spirit of that movement.
While we did not always agree with the tactics of the lawyers’ movement in the fight to restore the judiciary, we admired the spirit. But the legacy of the lawyers’ movement is being threatened by those who appear to want to go beyond strengthening the judiciary and become arbiters of the country’s political future. We are, therefore, gratified that other sections of the lawyers’ community are already pushing back. For sure, to achieve true judicial independence, the executive will have to be battled again — but not in the way and on the grounds some are arguing for at the moment.
