CJ Gate: Business tycoon says Pakistan chief justice’s son ran judiciary like a don
Business tycoon Malik Raiz asked three questions from Chief Justice Iftikar Muhammad during a news conference. Riaz holding the Quran in his right hand asked:
1. Chief Justice of Pakistan Iftikhar Muhammad Chaudhry should reveal how many times I (Malik Riaz) have met you in the middle of the night? Was Arsalan Iftikhar not a part of these meetings, does he not know me? The sitting Registrar was also present during several of these meetings.
2. How many meetings were held at the residence of Ahmed Khalil between the Chief Justice and Prime Minister and was there not an acting judge of the Supreme Court present during one of the meetings?
3. How long did the Chief Justice know about this case and why did he wait till media reports to take suo moto notice.
Malik Riaz said that he was blackmailed and did not pay any bribes. He described Arsalan Iftikhar as ‘Don’ adding that he was the one running the judiciary. SANA
Real estate tycoon and the developer of Bahria Town, Malik Riaz, on Tuesday levelled horrendous allegations against Chief Justice Iftikhar Muhammad Chaudhry, in his row with the son of the chief justice, Dr Arsalan Iftikhar.
Addressing a crowded news conference with reference to the Dr Arsalan Iftikhar suo moto case, Malik Riaz, while holding a pocket-sized Holy Quran in his right hand, asked three questions from the chief justice.
“I have come with Holy Quran just like the chief justice did while taking suo moto notice,” he said, adding he would share more evidence with media in the due course of time.
He asked the chief justice to tell the nation on Holy Quran as to how many times they had met during the night and if his son Dr Arsalan Iftikhar did not know about it? Was he and the sitting registrar of the Supreme Court were not present in these meetings?
He further asked the chief justice to disclose how many times he and the prime minister met at the residence of his partner Ahmed Khalil.
“Place this Holy Quran in front of you and tell the people, for how long have you not known about this? Why did you not take a suo moto then? Why did you take a suo moto only after the media broke the news?”
When asked of repercussions that may arise following such a news conference, Malik Riaz replied that he did not care if he was charged with contempt or sent to prison. He said a person putting everything at stake was never afraid of jail or death. “Call me in contempt of court or send me to jail. I’m ready to die. I’m not afraid of the jails,” he added.
Terming Dr Arsalan a ‘don’, Malik Riaz said he was running the judiciary, adding he did not go to the Supreme Court to purchase justice but to get justice. “Our cases were not heard in the Supreme Court properly,” he alleged.
He said the chief justice knew about the business dealings and should have taken suo moto action before the media broke this news.
Answering a question, he maintained that he had been blackmailed as a businessman and said, “I did not bribe anyone but was blackmailed. Blackmailers were assigned to follow me and I did not bribe anyone, my son-in-law did.
Answering another question, Malik Riaz said he would not demand judicial reference against the chief justice, adding that he had not accused the chief justice of anything and respected him.
He also denied that he had backing of President Asif Ali Zardari and Prime Minister Yousuf Raza Gilani. “President Zardari had refrained me from doing so,” he added.
He said in 2007, he worked for restoration of the judiciary and wrote columns in support of the chief justice during the Musharraf era. He said he even offered a bulletproof car to the chief justice for the safety of his life but he refused.
He said he faced investigation of NAB, FIA, MI and other institutions for sixteen years.
Malik Riaz had to leave in the middle of press conference amid a hue and cry that he should also disclose names of journalists on Holy Quran who had benefited from him.
“I do not need to answer all the questions,” he remarked after keeping mum for minutes and requested his legal counsel to answer questions of the journalists but he also declined. Najam Sethi’s name is being rumoured as one of those journalists who were bribed by Malik Riaz. (Source 1)

SC issues show-cause notice to Malik Riaz

After taking suo motu notice of the press conference organized by Bahria Town boss Malik Riaz Supreme Court of Pakistan Wednesday issued show cause notice to the real estate tycoon over his rant. Heading the three-member bench hearing the suo motu case, Justice Shakirullah Jan read out the draft of the real estate tycoon’s press conference. The bench issued show-cause notice to Malik Riaz for conducting a press conference with derogatory remarks directed against the judiciary. The court adjourned the hearing till today (Thursday). Earlier, the informal full court session summoned by the Chief Justice of Pakistan (CJP) Iftikhar Mohammed Chaudhry, solicited the record consisting of draft (transliteration) and footage of Riaz’s press conference. Later on after discussing the repercussions of the press conference, the apex court constituted a three-member bench to hear the suo motu case against Malik Riaz. It should be mentioned here that Malik Riaz leveled charges against Chief Justice of Pakistan (CJP) Iftikhar Muhammed Chaudhry’s son Arsalan of receiving bribes and foreign trips’ sponsorships from him. However, Arsalan denied the charges and in a previous hearing before a two-member bench, pleaded the court to issue arrest orders of Malik Riaz.
In fact bad news for CJ Chaudhry:
Pakistan Court Initiates Contempt Charge Against Justice’s Accuser

ISLAMABAD, Pakistan — Pakistan’s Supreme Court initiated contempt-of-court proceedings on Wednesday against a property baron who a day earlier accused the chief justice’s family of accepting $3.7 million in kickbacks and cash payments.

The contempt proceedings, which were announced after normal court hours, marked the judiciary’s first riposte in an extraordinary scandal that threatens Chief Justice Iftikhar Muhammad Chaudhry, who in some quarters has become an admired figure for his flamboyant court crusades against the country’s rich and powerful.
In court testimony and a news conference on Tuesday, the businessman, Malik Riaz Hussain, detailed a campaign of corruption. He implied that he had bankrolled luxury vacations in London, gambling in Monte Carlo and substantial cash kickbacks to Chief Justice Chaudhry’s son, wife and daughter-in-law over the past two years.
In court, Mr. Hussain’s lawyers said that Chief Justice Chaudhry’s 32-year-old son, Arsalan Iftikhar, had extracted the payments in return for favorable treatment in a number of court cases related to his property holdings. ‘‘I was victimized and blackmailed by him,’’ he said.
At a later news conference, Mr. Hussain went even further, suggesting that he had held secret meetings “in the dead of night” with the chief justice, although he did not directly accuse him of corruption.
‘‘I will make more disclosures,’’ he said, holding a copy of the Koran in one hand. ‘‘I will tell people what is happening in Pakistan.’’
Chief Justice Chaudhry, who had recused himself from the court proceedings, did not directly answer Mr. Hussain’s allegations. But the strong language used against the country’s top judge during the news conference offered ammunition to his colleagues on the bench to strike back against Mr. Hussain.
On Wednesday, they ordered the businessman to appear before a three-judge bench, headed by Justice Shakirullah Jan, on Thursday. Separately, the chief justice has convened a meeting of the full court to discuss the matter on Friday.
The judges may be hoping that contempt proceedings will stop Mr. Hussain from making further accusations outside the courthouse. The meeting of the Supreme Court bench on Friday will probably determine whether Chief Justice Chaudhry enjoys the full support of his fellow judges.
The spectacle, mixing politics, money, high drama and the law, has riveted the Pakistani media, which had largely treated the chief justice with deference bordering on reverence. ‘‘This is unprecedented,’’ said Cyril Almeida, an analyst with the English-language daily Dawn. ‘‘An institution like the Supreme Court is not designed to withstand this kind of ignominy. It cuts too close to the bone.’’
The case also focuses an uncomfortable spotlight on Mr. Hussain, who by several accounts has amassed a sizable fortune over the past two decades, partly through property development deals with the military, yet faced little media scrutiny.
His reputation as a well-connected but discreet power broker was shattered on Tuesday when he walked into the Supreme Court, armed with extensive details of payments that his lawyers said were linked to the chief justice’s close family.
Producing copies of air tickets, hotel bills, wire transfers and car rental documents, Mr. Hussain offered a financial account of three European vacations taken by Mr. Iftikhar in 2010 and 2011. The details suggested a high roller more akin to the son of an Arab prince than a Pakistani judge.
During one trip to London in 2010, for example, Mr. Iftikhar spent more than $8,000 to hire a Range Rover for transportation, according to Mr. Hussain. Later, in Monte Carlo, he spent around $10,000 on four nights at the Hôtel de Paris and accumulated more than $12,000 in gambling debts. A year later, he rented an apartment on Park Lane in London and stayed with his mother and siblings at the nearby Marriott Hotel.
Mr. Hussain said the $168,000 tab for the three trips was picked up by his son-in-law, Salman Ahmed Khan, who is based in London. Although he never said it directly, Mr. Hussain gave the impression that he ultimately footed the bill. He also listed four cash payments totaling $3.6 million ‘‘made to Arsalan.’’ Documents filed in court did not specify where the money came from and there was no further confirmation that money had changed hands.
Despite this largess, Mr. Hussain said, his property disputes in court did not progress satisfactorily. ‘‘Contrary to promises and assurances, I did not get any relief,’’ he told the court.
Mr. Hussain said he had warned Chief Justice Chaudhry through an intermediary about his son’s demands for money. ‘‘There are several other businessmen, like me, who are being blackmailed,’’ he said. But instead of taking action against the chief justice’s son, the courts charged Mr. Hussain with murder.
Why Mr. Hussain chose to come forward remained unclear. ‘‘No one has prompted me,’’ he insisted.
Chief Justice Chaudhry did not respond directly, but his assistant, the Supreme Court registrar, said the judge had met Mr. Hussain only before his reinstatement in March 2009.
While Chief Justice Chaudhry has been criticized this year for pursuing what was seen as a personal vendetta against President Asif Ali Zardari in the courts, he has also been praised for taking on the country’s top generals, including those of the powerful Directorate for Inter-Services Intelligence, over their part in suspected human rights abuses in the northwest and Baluchistan Province.
Some have speculated that those military cases prompted Mr. Hussain’s aggressive actions, although he denied it.

I take oath on Quran I never received a penny from Malik Riaz: Imran
By: INP | 22 minutes ago | 9
Brushing aside allegations of receiving money from real estate tycoon Malik Riaz, Pakistan Tehrik-e-Insaf Chairman Imran Khan said; I take oath on Quran I never get even a penny from Malik Riaz. Imran Khan categorically denied that any of his party member had taken money, reasoning if it happened he must have known that. The cricketer-turned politician said he would not let the judiciary to be toppled. He said a politician, sitting in Rawalpindi, should be ashamed of leveling baseless allegations. Imran Khan further said President Asif Ali Zardari had appointed Husain Haqqani as ambassador to US and he was also involved in the memo conspiracy. The PTI chief also spoke against war against terror, saying no issue could be resolved through war. Imran Khan said that he will stand by the Supreme Court of Pakistan. He said that conspiracies against the apex court were being hatched for the last few years. Imran Khan’s statement comes a day after property tycoon Malik Riaz levelled serious allegations against Chief Justice of Pakistan Iftikhar Muhammad Chaudhry. Political analysts say the allegations against the country’s top judge are the part of a conspiracy to maintain status quo. Moreover, lawyers fraternity have condemned the allegations leveled by Malik Riaz against Chief Justice Iftikhar Mohammad Chaudhry in a press conference on Tuesday. In separate meetings Islamabad High Court Bar Association and Khyber Pakhtunkhwa Bar Association expressed solidarity with the chief justice and pledged to launch a movement against those who are conspiring against the Supreme Court.

Last chance for Malik Riaz, son
By: Terence J Sigamony | June 12, 2012 | 5
ISLAMABAD – The Supreme Court Monday directed Malik Riaz and his son Ali Riaz to file concise statement by today (Tuesday). Bahria Town chief executive Ali Riaz was also ordered to appear in person, otherwise the court said it would be compelled to pass an order.
Earlier in the day, the Supreme Court Registrar Office rejected a plea of Chief Justice Iftikhar Muhammad Chaudhry’s son Dr Arsalan Iftikhar for registration of an FIR against real estate tycoon Malik Riaz Hussain.
Private TV channels reported at night that the business baron, who was said to be in the UK for treatment, has reached Islamabad. And his counsel Zahid Bukhari told the media that Riaz will record his statement today.
Arsalan in his plea had also asked the court to order arrest of the business baron and put his name on the Exit Control List (ECL). But the Registrar Office noted that the case is being heard in the court, so the application should be placed before it. Bukhari termed the application a poor attempt to scare away his client.
As the two-member bench comprising Justice Jawwad S Khawaja and Justice Khilji Arif Hussain resumed the hearing of the case regarding allegations of a clandestine deal between Riaz and Arsalan to influence the judicial process, Bukhari said Riaz would return in two days. Justice Jawwad said for the time being there was no need of his personal appearance but he should have filed the statement on Saturday.
The court on June 7 had ordered both parties to submit their statements by Saturday. Arsalan did file his concise statement but Malik Riaz and his son failed to comply with the order. Taking strong notice of it, Justice Jawwad ordered Zahid Bukhari to file his client’s statement before the hearing on Tuesday (today), saying if he failed then they would proceed on the basis of available material.
Justice Jawwad said three persons of private TV channel appeared before the court and also filed their statements. The court wanted to check and determine veracity of their statements.
He asked Sardar Ishaq, counsel for Dr Arsalan, and Bukhari to propose under what law the trial should be conducted. He said that they wanted to determine the nature of the offence. He inquired what law is attracted, telling them: “You are the best judge in this situation.” Both the counsels suggested different sections of Pakistan Penal Code, like sections 163, 420 (fraud), or 383 (extortion) of the PPC.
Sardar Ishaq argued that if Malik Riaz was unable to appear before the court then at least someone else should submit the documents he allegedly has claimed to be possessing. He said: “My fear is that Malik Riaz is delaying in furnishing documents in order to tamper them.” Mr Bukhari replied that technology is so advanced now that tampering could easily be detected.
Bukhari asked the court to either order an inquiry into allegations against Arsalan by an investigation agency or form a probe commission like it did in memogate case.
Arsalan’s counsel filed a CMA in which he made reference to a programme gone on air on a private TV channel on June 10. In that programme Hamid Mir has been quoted as saying “Malik Riaz has told him that he has video and pictures of Dr Arsalan’s mother and sister.”
Dr Arsalan said he (Malik Riaz) has no right to blackmail his family by using such tactics. He asked the court to put him and Malik Riaz on ECL and if necessary, “put (both of) us in the jail till the finalisation of the case”. He said: “I would reply to all the allegations.” Sardar Ishaq said that during the pendency of the case the media should be restrained from airing any such material. Justice Jawwad S Khawaja said: “The scurrilous (material) has no nexus with the case and would not be allowed.”
Zahid Bukhari categorically said that Malik Riaz has not made any such statement to Hamid Mir or to anyone else. He said his client would never say anything, which brings disrespect to any family member of the chief justice and Dr Arsalan.
Sardar Ishaq also expressed fear about the security of his client. Arsalan through his lawyer said his father, Ifthikhar Chaudhry, had expelled him from his house and that he might meet the fate similar to that of Shahbaz Taseer and a son-in-law of a former chairman joint chiefs of staff committee, both of whom were kidnapped in mysterious circumstances.
Bukhari said Malik Riaz would not do anything to cause damage or harm to Dr Arsalan or CJP’s family. The attorney general was however asked to arrange for the security of Dr Arsalan. The attorney general said that he would talk to secretary interior to ensure adequate security to Arsalan and his family.
Ali Zafar appeared as the counsel for Bahria Town. He informed the bench that Bahria Town secretary could not appear in the court to which Justice Jawaad remarked that “this was the court and should not be turned into Bahria Town”.
The Federal Board of Revenue chairman sent a sealed envelope, which was opened in the court. The court noticed that for number of years the tax returns of Malik Riaz were missing. An FBR official informed that, in hurry, whatever they could find they have submitted before the court but they would submit the missing documents as well. The court directed the official to file by Tuesday (today) the complete tax returns of Malik Riaz from 1986-87 till May 15, 2012, when he resigned from Bahria Town as chairman.
Arsalan Iftikhar was scolded by the bench when he interrupted saying he be given 5-minute time as some television channels had discussed his family in talk shows. He wanted to speak about Hamid Mir’s programme.
Dr Arsalan said: “Riaz Malik says that he has pictures and video of my mother and sister.” The court barred him from directly addressing the court. Upon that Dr Arsalan said that “you could send me to jail but I will not tolerate this”. Justice Khilji asked him to maintain court decorum, saying: “If the need be then they will send him to jail.” He said in the presence of his counsel he (Arsalan) should not speak.
Justice Jawwad S Khawaja said that they would not determine the question of fact on the basis of media reports. He said that media should feel the delicacy of the case. He remarked that it seems as if there was no issue in the whole country other than this case. “Naturally we have to proceed in accordance with law,” he said. The case was adjourned till Tuesday.
Earlier, in the day, Zahid Bukhari told the media his client would return to Pakistan Monday night and appear before the court to record his ‘explosive’ statement. Reacting over the Arsalan’s plea, Bukhari dubbed it as a tactic to bar his client from coming to the country. He said Riaz would come to Pakistan even if 10 FIR’s were registered against him. He claimed that Malik Riaz’s statement would prove explosive.
