Congratulations: Asma Jahangir won the SCBA elections.
It is a very good news after a long time from the lawyers’ front. Asma Jahangir’s success will have a positive impact on the direction of the Supreme Court and High courts.
The guys like Ahmed Awais and Qazi Anwar tarnished the image of one of the greatest movements in the history. It was a shame that a seat which was once honored by the lions like Ali Ahmed Kurd and the statesman like Aitzaz Ahsan and thinkers like Munir A Malik, was disgraced by Qazi Anwar. Good riddance, Qazi sahib!
Asma Jahangir’s victory is a slap on the face of the ISI and it’s cronies. The current Don (COAS) thought that after successfully manipulating the media/judiciary and after creating enough confusion, they could now have an easy ride. Ahmed Awais’s win in Islamabad (the center of the ISI) speaks volume how intense this war is. The battle will go on and at the end it will be the people of Pakistan who will come out victorious.
Asma Jahangir is roaring on the media. I always wondered why Faiz was so optimistic, despite all the gloominess , media propaganda and atrocities from the military against its own people, Faiz’s message was always of hope and resistance. But when I witness the historic moments like this, I realize the force behind Faiz’s hope. It is the people of Pakistan who always slap the establishment in the face whenever they get a chance.
And that is what I always tell my fellow comrades that there is no need to worry about the media venom, we must understand that though media may influence a small bunch of urban “illiterates” (the pseudo-liberals) , it cannot damage the collective wisdom of people of Pakistan.
Remember Pakistan is not Iraq or Middle Eastern state, it is a country of 160 million brave people. It is the most resilient society that existed on the face of earth and at the same time they are the most politically aware people in the whole world. It is because of this reason that for over 60 years people of Pakistan have resisted the most tyrant army on the face of earth.
History shows there will be very few (perhaps none) examples where common men have consistently fought and defeated the dictators and extremist. Even in the Europe and America, the people have never been so resilient in their resistance against the dictatorship.
Another aspect of the resiliency of the people of Pakistan is their consistent non-violent approach to get their rights. Despite facing perhaps the most brutal acts of violence by their own army, they always choose the path of non-violence.
Asma Jahangir’s victory is important in this struggle for the rights of people of Pakistan. It adds to the list of small battles that people of Pakistan have won against the establishment in the greater war for democracy.

Polling for the Supreme Court Bar Association (SCBA) presidential elections has ended with unofficial results indicating that prominent lawyer Asma Jahangir has won the elections by 42 votes. (Source)
Supreme Court Advocate and Human Rights activist Asma Jehangir is leading with 834 votes while Ahmed Owais who is her closest competitor bagged a total of 796 votes in the annual elections of Supreme Court Bar Association held today, Geo News reported Wednesday.
According to unofficial results of vote count so far: Karachi – Asma Jehangir 114 votes, Ahmed Owais 104; Lahore – Asma 419 votes, Owais 409; Multan – Asma 44, Owais 45; Quetta – Asma 42, Owais 29; Bahawalpur – Asma 27, Owais 29; Islamabad – Asma 124, Owais 29; Abbotabad – Asma 17, Owais 11 and; Peshawar – Asma 47, Owais 33.
Talking to media, Asma Jehangir said those who are doing business at the name of justice will face defeat today. “The city where we lost is the city of Establishment,” she said. (Source)

There are a total of 2,130 voters in the SCBA, including 1,518 from Punjab, 326 from Sindh, 179 from Khyber Pakhtunkhawa and 107 from Balochistan. They will decide the fate of 55 candidates vying for 21 seats. The most important election is for the presidential slot. These are non-panel elections, meaning candidates run for office in an individual capacity rather than as part of a group or party.
Senior members of the bar said it would be a close contest between Jahangir and Awais. They predicted that the margin of victory would be no more than 50 votes.
All three candidates avoided showing public support for former PCO judges during their campaign.

Lawyers worried over Asma’s stand

ISLAMABAD: As the crucial Supreme Court Bar Association election approaches in two days, the lawyers’ community is sharply divided as the key candidates have taken positions, which are at odds with their stature. A tallhuman rights figure, Asma Jahangir, who fought for the restoration of the judges, has now become a strong critic of the Supreme Court, more in line with the position taken by President Zardari and his PPP government. Lawyers are confused at this twist in her position.
The other candidate, Ahmad Owais, contesting on a popular platform of Hamid Khan group, strongly supports the judges and wants implementation of the verdicts, especially on the NRO, a position, which puts him in direct conflict with the PPP government.
Asma presents herself as an independent candidate but the government’s overt and covert support to her candidature has served her badly because of government’s own unending confrontation with the judiciary led by Chief Justice Iftikhar Muhammad Chaudhry.
Asma herself has been making some anti-judiciary statements especially in response to the Supreme Court’s December 16, 2009 judgment; While referring to the use of article 62-F as one of the bases for striking down the NRO by the Supreme Court, Asma said: “It was a ‘shararat’ (mischief) of the judges.” But she has welcomed the latest Supreme Court verdict on the 18th Amendment and praised the judges for their restraint.
Previously she has repeatedly questioned how all the 17 judges reached the same reasoning while rejecting this law. She did this more than ten times in about six TV programmes in the month of December 2009. Exact quote in Urdu was, “Thora bohat Ikhtilaf hota hay – Kaisay Yeh ho gia keh 17 kay 17 judgoon ki reasoning aik hi ho gayi”).
She also spoke against the NRO and in a December 19, 2009 programme said: “The NRO should not be sent to Parliament, which it did in July 31st judgment and it should have been decided by the court.”
“Why did the apex court shift ‘its’ burden on to the Parliament? By using 62-f the judges have assumed the powers to examine the characters of the parliamentarians,” Asma said during the same programme.
On the other hand, the second candidate for the position of President SCBA Ahmad Awais has always praised the country’s superior judiciary for its consistent stand in human rights cases and giving historic judgments like July 31, 2009 and December 16, 2009, which not only declared Musharraf’s November 3 emergency as illegal and unconstitutional, it also sent the Dogar court judges home.
Awais has appreciated the apex court judgments in all his statements, which have gone well with the lawyers, the media and the civil society in general.The two candidates have divided the top lawyers’ leadership as well and while Aitzaz Ahsan, Munir A Malik and many others have stepped on the sidelines, former Law Minister Iqbal Haider, Hamid Khan and Rashid A Rizvi have come out strongly against Asma Jahangir. Justice (R) Tariq Mehmood and Latif Khosa are openly supporting her while Ali Ahmad Kurd, Babar Awan are supporting her from behind the scenes.

No wonder Khan performs so bad in the elections , guys like Ahmed Awais are an insult to any political party. Khan’s choice of people around him has never been good but I did not realise he even has Ahmed Awais besides Hamid Khan.
Kudos to Justice Tariq Mehmood, Ali A Kurd, Munir A Malil and Latif Lala for their clear stance on the independence of Bar and support of Asma.
Sorry for the confused one Aitezaz, who flew away to Spain, and did not play his role, in the name of not indulging in Bar politics.

ISLAMABAD: Newly-elected and outgoing members of the Supreme Court Bar Association (SCBA) called on Chief Justice Iftikhar Muhammad Chaudhry on Thursday.
Speaking to the SCBA members, the chief justice said that the newly-elected SCBA body under the guidance of its president Asma Jahangir would work for the rule of law and strengthening of the country’s democratic system. He appreciated the efforts of Asma both within the country and abroad for restoration of judiciary after March 9, 2007.
He appreciating the role of SCBA’s outgoing president Qazi Muhammad Anwar and said Anwar had performed his job well and had cooperated with the bench in a professional manner.
Stressing the need of effective cooperation between the bench and bar, he said he was conscious of his duties and believed that there will be no difference between the bench and the bar and all the matters would be amicably solved with mutual consent of both sides.
Separately, Asma said the SCBA as a representative body of the lawyers community will continue soft accountability of the judiciary through a decent manner and would make its constructive voice heard. Asma said the body would no doubt resort to constitutional accountability of judges, but “only in extreme conditions and no one would be allowed to politicise the issue”. She announced that cooperation between bench and bar would continue, but at the same time a “required distance would also be maintained”.
Addressing the members of her team and former office bearers of the SCBA, she said that they would promote democratic norms.
