Mumtaz Qadri, A Hero? – by Bahadar Ali Khan
It is hard to find a dull moment on the horizons of Pakistan and especially when a civilian government is in place. But the recent developments in the aftermath and leading to the murder of Governor Punjab Salman Taseer are actually very scary, to say the least.
A Pakistani state which already failed on many accounts, has now transformed into a smoking inferno which can erupt any moment and that will wipe and burn away everything. The bigotry, mindlessness and intolerance has tore about everything of which a social fabric of a society is woven with. I was appalled to see the scenes of hero-like welcome to the suspected murderer of the constitutional head of the largest province of Pakistan. And this was accorded to him by none other than the lawyer fraternity, who are the very custodians of law and justice. No matter what was the motivation, it was a murder and in any society of humans it is incomprehensible to glorify the murderer.
In my previous writings I have been consistently mentioning the emerging dangerous trends and pampering of zealots by the state organs, so I am not going to repeat myself over it. But it is necessary to reiterate that after the painful procedures carried out over Pakistan in the last thirty odd years, we don’t need to be genius to guess the ditch we are going to fall in.
I always question myself, when we’ll stop celebration of the arrival of Muhammd Bin Qasim and look into the future? Infact Pakistan was created twice, once when it was carved out of the Indian Union by a brilliant lawyer and statesman Muhammad Ali Jinnah, but that Pakistan didn’t last long. The mischievous elements who were left behind rather opposed the making of new nation state, soon re-organized theirself to get credit for what that was none of theirs. However they remained on the sidelines and no one paid any attention to them, until they found one of their type, General Zia-ul-Haq as late as in 1977. And this was the second of birth of the Pakistan. Muhammad Ali Jinnah’s Pakistan was dead and a new Pakistan came into being. Currently we are living in this new dictator framed Pakistan.
During the past three decades, the religious facade was given to cover up any lie, dishonesty and consequently hypocrisy became the hallmark of this ‘holy’ society. The clandestine and visible efforts were made to spread hate and intolerance, as it was necessary to sustain the illegal rule of Zia. Religious forces were given free hand coupled by the public capital punishments and lashing, which gradually transformed the society into the one which sought its entertainment from inflicting pain and suffering on its fellow members, basically a sadistic one. School text books were amended to include heroic Arab conquests of the world. National media glorified the same characters of Arab monarchies of Umayyad and Abbasis. The world view of the new minds was twisted with fabricated stories of gallantries and myths of crowdedness of their enemies. A nation was cheated to achieve the longevity of an individual’s ruling tenure. Basically during this process Pakistan lost a whole generation!
To compound the pain, Russian adventure in Afghanistan, implicitly plagued the entire nation to an extent that Pakistani society started reflecting the medieval outlook. Essentially if we fast it forward to present day, Pakistan has been transformed into a nation where nobody from outside world want to visit, invest and live. This is unfortunate but I must say the present scenarios is like the one we see in apocalyptic theme movies where a segment of the people are infected with a deadly virus and the rest of them quarantine them so that infection couldn’t spread. Please forgive my forbearance but I see the same scenario in the world where Pakistan is increasingly getting quarantined as no antidote has till this day been discovered to cure it.
Most of us are raised in traditional Muslim families where along with religious rituals, we are also imparted with vital lessons of ethics, morality, respect, tolerance and love. But lately the rituals have dominated the entire religious space and basic norms of living in a human society have practically evaporated. True, the whole scenario is not only the doing of clergy or power savvy generals but it has too many other moving parts as well. During the peak of Afghan Jihad days there was a special emphasis on one of the tradition ( Hadith ) that says “In the matter of faith, kids are not obliged to listen to the contrary views of their parents”. Agreed, but this was not quoted in love of religion but was used as a weapon to get the conscripts against the wishes of their parents for a multi-faceted Jihad in various regions of the world with focus on Afghanistan and Kashmir by the Pakistani establishment and greedy clergy.
The subject of blasphemy may be beyond me to indulge in but we are always taught to pray for treading the ‘Uswa-e-Hasna’ ( the best trail, meaning by to attempt the emulate the life of Holy Prophet ) but when I study the life and times of Holy Prophet, I find him with a patience as high as mountains, compassion more than a mother who showers the love on her infant, forgiveness of the highest level to the extent to forego who insulted him, to clemency for those who killed his nearest relatives and a message of love for everybody. Allah says in His Book “Ponder over ( think and learn)”, do we? And if we don’t what this whole fuss is about, let us celebrate the death of a murdered man and garland his murderer, after all Mumtaz Qadri has opened many closed vistas on us and if we follow them soon we’ll earn our respect in the community of nations!
Tailpiece: I wish Mumtaz Qadri knew that Qadri Sufi’s originate from Hazrat Mian Mir who was such a tolerant and peace loving man who even helped Sikhs in setting the foundations of Darbar Sahib Amratsar. Baba Bullhay Shah was also one from the same ‘silsala-e-Qadria’. Alas, someone could educate us!

میں یہ بات سمجھنے سے قاصر ہوں کہ یہ کس طرح ہو سکتا ہے کہ اسلامی جمہوریہ پاکستان میں رہنے والے بہت سوں کو سلمان تاثیر بطور گورنر پنجاب تو قبول تھے لیکن بطور ایک مقتول قبول نہیں ہیں۔
میڈیا اور عوام جو مقتول سلمان تاثیر کی پنجاب حکومت سے نوک جھونک تو مزے لے لے کر سنتے سناتے تھے، اب ان کے قاتل کو قاتل کہتے ہوئے گھبرا رہے ہیں۔
اور پاکستان کے ’جمہوریت پسند‘ وکلاء جو ایک آمر کے خلاف ایسے اٹھے کہ اسے ملک سے بھگا کر ہی دم لیا، بغلیں بجاتے ہوئے ایک قاتل کو کمرۂ عدالت کے باہر ہار پہنا رہے ہیں۔ کیا قادری نے ایک جمہوری حکومت کے جمہوری سیاستدان کا قتل نہیں کیا؟
بہت کم لوگ پی پی سی 153 اے (a) کا ذکر کرتے ہیں جس کے تحت مذہب، نسل، جائے پیدائش، شہریت، زبان یا اس طرح کی کسی چیز کی بنیاد پر نفرت پھیلاتے یا پھیلانے کی کوشش کرنے والوں کو پانچ سال تک سزا ہو سکتی ہے
تو پھر لوگ چپ کیوں ہیں۔ یہ کیا اگر مگر ہے۔ سلمان تاثیر کا جرم کیا تھا۔ صرف یہ کہ انہوں نے ایک ایسی مظلوم عورت کے لیے آواز اٹھائی جس کے لیے کوئی بھی کچھ کرنے سے کترا رہا تھا۔ مقتول گورنر نے آخر ایسا کیا کیا۔ ضیا دور میں جو توہینِ رسالت کا قانون بنایا گیا تھا وہ بھی تو سیاستدانوں نے ہی بنایا تھا اور اس کے بعد اس میں جو ترامیم ہوتی رہی ہیں وہ بھی سیاستدان ہی کرتے رہے ہیں۔ تو آخر اگر گورنر نے اس پر تنقید کی بھی تھی تو انہوں نے کون سی حد پار کر لی تھی۔ ہم سب کو معلوم ہے کہ اس قانون کا کس طرح غلط استعمال ہوتا رہا ہے۔ کبھی اسے جائیداد ہتھیانے کے لیے استعمال کیا گیا تو کبھی پیسے کے لین دین میں۔ کبھی بچوں کی لڑائی کے بعد پیغمبرِ اسلام کی شان میں گستاخی کا الزام لگایا گیا تو کبھی غیر مسلموں کو محلے سے نکالنے کے لیے۔
ایک اندازے کے مطابق انیس سو چھیاسی سے لے کر اب تک تقریباً سات سو سے زائد افراد پر توہینِ رسالت کے مقدمات بنائے گئے ہیں۔ ان میں سے کئی ایک کو نام نہاد مذہبی انتہا پسندوں نے سزا سنائے جانے سے پہلے ہی قتل کر دیا۔ کئی ایسے واقعات ہیں جہاں مشتعل ہجوم نے لوگوں کو یہ کہہ کر قتل کیا اور ان کے گھر جلائے کہ وہ توہینِ رسالت کے مرتکب ہیں۔ عدالتیں یہ سب کچھ دیکھتی رہیں اور معزز جج صاحبان جو ہر بات پر ’از خود نوٹس‘ لیتے رہتے ہیں چپ رہے اور قانون کے غلط استعمال کے خلاف کوئی بلند آواز ناراضگی کا اظہار نہیں کیا۔
بہت کم لوگ پاکستان کے قانون پی پی سی 153 اے (a) کا ذکر کرتے ہیں جس کے تحت مذہب، نسل، جائے پیدائش، شہریت، زبان یا اس طرح کی کسی چیز کی بنیاد پر نفرت پھیلاتے یا پھیلانے کی کوشش کرنے والوں کو پانچ سال تک سزا ہو سکتی ہے۔
آخر کتنے لوگوں کو اس زمرے میں سزا سنائی گئی ہے۔
قادری ایک قاتل ہے اور اسے قاتل ہی کہنا چاہیے
میرے خیال میں توہینِ رسالت کے علاوہ شاید ہی کوئی ایسا مقدمہ ہو کہ جس میں پولیس تھانے میں محرر کی طرف سے لکھی گئی ایف آئی آر کو صحیفے کی طرح یا کم از کم اتنی آسانی سے تسلیم کر لیا جاتا ہو۔ اس لیے شاید سلمان تاثیر اور ان جیسے بہت سے دوسرے اس قانون میں ترمیم کا کہتے رہے ہیں۔ یہ ترمیم پولیس کے اس قسم کا مقدمہ درج کرنے کے بعد تحقیقات کرنے کے طریقۂ کار سے لے کر مقدمے کی آزادانہ کارروائی تک ممکن ہے۔
دکھ کی بات یہ ہے کہ پنجاب کے گورنر کے قتل کے لیے بھی وہی عذر پیش کیا جا رہا ہے کہ جس کے خلاف وہ خود بات کرتے رہے ہیں۔ وہ یہ کہ توہینِ رسالت کے قانون کا لوگ غلط استعمال کرتے ہیں اور اپنے کوئی ’پرانے سکور‘ برابر کرنے کے لیے لوگوں پر جھوٹے مقدمات کرواتے ہیں۔
قادری ایک قاتل ہے اور اسے قاتل ہی کہنا چاہیے۔ اسے ہار پہنانے سے اس کا جرم تو کم نہیں ہوگا لیکن وہ لوگ شریکِ جرم ضرور سمجھے جانے چاہئیں جو ایسا کر رہے ہیں۔ ویسے پاکستان کا ہر قاتل یہ طریقہ ضرور استعمال کر سکتا ہے کیونکہ جب تک اس قانون کا استعمال اس طرح ہوتا رہے گا قاتلوں کو اس کی آڑ میں ’محفوظ پناہ‘ گاہ ملتی رہے گی۔
اب ذرا کوئی جا کے دیکھے تو کہ آسیہ بی بی کا کیا حال ہے۔
قادری نے سلمان تاثیر کے ساتھ اسے بھی تو مار دیا ہے۔

Qadari is a murderer and ignorant person and i m 100 % sure that he has no knowledge of Islam and Quran. He just want to become Ghazi Ilm deen and want to gain popularity. It is a dangerous tren among Muslims that they misuse Islam for their personal gains. Molvies, Ulma, Politicians, and people like Qadaris all are doing it.
Qadari should be given death penalty so that Muslims refrain from spilling blood of other people.
So far as these lawyers are concerned, just go and ask how much those lawyers offer 5 times prayers and refrain from lying in their profession???? How much have read Quran with translation????There Islam is limited to such emotional actions….pathetic…Muslims are degenerating…Alas!!!!
“Qur’an and Hadith on Blasphemy”
The scholars are unanimously agreed that a Muslim who insults the Prophet (peace and blessings of Allaah be upon him) becomes a kaafir and an apostate who is to be executed. This consensus was narrated by more than one of the scholars, such as Imaam Ishaaq ibn Raahawayh, Ibn al-Mundhir, al-Qaadi ‘Iyaad, al-Khattaabi and others. Al-Saarim al-Maslool, 2/13-16
This ruling is indicated by the Qur’aan and Sunnah.
In the Qur’aan it says (interpretation of the meaning):
“The hypocrites fear lest a Soorah (chapter of the Qur’aan) should be revealed about them, showing them what is in their hearts. Say: ‘(Go ahead and) mock! But certainly Allaah will bring to light all that you fear.’
If you ask them (about this), they declare: ‘We were only talking idly and joking.’ Say: ‘Was it at Allaah, and His Ayaat (proofs, evidences, verses, lessons, signs, revelations, etc.) and His Messenger that you were mocking?’
Make no excuse; you disbelieved after you had believed”
[al-Tawbah 9:64-66]
This verse clearly states that mocking Allaah, His verses and His Messenger constitutes kufr, so that applies even more so to insulting. The verse also indicates that whoever belittles the Messenger of Allaah (peace and blessings of Allaah be upon him) is also a kaafir, whether he was serious or joking.
With regard to the Sunnah, Abu Dawood (4362) narrated from ‘Ali that a Jewish woman used to insult the Prophet (peace and blessings of Allaah be upon him) and say bad things about him, so a man strangled her until she died, and the Prophet (peace and blessings of Allaah be upon him) ruled that no blood money was due in this case.
Shaykh al-Islam Ibn Taymiyah said in al-Saarim al-Maslool (1/162): This hadeeth is jayyid, and there is a corroborating report in the hadeeth of Ibn ‘Abbaas which we will quote below.
This hadeeth clearly indicates that it was permissible to kill that woman because she used to insult the Prophet (peace and blessings of Allaah be upon him).
Abu Dawood (4361) narrated from Ibn ‘Abbaas that a blind man had a freed concubine (umm walad) who used to insult the Prophet (peace and blessings of Allaah be upon him) and say bad things about him. He told her not to do that but she did not stop, and he rebuked her but she did not heed him. One night, when she started to say bad things about the Prophet (peace and blessings of Allaah be upon him) and insult him, he took a short sword or dagger, put it on her belly and pressed it and killed her. The following morning that was mentioned to the Messenger of Allaah (peace and blessings of Allaah be upon him). He called the people together and said, “I adjure by Allah the man who has done this action and I adjure him by my right over him that he should stand up.” The blind man stood up and said, “O Messenger of Allaah, I am the one who did it; she used to insult you and say bad things about you. I forbade her, but she did not stop, and I rebuked her, but she did not give up her habit. I have two sons like pearls from her, and she was kind to me. Last night she began to insult you and say bad things about you. So I took a dagger, put it on her belly and pressed it till I killed her.” Thereupon the Prophet (peace and blessings of Allaah be upon him) said: “Bear witness, there is no blood money due for her.”
(Classed as saheeh by al-Albaani in Saheeh Abi Dawood, 3655)
Al-Nasaa’i narrated (4071) that Abu Barzah al-Aslami said: A man spoke harshly to Abu Bakr al-Siddeeq and I said, ‘Shall I kill him?’ He rebuked me and said, ‘That is not for anyone after the Messenger of Allaah (peace and blessings of Allaah be upon him) .’” (Saheeh al-Nasaa’i, 3795)
It may be noted from this that the Prophet (peace and blessings of Allaah be upon him) had the right to kill whoever insulted him and spoke harshly to him, and that included both Muslims and kaafirs.
The second issue is: if a person who insulted the Prophet (peace and blessings of Allaah be upon him) repents, should his repentance be accepted or not?
The scholars are agreed that if such a person repents sincerely and regrets what he has done, this repentance will benefit him on the Day of Resurrection and Allaah will forgive him.
But they differed as to whether his repentance should be accepted in this world and whether that means he is no longer subject to the sentence of execution.
Maalik and Ahmad were of the view that it should not be accepted, and that he should be killed even if he has repented.
They quoted as evidence the Sunnah and proper understanding of the ahaadeeth:
In the Sunnah, Abu Dawood (2683) narrated that Sa’d ibn Abi Waqqaas said: “On the Day of the Conquest of Makkah, the Messenger of Allaah (peace and blessings of Allaah be upon him) granted safety to the people except for four men and two women, and he named them, and Ibn Abi Sarh… As for Ibn Abi Sarh, he hid with ‘Uthmaan ibn ‘Affaan, and when the Messenger of Allaah (peace and blessings of Allaah be upon him) called the people to give their allegiance to him, he brought him to stand before the Messenger of Allaah (peace and blessings of Allaah be upon him). He said, “O Prophet of Allaah, accept the allegiance of ‘Abd-Allaah.” He raised his head and looked at him three times, refusing him, then he accepted his allegiance after the third time. Then he turned to his companions and said: “Was there not among you any smart man who could have got up and killed this person when he saw me refusing to give him my hand and accept his allegiance?” They said, “We do not know what is in your heart, O Messenger of Allaah. Why did you not gesture to us with your eyes?” He said, “It is not befitting for a Prophet to betray a person with a gesture of his eyes.”
(Classed as saheeh by al-Albaani in Saheeh Abi Dawood, 2334)
This clearly indicates that in a case such as this apostate who had insulted the Prophet (S), it is not obligatory to accept his repentance, rather it is permissible to kill him even if he comes repentant.
‘Abd-Allaah ibn Sa’d was one of those who used to write down the Revelation, then he apostatized and claimed that he used to add whatever he wanted to the Revelation. This was a lie and a fabrication against the Prophet (peace and blessings of Allaah be upon him), and it was a kind of insult. Then he became Muslim again and was a good Muslim, may Allaah be pleased with him. Al-Saarim 115.
With regard to proper understanding of the ahaadeeth:
They said that insulting the Prophet (peace and blessings of Allaah be upon him) has to do with two rights, the right of Allaah and the right of a human being. With regard to the right of Allaah, this is obvious, because it is casting aspersions upon His Message, His Book and His Religion. As for the right of a human being, this is also obvious, because it is like trying to slander the Prophet (peace and blessings of Allaah be upon him) by this insult. In a case which involves both the rights of Allaah and the rights of a human being, the rights of the human beings are not dropped when the person repents, as in the case of the punishment for banditry, because if the bandit has killed someone, that means that he must be executed and crucified. But if he repents before he is caught, then the right of Allaah over him, that he should be executed and crucified, no longer applies, but the rights of other humans with regard to qisaas (retaliatory punishment) still stand. The same applies in this case. If the one who insulted the Prophet (peace and blessings of Allaah be upon him) repents, then the rights of Allaah no longer apply, but there remains the right of the Messenger of Allaah (peace and blessings of Allaah be upon him), which still stand despite his repentance.
If it is said, “Can we not forgive him, because during his lifetime the Prophet (peace and blessings of Allaah be upon him) forgave many of those who had insulted him and he did not execute them?” The answer is:
The Prophet (peace and blessings of Allaah be upon him) sometimes chose to forgive those who had insulted him, and sometimes he ordered that they should be executed, if that served a greater purpose. But now his forgiveness is impossible because he is dead, so the execution of the one who insults him remains the right of Allaah, His Messenger and the believers, and the one who deserves to be executed cannot be let off, so the punishment must be carried out.

Insulting the Prophet (peace and blessings of Allaah be upon him) is one of the worst of forbidden actions, and it constitutes kufr and apostasy from Islam, according to scholarly consensus, whether done seriously or in jest. The one who does that is to be executed even if he repents and whether he is a Muslim or a kaafir. If he repents sincerely and regrets what he has done, this repentance will benefit him on the Day of Resurrection and Allaah will forgive him.
Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) wrote a valuable book on this matter, entitled al-Saarim al-Maslool ‘ala Shaatim al-Rasool which every believer should read, especially in these times when a lot of hypocrites and heretics dare to insult the Messenger (peace and blessings of Allaah be upon him) because they see that the Muslims are careless and feel little protective jealousy towards their religion and their Prophet, and they do not implement the shar’i punishment which would deter these people and their ilk from committing this act of blatant kufr.
And Allaah knows best. May Allaah send blessings and peace upon our Prophet Muhammad and all his family and companions
