Updated: Ban the supporters of Taseer’s murder: An appeal to international organizations and governments
This is an ethical and legal appeal to all international organisations and governments including the United Nations, Governments of UK, Ireland, France, Germany, Italy and other countries of Europe, USA, Canada, UAE, India and all other countries of the world.
This is to request you to consider sanctions on the supporters of Salman Taseer’s killers. The sanctions may include:
1. Cancellation of any pre-existing visas;
2. Complete ban on issuing any kind of visas in the future;
3. Stopping national (public, private) and international organisations from engaging in any type of commercial or non-commercial businesses owned by these individuals;
4. Stopping all donations given to these individuals or the organisations they own or manage;
5. Freezing their bank accounts; and
6. Placing details of these individuals and organisations on the international database of terrorist organisations and individuals
On 4 January 2011, Governor of Pakistan’s Punjab Province Salman Taseer was brutally murdered by a religious fanatic who had been systematically brainwashed by a group of mullahs, journalists, politicians, lawyers and other members of Pakistani’s violent right wing (a numerical but very noisy and influential minority in Pakistan).
The killer operative, a police guard namely Malik Mumtaz Qadri, had been convinced that Salman Taseer is a blasphemous to the Prophet Muhammad (peace be upon him).
Before Salman Taseer’s murder, a number of violence inciting measures were taken by Pakistan’s Islamofascists including but not limited to the following:
1. Issuance of Fatwa of Salman Taseer’s apostasy and murder;
2. Violence inciting, fact twisting and misrepresenting campaign in Pakistan’s electronic and print media;
3. Systematic alliance of a particular political party (PML-N) in Punjab with a violent sectarian group (Sipah-e-Sahaba / Lashkar-e-Jhangavi)
4. Violent statements by a group of lawyers associated with the Jamaat-e-Islami, Tehreek-e-Insaf, JUI, JUP and PML-N
5. Announcement of reward on Aasia bib’s and Salman Taseer’s murder
6. Violent protests across various cities in Pakistan
After the brutal murder of Salman Taseer in Islamabad, several Islamofascists (mullahs, media persons, lawyers, politicians etc) have publicly endorsed his murder, praised his killer as a champion of Islam and/or tried to justify the murder by placing the blame on Salman Taseer or the PPP.

KARACHI: More than 500 religious scholars belonging to the Barelvi school of thought paid rich tributes to the assassin of Punjab Governor Salmaan Taseer on Tuesday and urged ‘Muslims across the country’ to boycott the funeral ceremony.
While the Deoband and Barelvi leaders appear to be on the same page when it comes to condemning the slain Pakistan Peoples Party (PPP) leader for terming the blasphemy law as a black law, the Barelvi scholars, who claim to be the ‘true lovers of the Holy Prophet (pbuh)’, have taken a more hardline stance.
The largest body of the Barelvi group, the Jamaate Ahle Sunnat Pakistan (JASP), whose directions are considered binding on every other organisation that follows the same school of thought, issued a statement saying that “No Muslim should attend the funeral or even try to pray for Salmaan Taseer or even express any kind of regret or sympathy over the incident.”
The statement which has been endorsed by senior Barelvi leaders such as Professor Saeed Shah Kazmi, Allama Syed Riaz Hussain Shah, Syed Shah Turabul Haq Qadri and Hajji Mohammad Tayyab calls the assassin Mumtaz Hussain Qadri ‘Ashiqe Rasool Ghaziye Mulk (Lover of the Prophet, Commander of the Country)’.
“We pay rich tributes and salute the bravery, valour and faith of Mumtaz Qadri,” the statement said, adding that the ministers, politicians, ‘so-called’ intellectuals and anchor persons should learn lessons from the governor’s death. The scholars said that those who insult the Holy Prophet (pbuh), even if they did not intend to, were liable for death.
Hajji Mohammad Tayyab, who is also the secretary general of the Sunni Ittehad Council, told The Express Tribune that scholars had “repeatedly urged the president, prime minister and Governor Taseer himself that if their knowledge about the blasphemy law are limited, they should consult them and avoid debating over the issue as it would inflame the people and then anything could happen.”
Shah Turabul Haq Qadri’s son Siraj, also a senior member of the JASP, endorsed the statement and said it was now binding on every Muslim.
Jamiat Ulemae Pakistan (JUP) central executive committee member Maulana Shabbir went as far as saying that in his opinion Salmaan Taseer was ‘Wajubul Qatil’ (must be killed according to divine law). “He had called the divine law of God, a black law and tried to protect a condemned blasphemer,” he said.
Senior Sunni Tehrik leader Shahid Ghauri said although his party was yet to issue any formal statement about the matter, he would support the call of JASP because the people who gave the edict were his elders.
Senior Jamaate Islami leader Farid Paracha distanced his organisation from the JASP statement, but condemned the governor for calling the blasphemy law, a black law. “I believe that this call for changing the law was being done at the behest of the US and other western powers.”
Senior cleric of the Deoband school of thought and Jamia Binoria chief Mufti Naeem said he could not understand why the slain PPP leader invited trouble for himself, especially given that the blasphemy law was passed in 1985 by the parliament unanimously. “He kept on taking Aasia’s name, but I ask why didn’t he ever make a similar plea for Aafia (Siddiqui).” Naeem said although Islam says that anyone who commits blasphemy is liable to death punishment, what the killer Mumtaz Qadri did was totally wrong as he took the law into his hand.
“The blasphemy law was made exactly to prevent such incidents. Else there will be chaos in the country and everyone would kill everyone,” he said. Maulana Asad Thanvi too supported Naeem’s stance and said although what governor Taseer did was condemnable in the strongest words, he should have been tried in the courts.
Allama Abbas Kumaili of the Shia school of thought said the blasphemy law can be misused and there was no doubt about it. “But the way Salmaan Taseer took up the matter was blunt which inflamed the more emotional and ignorant people of our country.”

“Salmaan Taseer was himself responsible for his killing,” Munawar Hasan, the head of Jamaat-e-Islami, one of the two big religious political parties, said. “Any Muslim worth the name could not tolerate blasphemy of the Prophet, as had been proved by this incident.”
“No Muslim should attend the funeral or even try to pray for Salmaan Taseer,” a statement from Jamaate Ahle Sunnat Pakistan, one of the biggest organisations of the Barelvi, representing 500 religious scholars, said. “We pay rich tributes and salute the bravery, valour and faith of Mumtaz Qadri.”
Taseer’s assassination showed how free speech has been curtailed in Pakistan. The religious scholars warned that others could meet the same fate.
“The supporter is as equally guilty as one who committed blasphemy,” the Jamaate Ahle Sunnat Pakistan statement said. It added that adding politicians, the media and others should learn “a lesson from the exemplary death”.
Qadri appeared in court, unrepentant, where waiting lawyers threw handfuls of rose petals over him and others in the crowd slapped his back and kissed his cheek as he was led in and out amid heavy security.
The internet had already been hosting fan pages for Qadri, with one Facebook page attracting over 2,000 followers before being taken down, while there were small demonstrations in favour of the killer in north-west Pakistan.

Last month Meher Bokhari, a prominent female television anchor, asked Taseer if he wasn’t following a “pro-western agenda” by supporting the Christian woman. Taseer replied: “If you are asking me if I am a liberal, I am.”

When asked if Pakistan was heading for a clash between liberals and hardliners, he said he doubted it would happen “in the near future” because “the death of the governor of Punjab will caution many who used to issue such statements”.

When asked if he believed Qadri himself would face justice – the death penalty, for instance – Khattak was at his most ominous. “The court and judges will also be too cautious to announce a verdict which is against the thinking of a majority of the people,” he said. “Judges are also human beings.”
I don’t know about you, but I’m not taking my eyes off the Qadri justice case. I hope Khattak will be proved wrong. But somehow I doubt it.

Jamaat-e-Islami, one of Pakistan’s main Islamist political parties, also said the assassination was justified. “If the government had removed him from the governorship, there wouldn’t have been the need for someone to shoot him,” it said in a statement.
Other segments of society, including talk-show hosts, have also justified Mr. Taseer’s murder.
“The governor’s remarks had hurt the sentiments of Muslims and Qadri could not control his sentiments,” said one top TV anchor on a prime-time show.

The Nation (of the Nawaiwaqt group), a right-wing paper close to the Punjab government, echoed the sentiment expressed by the The Jamat Ahle Sunnat religious group that blamed Taseer for setting himself for his own demise:
“It should be recalled that Mr Taseer had launched a public campaign against what he believed was a misuse of the blasphemy law. And, as was his wont when espousing the causes he thought worth defending, he vehemently argued for amending it. … he went too far, and even took up the cudgels on behalf of Aasia Bibi, who had been sentenced to death by a lower court under this law. Rather than letting the law take its course, he called a press conference in her house and openly demanded her release.”

۔ پاکستان کی مختلف جیلوں میں ہزاروں افراد چھوٹے بڑے جرائم کی سزا بھگت رہے ہیں۔ لاتعداد ہیں جن پر ابھی تک کوئی جرم ثابت نہیں ہوا لیکن وہ سال ہا سال سے کال کوٹھریوں میں بند ہیں۔ ان میں سینکڑوں غریب اور بے بس و لاچار خواتین بھی ہیں۔ سلمان تاثیر نے ان سب میں سے صرف ایک خاتون کا انتخاب کیوں کیاجو قانون و انصاف کے پہلے مرحلے سے گزر کرسیشن کورٹ سے سزا پاچکی تھی۔ ابھی اس کے پاس ہائیکورٹ اور سپریم کورٹ جانے کی گنجائش موجودتھی اور سلمان تاثیر کو صرف وہی خاتون مظلوم اور ستم رسیدہ کیوں دکھائی دی جس پر توہین رسالت کا الزام تھا؟ صوبے کا آئینی سربراہ ہونے کے ناتے اُنہیں یہ اختیار کیسے مل گیا کہ وہ نہ صرف معاملے کی حساسیت بلکہ اپنی منصبی ذمہ داریوں سے بھی انحراف کرتے ہوئے شیخوپورہ جیل پہنچیں‘اولین مرحلے میں مجرم ثابت ہوجانے والی خاتون کو ساتھ بٹھائیں اور وہ کچھ کہیں جو کچھ انہوں نے کہا؟ کیا آج تک پاکستان کی پوری تاریخ میں کسی وزیراعظم‘ کسی وزیراعلیٰ ‘ کسی صدر مملکت اور کسی گورنر نے ایسا کیا ہے؟ کیا کسی دوسرے ملک میں بھی اس طرح کی کوئی نظیر ملتی ہے؟ اور پھر انہوں نے قانون توہین رسالت کے بارے میں انتہائی ناتراشیدہ الفاظ استعمال کرتے ہوئے اسے ”کالاقانون“ قرار دیا۔ انہوں نے خود آسیہ بی بی سے ایک درخواست وصول کی اور اعلان کیا کہ وہ صدر زرداری سے اس کی سزا معاف کرائیں گے۔ باقاعدہ ٹی وی کیمرے سجا کر کہا کہ چیف جسٹس لاہور ہائیکورٹ سویوموٹو نوٹس لے کر آسیہ کی سزا ختم کریں۔ اس کے بعد بھی انہوں نے درجنوں بار یہی کچھ دہرایا۔ لبرل فاشسٹوں کی ستائشی تالیوں میں اُنہیں اندازہ ہی نہ ہوپایا کہ وہ کس راہ پر چل نکلے ہیں اور ان کا بے ڈھب رویہ پاکستانیوں کے دلوں میں کیسے چرکے لگارہا ہے۔
پاکستان میں صرف ناموس رسالت ہی کا قانون نہیں‘ یہاں تو صدر کے ناموس‘ گورنر کے ناموس‘ پاکستانی پرچم کے ناموس‘عدلیہ کے ناموس‘ فوج کے ناموس اور نہ جانے کس کس کے ناموس کے قوانین بھی موجود ہیں۔ صدر اور گورنر کے ”ناموس“ کو اتنا کڑا تحفظ دیا گیا ہے کہ وہ کچھ بھی کہہ یا کرلیں‘ انہیں عدالت میں نہیں لایا جاسکتا۔ فوج کے ناموس کی بے حرمتی‘ کے جرم میں ہی جاوید ہاشمی برسوں جیل میں سڑتا رہا۔ عدلیہ اپنے ناموس پر خراش آنے کا محاسبہ خود کرنے کی طاقت رکھتی ہے۔ کیا یہ کالا قانون نہیں کہ صدر اور گورنر‘ کسی بھی جرم کا ارتکاب کرتے رہیں اور اُنہیں کٹہرے میں نہ لایا جاسکے؟ کیا اسلامی ملک میں ایسا قانون ہونا چاہئے؟ جہاں بھانت بھانت کے ”کالے قوانین“ کی کارفرمائی ہو اور بڑے بڑے منصبدار اُن کا قوانین کو اپنے کرتوتوں کی پناہ گاہ بنائے بیٹھے ہوں‘ وہاں نہ جانے کیوں سلمان تاثیر کی نظر میں ناموس رسالت‘ ہی کا قانون کانٹے کی طرح کیوں کھٹکا اور انہوں نے پاکستانی قوم کے جذبہ و احساس کی پرواہ کئے بغیر ایک ایسی مہم اٹھائی جو کروڑوں دلوں میں گھاؤ ڈال گئی؟
اس پہلو کو بھی پیش نظر رکھنا ہوگا کہ مغرب نے نبی کریمﷺ کی حرمت و عظمت سے کھیلنے کو ایک مشغلہ بنالیا ہے۔ آئے دن کوئی نہ کوئی مکروہ واردات ہوتی رہتی ہے۔ سلمان رشدی اور تسلیم نسرین جیسے مکروہات کو انہوں نے ہیرو قرار دے کر تکریم و تعظیم کی مسندوں پر بٹھا رکھا ہے۔ ان کے سینوں پر انہوں نے تمغہ ہائے فضیلت سجا رکھے ہیں۔مسلمان اس رویے پر انگاروں پہ لوٹتے ہیں اور کچھ نہیں کرسکتے۔ اندرون ملک کسی غیر محتاط شخصیت کی طرف سے کسی ناروا عمل کا ردعمل اس لئے شدید ہوتا ہے کہ آتشکدہ پہلے ہی دہک رہا ہوتا ہے۔ اس ساری صورت حال کو مجموعی تناظرمیں دیکھنا ہوگا۔

And why wouldn’t such views and conduct prevail, why wouldn’t the killer Malik Mumtaz Qadri be treated as a hero when mainstream religious party members, such as Sahibzada Zubair of the Jamiat Ulema-e-Pakistan, categorically state on national television that Salmaan Taseer’s death was God’s verdict and nobody who loves the Prophet (PBUH) could or should condemn his murder? Or those like Maulana Fazlur Rahman, or Jamaat-e-Islami’s Farid Ahmed Paracha, who, while not out rightly stating that the murder should not be condemned, concede in no uncertain terms that the governor had injured the sentiments of thousands of Muslims in Pakistan and that this was bound to happen.
On news talk shows, even those who do not belong to the religious parties were found deliberating more on what led to Governor Taseer’s death – i.e. his speeches against the Blasphemy Law and in support of Aasiya Bibi – than the act of murder, or the manner of killing. Additionally, over 500 “religious” men maintained that Taseer’s funeral must be boycotted. Talk on Twitter has it that the Badshahi mosque imam refused to pray Taseer’s namaz-e-janaza.
The same people who were quick to criticise Taseer’s step to seek a presidential pardon for Aasiya Bibi instead of trusting the legal process and the court system are now, conveniently, promoting vigilantism. Previously there were clerics announcing head money for both Aasiya Bibi and Taseer. Now, on national television, Qadri’s intent, and not his act, is the focus of discussion, and the murder is being justified on religious grounds. The Sunni Tehreek has gone so far as to say, “We will provide legal and constitutional protection to Mumtaz Qadri.”

Let me suggest five things that would happen if Pakistan was, indeed, a functional state and society.
Instead of the emotional slogans, false tears, and petty political point-scoring that we are now seeing, here are a few things that might have happened if Pakistan was the place we all want it to be, but is not (starting from the easiest and moving to the most important):
1. The immediate culprit – Malik Mumtaz Hussain Qadri – would be immediately and swiftly (that is critical) tried in a court of law and given the full punishment under the law. Justice which is transparent, fair, and speedy should be done, and seen to be done.
2. All opportunities to turn the murderer into a public hero would be denied to him and his ‘fans.’ This means, no access to media, no opportunities to be garlanded, no occasions to shout slogans to TV cameras, etc. There are lots of simple means to do so and the media would be banned – for national sanity reasons – from reporting directly on his, running footage of him, or in any way projecting him. The purpose would be not to restrict information, but to resist misinformation on a pending case.
3. Immediate investigation would be undertaken against all who had instigated violence and murder, issued fatwas, or in any ways created the inducement or provided encouragement to commit violence against Salman Taseer or others in relation to the blasphemy issue. This would certainly include, at a minimum, those evil jokers who were publicly offering money for murder but would also include an immediate and swift investigation into those on the media who had contributed to instigation and hysteria and inflamed emotions with violent rhetoric and also those political or public figures (including so-called ‘ulemas‘) who may have directly instigated violence in the name of this issue at any public rally. These investigations would swiftly lead to arrests, trials, and full punishment under incitement to violence laws.
4. Anyone justifying murder, glorifying the murderer, or creating public incitement on this issue in the aftermath of the murder would be swiftly arrested, tried and given full punishment under the law. This could require large number of arrests to crush illegal rallies, etc., and the government would be ready to take that principled stand. This would also include full legal action against any media person using the media to justify the breaking of the law or the act of murder (for example, by arguing – directly or indirectly – that the murder of Salman Taseer was justified).
5. The government would immediately move to repeal, or at least review the Blasphemy law itself and swiftly bring needed changes to it so that its spirit is not misused or made subject to vigilantism. This would be the least that could be done to honor the memory of Salman Taseer.
None of these would be easy to do, even in a saner Pakistan. But ‘difficult’ is never an excuse not to do what is ultimately ‘right.’
I can try to push the conversation away from the inanities I hear on the TV and read in newspapers and towards a sense of what the ‘right’ thing to do would be, even if in an imaginary Pakistan.

The reason the pre partition history is important is because in the pakistani goverment board schools (not the prepie O levels A Levels or amreican schools), children are taught iqbal poetry. I went to one such school. (islamabad college for boys). we were taught in urdu lectures about iqbal poetry about ghazi imludieen and he was greatly potrayed as a hero by iqbal.
The point is, this was taught as gospel truth. Now, if you are brainwashing kids into thinking this way its hardly fair to blame them if they buy into the story.
If you are going to blame someone its either iqbal or jinnah and those who treet their words and deeds as gospel truth. Blaming a poor half educated policeman who would believe anything taught by his elders is not exactly fair.

Also the cleric Yousuf Qureshi of the Mohabat Khan Masjid, Peshawar, who at a public gathering on Dec 3, 2010 offered a Rs 500,000 reward to kill Aasia Bibi if her death sentence was not confirmed by the High Court.

Khangarh police on Tuesday arrested a man who had announced a Rs20 million prize for whoever would kill Governor Salmaan Taseer. Sardar Ebaad Dogar had made the announcement at a rally organised last Friday against proposals to amend or reform the blasphemy laws.
Talking to The Express Tribune after the rally, Dogar had said that he felt no embarrassment in making the announcement.
He had said he would raise the reward to Rs30 million if someone from Khangarh would kill Taseer.
Dogar had served as Khangarh’s district nazim on a Pakistan Muslim League-Q ticket. He was accused of association with banned organisation Sipah-i-Sahaba Pakistan before joining the PML-Q.
The police have shifted him to unidentified location and started interrogation.

A month before the governor of the Punjab, Salmaan Taseer, was lowered into an early grave, an imam at a mosque in Peshawar asked the Taliban to kill a Christian woman convicted of blasphemy, if the Pakistani state did not carry out the death sentence. Nawa-e-Waqt, the second most read Urdu-language newspaper in the country, wholeheartedly approved of the 500,000 rupee bounty that the cleric Maulana Yousuf Qureshi put on Asia Bibi’s head. Its lead editorial went on to threaten anyone, like Taseer, who supported the woman’s cause and campaigned for a repeal of the infamous blasphemy law. “The punishment handed down to Asia Bibi will be carried out in one manner or the other, and who knows whose position and rank will be terminated as a result of the debate on the repeal of the blasphemy laws,” the newspaper wrote. That was on 5 December. A month later Taseer was killed by his bodyguard, a 26-year-old policeman, Mumtaz Qadri. Neither the cleric nor the editors of the newspaper are being charged with incitement.
The celebration of Taseer’s assassination has continued ever since. Making common cause with radical Islamists, lawyers showered petals on Qadri. They surrounded the anti-terrorism court at Rawalpindi and at one point the judge refused to hear the case and police considered dropping a reference to the anti-terror act and trying Qadri in a district court. When the hearing went ahead after five hours, no public prosecutor turned up because of fears for their safety, according the report in Dawn.com. Nationally, Taseer’s death was greeted with cold-hearted intolerance from rightwing religious leaders – several of whom said he got what he deserved – and with spineless capitulation from the ruling Pakistan People’s party, of which the Punjab governor was the fifth most important member. Shortly after he visited Asia Bibi in jail with his wife and daughter, a mob rioted outside the governor’s house. Prominent TV commentators joined in. The law minister, Babar Awan, then caved in, saying there was no question of reforming the law.

گجرات / مانسہرہ (نمائندگان جنگ) گورنر پنجاب سلمان تاثیر کے قتل پر گجرات اور مانسہرہ میں جماعت اہلسنت اور تحریک تحفظ ختم نبوت نے ریلیاں نکالیں اور گورنر کو قتل کرنے والے ملک ممتاز قادری کو خراج تحسین پیش کیا۔ تفصیلات کے مطابق تحریک تحفظ ختم نبوت کے کارکنوں نے منگل کو گورنر پنجاب سلمان تاثیر کے قتل کا جشن منانے کیلئے مانسہرہ میں ایک ریلی نکالی، 100 سے زائد افراد مرکزی چوراہے پر جمع ہوگئے اور مقتول گورنر کے خلاف نعرے لگائے ۔ ریلی میں شریک افراد نے اپنے ہاتھوں میں پلے کارڈ اُٹھا کر ایبٹ آباد روڈ پر مارچ کیا اور واقعے کی خوشی مناتے ہوئے مٹھائیاں بھی تقسیم کیں۔ تحریک تحفظ ختم نبوت مانسہرہ ڈسڑکٹ کے سربراہ عبدالروٴف روفی ، سابق ناظم امجد سالار اور دیگر نے ریلی سے خطاب کرتے ہوئے کہا کہ سلمان تاثیر کو توہین آمیز کلمات کی ادائیگی کے باعث قتل کیا گیا۔ انہوں نے کہا کہ جس شخص نے گورنر کا قتل کیا وہ ایک بہترین مسلمان ہے اور مسلمانوں کو اس بہادری پر اسے انعامات سے نوازا جانا چاہئے۔ انہوں نے کہا کہ مرحوم سلمان تاثیر صیہونیوں کے ایجنٹ تھے اور ان کی لاش کو ان کے صیہونی آقاوٴں کے حوالے کر دینی چاہئے۔ جبکہ گجرات میں عالمی تنظیم اہلسنت کے صدر پیر محمد افضل قادری کی زیر قیادت ریلی نکالی گئی جس میں زبردست ہوائی فائرنگ ہوئی۔ پیر محمد افضل کا کہنا تھا کہ ملک ممتاز قاردی کو زبردست خراج تحسین پیش کرتے ہیں ، حکومت اس کیخلاف کسی قسم کی کارروائی سے باز رہے اس کا مقدمہ ہم لڑیں گے۔ انہوں نے گورنر سلمان تاثیر کے قتل پر 40 روزہ جشن منانے کا اعلان کیا۔ پیر افضل قادری نے کہا کہ گورنر پنجاب کو شہید نہیں بلکہ ملک ممتاز قادری کو غازی کے لقب سے پکارا جائے۔

توہین شانِ رسالت کی مجرمہ سے اظہار ہمدردی درست نہیں تھا ،فضل الرحمن
کراچی (جنگ نیوز) جمعیت علماء اسلام (ف) کے سربراہ مولانا فضل الرحمان نے کہا ہے کہ توہین شان رسالت کے قانون کو ”کالا قانون “ کہنا بے احتیاطی اور اس کی مجرمہ سے ہمدردی کرنا اور اُس کی رہائی کیلئے باتیں کرنا بھی اعتدال سے باہر کی صورت تھی اور ایسا کرنا درست نہیں تھا، دونوں طرف سے انتہا پسندانہ جذبات سامنے آنے سے اس طرح کے واقعات رونما ہوتے ہیں۔ اِن خیالات کا اظہار اُنہوں نے جیو نیوز کے پروگرام ”کیپٹل ٹاک“ میں میزبان حامد میر کے ساتھ گفتگو میں کیا۔ ”گورنر پنجاب کی ہلاکت کے سیاست پر کیا اثرات مرتب ہوں گے“ کے موضوع پر ہونے والے اس مباحثے میں سابق وفاقی وزیر اعظم سواتی ، مسلم لیگ (ق) کے سینئر رہنما شیخ وقاص اکرم ، سینئر تجزیہ کار اور جیو نیوز کے اینکر محمد مالک شریک ہوئے۔ پروگرام کے دوران اسلام آباد میں جیو نیوز کے بیورو چیف رانا جواد نے ملزم کے حوالے سے تفصیلات بیان کرتے ہوئے بتایا کہ ملزم نے گورنر پنجاب کو 26 گولیاں ماریں، حیران کن بات یہ ہے کہ باقی سیکورٹی گارڈز نے اُنہیں گولیاں چلانے سے نہیں روکا اور نہ ہی ملزم پر اُس وقت گولیاں چلائیں، جب گورنر زمین پر گرگئے تو ملزم کو زمین پر لٹایا اور ہاتھ باندھ کر منتقل کردیا گیا۔ ملزم 1985ءء میں پنڈی میں پیدا ہوا 2003ءء میں پولیس فورس کو جوائن کیا، 2008ءء میں ایلیٹ پولیس کی تربیت لی اور وی آئی پی ڈیوٹی پر مامور ہوا، کچھ عرصہ قبل اُس نے اپنی ڈاڑھی منڈوالی تھی اور کچھ عرصے بعد واپس رکھ لی تھی، حیران کن بات یہ ہے کہ کسی نے اس بات پر غور نہیں کیا کہ اس کی ڈیوٹی ایسے شخص کے ساتھ لگائی جارہی ہے جن کے بیانات سے مذہبی جذبات بھڑک رہے ہیں، یہ تمام باتیں بہت سے سوالات جنم دیتی ہیں۔ پولیس کو دیئے جانے والے بیان میں ملزم نے کہا ہے کہ 3 دِن قبل اُس نے گورنر کو قتل کرنے کا ارادہ کرلیا تھا جس سے ظاہر ہوتا ہے کہ اس کے پاس گورنر کی موومنٹ کا 3 دِن قبل ہی پلان موجود تھا۔ سعودی عرب میں موجود مولانا فضل الرحمان نے ٹیلیفون پر گفتگو کرتے ہوئے مزید کہا کہ ملک میں قانون اور عدالتیں موجود ہیں ، یہ تمام باتیں اُسی کو تفویض ہونی چاہئیں لہٰذا ایسے واقعات کی پہلے بھی مذمت کی اور آج بھی کرتے ہیں جبکہ رحمان ملک اپنے بیان میں کہہ چکے ہیں کہ یہ توہین شان رسالت کے قانون کو کالا قانون کہنے کا ردِعمل ہوسکتا ہے۔ نوازشریف کی پریس کانفرنس کے حوالے سے اُن کا کہنا تھا کہ نوازشریف نے جو بیان دیا ہے وہ عوامی دباؤ سے نکلنے کی کوشش ہے اور موجود ہ الٹی میٹم ہم آہنگی کے تحت لگتا ہے ۔ اُنہوں نے کہا کہ توہین شان رسالت کے احتجاج کے حوالے سے کمیٹی تشکیل دی گئی ہے جس کے سربراہ ڈاکٹر ابوالخیر ہیں اور آنے والے دِنوں میں احتجاج کرنے یا نہ کرنے کا فیصلہ وہی کریں گے تاہم گورنر کے قتل کے بعد جو نئی صورتحال پیدا ہوئی ہے اس حوالے سے مختلف جماعتوں کے ذمہ داران کو ملکر فیصلہ کرنا ہوگا۔ اعظم سواتی نے کہا کہ پیپلزپارٹی کے قائدین کیلئے موجودہ وقت انتہائی تکلیف دہ ہے، کسی بھی انسان کا قتل افسوسناک ہے، اسلامی نظریات کونسل کو فعال نہیں کیا گیا جس کی وجہ سے اس طرح کا واقعہ رونما ہوا۔ شیخ وقاص اکرم نے کہا کہ آج ہم کتنی ہی تنقید کرلیں گورنر پنجاب کو قتل کرنے والا شخص کل قوم کا ہیرو بن کر نکلے گا اور جمعے کے خطبات میں اس کی تعریفیں کی جائیں گی، شان رسالت میں توہین کرنے والے کے سامنے مسلمانوں کے جذبات کی حد ختم ہو جاتی ہے۔ جس معاشرے میں ہم رہتے ہیں اس میں واضح ہے کہ توہین شان رسالت کا جو مرتکب ہوگا وہ مارا جائے گا، اُس کا بچنا ہمارے معاشرے میں مشکل ہے۔ اُنہوں نے کہا کہ حیران ہیں کا لعدم جماعتوں کے لوگ سیکورٹی اداروں میں کس طرح ضم ہو چکے ہیں۔اُنہوں نے کہا کہ ملک میں تمام شخصیات ہٹ لسٹ پر ہیں ۔ محمد مالک نے کہا کہ گورنر کے قتل کیلئے کسی مستند عالم نے فتویٰ نہیں دیا، لیکن جب فتوے آرہے تھے تو کسی مستند عالم نے اس کی مذمت بھی نہیں کی، اب ڈر ہے کہ شیری رحمان کو بھی قتل نہ کردیا جائے ۔ پورے ملک میں ایک جنونی کیفیت طاری ہے ،ہم توہین شان رسالت اور توہین شان رسالت کے قانون میں فرق نہیں کر پارہے، یہ قانون انسان کا بنایا ہوا ہے جس پر دو آراء ہوسکتی ہیں

کراچی (پ ر) جماعت اہلسنت پاکستان کے مرکزی امیر پروفیسر سید مظہر سعید شاہ کاظمی، علامہ سید ریاض حسین شاہ، علامہ سید شاہ تراب الحق قادری، علامہ ضمیر ساجد، پیر خالد سلطان، پیر غلام صدیق نقشبندی، علامہ سید خضر حسین شاہ، الحاج امجد چشتی، علامہ غلام سرور ہزاروی، علامہ سید شمس الدین بخاری، پیر سید عاشق علی شاہ جیلانی، مفتی محمد اقبال چشتی، علامہ فضل جمیل رضوی، آغا محمد ابراہیم نقشبندی مجددی، مولانا محمد ریاض قادری، مولانا گلزار نعیمی، علامہ سید غلام یٰسین شاہ اور جماعت اہلسنت سے وابستہ پانچ سو سے زائد علماء ومفتیان کرام نے گورنر پنجاب سلمان تاثیر کی عبرتناک موت پر اپنے مشترکہ بیان میں مسلمانوں کو ہدایت کی ہے کہ نہ کوئی اس کی نماز جنازہ پڑھے نہ پڑھانے کی کوشش کرے اور گورنر کی ہلاکت پر کسی قسم کے افسوس یا ہمدردی کا اظہار ہرگز نہ کیا جائے۔ گستاخ رسول کا حمایتی بھی گستاخ ہے۔ قائدین علماء اہلسنت نے کہاکہ گورنر کو ہلاک کرنے والے عاشقِ رسول غازی ملک ممتاز حسین قادری کی جرأت، بہادری ایمانی غیرت ودینی حمیت کو زبردست خراج تحسین پیش کرتے ہوئے کہاکہ اس جانباز نے امت کی چودہ سو سالہ روایت کو باقی رکھا اور دنیا کے ڈیڑھ ارب مسلمانوں کا سر فخر سے بلند کر دیا۔ قائدین وعلماء اہلسنت نے کہاکہ قانون ناموس رسالت کی مخالفت اور گستاخان رسول کی حمایت کرنے والے وزراء سیاستدان، نام نہاد دانشور، اینکر پرسن ودیگر گورنر پنجاب کی موت سے عبرت حاصل کریں۔ قائدین وعلماء اہلسنت نے کہاکہ کتاب وسنت، اجماع امت اور تصریحات آئمہ کے مطابق توہین رسول کی سزا صرف قتل ہے اور توہین کی نیت کے بغیر بھی حضور کی شان میں توہین کا کلمہ کہنا کفر ہے۔ اس مسئلے پر عہد نبوی اور عہد صحابہ سے لیکر آج تک سب علماء امت اور اہل فتویٰ کا اجماع ہے۔ خلفائے راشدین کے دور میں گستاخان نبی قتل کئے جاتے رہے بلکہ غلاف کعبہ سے لپٹے ہوئے توہین رسول کے مرتکب مرتد کو مسجد حرام میں قتل کرنے کا حکم رسول اللہ نے دیا اور حضرت عمر نے رسول اللہ کا فیصلہ نہ ماننے والے ایک مناقق مسلمان کا اپنی تلوار سے سر کاٹ دیا تھا۔ حضور نبی کریمﷺ کو حق تھا کہ وہ اپنے گستاخ کو معاف فرما دیں لیکن امت کیلئے جائز نہیں کہ وہ حضور اکرمﷺ کے گستاخ کو معاف کردے۔ قائدین وعلماء اہلسنت نے کہاکہ پچھلی چودہ صدیوں میں صرف ایک سو افراد کو گستاخی رسول پر قتل کیا گیا جس سے ظاہر ہوتا ہے کہ بغیر ثبوت کے کسی کی بلاوجہ جان نہیں لی گئی۔ قانون ناموس رسالت کی مخالفت کرنے والے کفر کا ارتکاب کر رہے ہیں انہیں توبہ اور تجدید ایمانی کرنی چاہئے نیز حکمران قانون ناموس رسالت میں ترمیم نہ کرنے کا اعلان کر کے اپنے ایمان بچائیں

Some Mullah websites are now once again spinning old lies about Jinnah vis a vis the Ilamdin case. They say if you do not counter a lie, it becomes the truth but I will come to that in a second. First let us review what Jinnah, as a member of the select committee, had to say when 295-A came up for the discussion in the Indian Legislative Assembly. 295-A was discussed and enacted in response to Rajpal case. Bear in mind 295-A is a much more lenient law than 295-B and 295-C. This is what Jinnah had to say:
“We must also secure this very important and fundamental principle that those who are engaged in historical works, those who are engaged in the ascertainment of truth and those who are engaged in bona fide and honest criticisms of a religion shall be protected.”
In other words the founding father of the nation was asking for a right to criticise religion and ascertain the truth. This is much more than what Salman Taseer said and was killed for.
Now coming to the scurrilous lie about Jinnah, I wrote an article which was reproduced on PTH in the past as well but which requires repetition and therefore I am reproducing it below. Jinnah was not the trial lawyer. He did not ask Ilamdin to change his plea. Contrary to the myth Ilamdin always claimed he was innocent and wrongly framed!!! Nor did Jinnah do the case without a fee as it was alleged. The only case that Jinnah did for free in his career was for Bal Gangadhar Tilak.
For Jinnah Ilamdin case was a question of best defense for his client. Bear in mind as a lawyer Jinnah also defended the murderer Sardar Anandrao Gangaram Phanse who was a co-conspirator in the murder of Abdul Kadar Bawla and attempted murder of his companion dancing girl the “Hur of Indore” Mumtaz in the famous Bawla Murder Trial. Jinnah had managed – in the words of H M Seervai- to get the death sentence changed to life sentence. Does that mean we should allow murder in society as well- well because Jinnah defended a murderer? Would Jinnah the legislator, Jinnah the statesman agree with that proposition?
The Lahore-based-Hindi newspaper Pratap said that taking the case would lower Jinnah’s prestige in the eyes of Hindus. In retrospect it has much more damage to Jinnah’s own ideas of what Pakistan should be as the uneducated and semi-literate fools have made a mockery of the Quaid-e-Azam in Pakistan.

VIEW: The Ilam Din fiasco and lies about Jinnah —Yasser Latif Hamdani
In the recent debate over the blasphemy law, a group of Jamaat-e-Islami-backed right-wing authors have come up with an extraordinary lie. It is extraordinary because it calls into question the professional integrity of the one man in South Asian history who has been described as incorruptible and honest to the bone by even his most vociferous critics and fiercest rivals, i.e. Mohammad Ali Jinnah. The lie goes something like this: ‘Ghazi’ Ilam Din ‘Shaheed’ killed blasphemer Hindu Raj Pal and was represented by Quaid-e-Azam at the trial who advised him to deny his involvement in the murder. ‘Ghazi’ and ‘Shaheed’ Ilam Din refused and said that he would never lie about the fact that he killed Raja Pal. Quaid-e-Azam lost the case and Ilam Din was hanged.
To start with, the story is entirely wrong. First of all, Jinnah was not the trial lawyer. Second, Ilam Din had entered the not guilty plea through his trial lawyer who was a lawyer from Lahore named Farrukh Hussain. The trial court ruled against Ilam Din. The trial lawyer appealed in the Lahore High Court and got Jinnah to appear as the lawyer in appeal. So there is no way Jinnah could have influenced Ilam Din to change his plea when the plea was already entered at the trial court level. Nor was Ilam Din exactly the ‘matchless warrior’ that Iqbal declared him to be — while simultaneously refusing to lead his funeral prayers. Indeed Ilam Din later filed a mercy petition to the King Emperor asking for a pardon.
The relevant case — in which Jinnah appeared — cited as Ilam Din vs. Emperor AIR 1930 Lahore 157 — makes interesting reading. It was a division bench judgement with Justice Broadway and Justice Johnstone presiding. Jinnah’s contention was that the evidence produced before the trial court was insufficient and the prosecution story was dubious. To quote the judgement, “He urged that Kidar Nath was not a reliable witness because (1) he was an employee of the deceased and, therefore, interested. (2) He had not stated in the First Information Report (a) that Bhagat Ram (the other witness) was with him, and (b) that the appellant had stated that he had avenged the Prophet. As to Bhagat Ram it was contended he, as an employee, was interested, and as to the rest that there were variations in some of the details.”
The court rejected this contention. The judgement continues that “Mr Jinnah finally contended that the sentence of death was not called for and urged as extenuating circumstances, that the appellant is only 19 or 20 years of age and that his act was prompted by feelings of veneration for the founder of his religion and anger at one who had scurrilously attacked him.” The court rejected this contention as well referring to Amir vs. Emperor, which was the same court’s decision a few years earlier. Interestingly, the curious reference to 19 or 20 years deserves some attention. Why did Jinnah as one of the leading lawyers refer specifically to an argument that had been exploded by the same court only two years earlier? That only Mr Jinnah can answer and I do not wish to speculate. Perhaps he was trying to argue what Clarence Darrow had argued successfully a few years ago in the famous Leopold and Loeb case involving two 19-year old college students who had committed the ‘perfect crime’. Clarence Darrow’s defence converted a death sentence to a life sentence.
Another corollary of the argument forwarded by our right-wing commentators is that since Jinnah defended Ilam Din in this murder trial, he favoured the ‘death sentence for blasphemy’. It is an odd derivative even for average intellects that most Pakistani ultra-rightwingers and Islamists possess. First of all, it is quite clear that Jinnah did not defend the actions of Ilam Din. He had attacked the evidence on legal grounds. Second, it is clear that there was no confession and Jinnah did not ask Ilam Din to change his plea. Third, when the court rejected Jinnah’s contentions, Jinnah’s argument was simply that a death sentence was too harsh for a man of 19 or 20, with the obvious implication that sentence should be changed to life imprisonment.
We can only conjecture as to what Jinnah’s reasons as a lawyer and politician to agree to be the lawyer for the appellant before the high court were. In any event, a lawyer’s duty is to accord an accused the best possible defence. Just because a lawyer agrees to defend an accused does not mean that the lawyer concurs with the crime. One is reminded of the famous Boston Massacre in 1770 when British soldiers opened fire and killed five civilians who were protesting against them. The British soldiers hired John Adams as a lawyer, who got five of the accused acquitted, arguing that a sentry’s post is his castle. Does that mean that John Adams was in favour of British rule in the US? If so, it is rather ironic that he was the prime mover and the guiding spirit behind the American declaration of independence. Similarly, when Clarence Darrow defended Leopold and Loeb, was he in any way suggesting that the crime that those two young men had committed was justified?
Jinnah’s record as a legislator tells us a different story altogether. He was an indefatigable defender of civil liberties. He stood for Bhagat Singh’s freedom and condemned the British government in the harshest language when no one else would. In the debate on 295-A of the Indian Penal Code, a much more sane and reasonable law than our 295-B and 295-C, Jinnah had sounded a warning against the misuse of such laws in curbing academic freedoms and bona fide criticisms. I have quoted that statement in my previous two articles.
There cannot be any question that Jinnah the legislator would have balked at the idea that his defence of a murder convict is now being used by some people to justify a law that is ten times more oppressive and draconian than the one he had cautioned against. To this day, I have only found him alone to have had the courage to state in the Assembly on September 11, 1929: “If my constituency is so backward as to disapprove of a measure like this then I say, the clearest duty on my part would be to say to my constituency, ‘you had better ask somebody else to represent you’.”

The problem with Pakistan (the way I see it) is not of religious extremism – which is not a mainstream phenomenon anywhere. It is very much a problem of lousy administration – the state is not doing its job – and the fringe elements are allowed to run amuck without any fear of repercussions. The politicos are weak-kneed, of course, but the real crime is of the khakis who have – over the long haul – emasculated the political system for their own selfish ends. They need to stop playing the role of amused spectators and come firmly on the side of the civilian government and help restore law and order – in no uncertain terms.

گورنر پنجاب سلمان تاثیر کے قتل کے الزام میں گرفتار ممتاز قادری کے خلاف عدالتی کارروائی راولپنڈی کی انسداد دہشت گردی کی ایک عدالت میں جاری ہے۔ لیکن عدالت میں ملزم کی پیشی کے دوران جو مناظر دیکھے گئے، جس طرح سے بعض وکلاء اور دیگر افراد نے ان کا استقبال کیا اس بارے میں ایک بحث چل رہی ہے۔

گورنر پنجاب کے قتل کے بعد پاکستانی معاشرے میں بعض لوگوں کے لیے جو قابل حیرت رجحانات سامنے آئے ان میں ایک ملزم ممتاز قادری کا عدالتی پیشی کے وقت بعض وکلاء کی جانب سے خیرمقدم اور اس کا مقدمہ لڑنے کے لیے فریق بنے کا اعلان ہے۔ بعض لوگوں کے خیال میں ایک انسان کے قتل کے ملزم کا اس طرح کا استقبال نہیں ہونا چاہیے تھا جبکہ دوسری جانب اس استقبال کو کئی مبصرین اس معاشرے میں پائے جانے والے رحجانات کی عکاسی بھی قرار دیتے ہیں۔
انہیں وکلاء نے کچھ عرصہ قبل پاکستان میں آئین اور قانون کی حکمرانی کے لیے ایک غیرمعمولی تحریک چلائی تھی لیکن آج اس تحریک کے اکثر سرکردہ رہنماؤں نے اس پر بات کرنے سے انکار کر دیا یا بعض سے رابطہ نہیں ہو سکا۔ صورتحال کا جائزہ لینے کے لیے تاہم سب سے پہلے ممتاز قادری کے وکیل اور راولپنڈی بار ایسوسی ایشن کے صدر وحید انجم سے بات کی اور اس مقدمے کا دفاع کرنے کے فیصلے کی وجہ جانا چاہی۔
ان کا اصرار تھا کہ وکلاء نے متحد ہو کر یہ قرارداد منظور کی تھی کہ بار کو اس کیس کا دفاع کرنا چاہیئے۔ ’چونکہ میں بار کا صدر ہوں اس لیے میں وکیل ہوں ان کا۔‘
کوئی اس کو ملزم جبکہ کوئی اسے ہیرو سمجھتا ہے۔ کوئی اُس پر پھول پھینکتا ہے تو یہ اس کے اپنی عقیدت ہے، کوئی اسے ہتھکڑیاں لگا کر بجلی کا کرنٹ لگاتا ہے تو وہ بھی اس کا اپنا اختیار ہے۔ میں کیا کہہ سکتا ہوں

ایک سوال کے جواب میں کہ اس نے تو بقول حکومت اقبالِ جرم کیا ہے، وحید انجم نے واضح کیا کہ اقبالِ جرم وہ ہوتا ہے جو کسی ایسی عدالت میں جو اس اقبالِ جرم کو ریکارڈ کرنے کی اہل ہو، اس کے سامنے کھڑا ہو کر اقبالِ جرم کیا جائے، اور وہ پولیس کی حراست میں نہ ہو، آزاد ہو، اس کو ہتھکڑیاں نہ لگی ہوں تب وہ بیان دے اور اس پر چارج لگے۔ ’پولیس اگر کہہ دے کہ فلاں قاتل ہے اور فلاں نے ہمیں کہہ دیا ہے، تو درست نہیں ہے۔‘
وکلاء کی جانب سے گل پاشی کے بارے میں ان کا کہنا تھا کہ یہ تو ہر آدمی کا حق ہے کہ وہ اس جو چاہے سمجھے۔ ’کوئی اس کو ملزم جبکہ کوئی اسے ہیرو سمجھتا ہے۔ کوئی اُس پر پھول پھینکتا ہے تو یہ اس کے اپنی عقیدت ہے، کوئی اسے ہتھکڑیاں لگا کر بجلی کا کرنٹ لگاتا ہے تو وہ بھی اس کا اپنا اختیار ہے۔ میں کیا کہہ سکتا ہوں۔‘

Imran Khan links Blasphemy laws to War on Terror
Khan suggested that all political parties need to collectively take a decision on Pakistan’s ongoing role in the war on terror.
ISLAMABAD: Pakistan Tehreek e Insaaf (PTI) chief, Imran Khan has said that there is a “sound reason” for the blasphemy laws legislature, and the real reason for rising terrorism being witnessed across Pakistan is actually the US-led War on Terror.
Speaking to the media today (Sunday), Khan said that, “The War on Terror is the root cause for the increase in terrorism, injustice and intolerance… some people will feel that Islam is under threat, and to save Islam people will start sacrificing themselves more.”
Justifying the existence of the blasphemy laws, Khan further said that, “Even England has the blasphemy law and there is a sound reason for this… Allama Iqbal proposed a bill in the 1920′s Punjab legislative assemblies, which provides punishment for anything being said against any religious personality.”

Rally leader Qari Ahsaan, from the banned Islamist group Jamaat ud Dawa, addressed the crowd from a stage.
“We can’t compromise on the blasphemy law. It’s a divine law and nobody can change it,” Ahsaan told the masses.
“Our belief in the sanctity of our prophet is firm and uncompromising and we cannot tolerate anyone who blasphemes. Whoever blasphemes will face the same fate as Salman Taseer,” 40-year-old labourer Abdul Rehman told AFP at the rally.
JUI-F chief Maulana Fazalur Rehman has alleged that attempts at amending the blaphemy law are part of a foreign agenda. He cautioned the government to refrain from acting against the will of the masses.
Addressing a public gathering in Karachi, the JUI Chief said the government should carefully weigh its steps if it considers making any changes in the blasphemy law. He added that no Muslim would ever be willing to allow the government to bring any change to this law.
More than 40,000 people rallied in Karachi on Sunday, police said, against the controversial reform of a blasphemy law that was behind the killing of a senior politician.
Religious groups blocked a main thoroughfare in Karachi’s teeming metropolis holding banners in support of the police commando who shot dead Punjab governor Salman Taseer on Tuesday over his views in favour of the law’s amendment.
Taseer had called for reform of the blasphemy law that was recently used to sentence a Christian woman to death. But his outspoken liberal stance offended the country’s increasingly powerful conservative religious base.
“Mumtaz Qadri is not a murderer, he is a hero,” said one banner in the national Urdu language in support of the man who carried out Pakistan’s most high-profile political killing in three years.
“We salute the courage of Qadri,” said another.
“There are at least 40,000 people here,” senior police official Mohammad Ashfaq told AFP, watching over a sea of protesters bellowing slogans in favour of “jihad” and waving the flags of religious parties.

We published two photo galleries on BBC’s Urdu website last Friday. One on the Jamaat-e-Islami’s youth wing Shabab-e-Milli’s tribute to Mumtaz Qadri’s father in Rawalpindi and the other on the candlelit vigil in Lahore in memory of the slain Punjab governor Salmaan Taseer.
As expected, comments started to pour in almost instantly. The most telling among them simply said: “Please compare the crowd in the two, for every Taseer mourner, there are at least 50 Qadri supporters.” If nothing else, it says a lot about the state of siege in which liberal opinion finds itself, as more and more people flock behind Mr Qadri, a cold-blooded killer who had been painstakingly planning Taseer’s murder for weeks before he struck.
Irrespective of the number of people who gathered for the vigil in Lahore, I am stunned at their courage in standing up to a crazed mob that neither understands its religion nor the man who brought it to them. It is a mob of moral cheats that has become religiously, politically, intellectually and morally so bankrupt that it seems to have convinced itself that its only salvation lies in baying for innocent blood.
Let us give ourselves some idea of how courageous the dozens who flocked to the vigil in Lahore really are. Since the glowing tribute paid to Qadri by lawyers at his first court appearance, we have been trying to contact the lawyer leadership that spearheaded the civil society movement only three years ago to bring down General Musharraf’s dictatorship. In that movement, millions around the world saw the seeds of a politics that Pakistan has desperately been waiting for all its life — a politics that flows from the combined intellect of the mobile middle class instead of dynastic politics, hereditary constituencies and endemic corruption.
Justice (retd) Wajihuddin Ahmed, Aitzaz Ahsan, Ali Ahmed Kurd and Justice (retd) Tariq Mahmood became household names as tens of thousands of people rallied behind them wherever they went. For weeks, no political talk show in the country was considered complete without at least one of them in the chair. Since Taseer’s murder, they simply seemed to have vanished into thin air.
We finally managed to get through to two of them: one simply said that we are free to call him a coward if we want to but he doesn’t want to comment on the issue at all. The other one went even further: he said he would not even allow us to report that he was contacted for his opinion on the issue.
Predictably, Asma Jahangir was the honourable exception who not only spoke in detail about the atrocity against Taseer but was candid and unambiguous in her criticism of the legal fraternity’s sudden gush for a killer. But then, one has always known her to be one of the bravest women in the country.
Which brings to mind another brave woman who dared to bring a bill to the National Assembly aimed at amending some of the more draconian provisions of a law that has spawned nothing but injustice in the quarter century of its existence. Our crazed mob has distributed pamphlets advocating that she must meet the same fate as Mr Taseer. I am proud to have worked for her at Herald for six years. She was one of the bravest editors I know. Today, she has been forced into abandoning her public life by the tyranny of bloodthirsty criminals masquerading as religious zealots.

مسئلہ توہین رسالت… کس سے منصفی چاہیں… انصار عباسی
گورنر پنجاب سلمان تاثیر کے قتل کو پاکستان میں موجود ایک مغرب زدہ سیکولر طبقہ اپنے مذموم مقاصد کے لیے استعمال کررہا ہے تاکہ قانون ناموس رسالت کو ختم کیا جاسکے۔ ایک انگریزی اخبارنے تو اس قانون کو ہی سلمان تاثیر کے قتل کا ذمّہ دار ٹھہرا دیا۔ موم بتیاں جلا کر مقتول کو خراج تحسین پیش کرنے والے روشن خیالی کے عَلم بردار قانون ناموس رسالت کو انسانوں کا بنایا ہوا قانون کہہ کرجھٹلانے کی کوشش میں ہیں جیسا کہ وہ دوسرے اسلامی قوانین اوردینی شعائر پر مکمل عمل پیرا ہوں۔ قارئین کی رہنمائی کے لیے اس قانون کی شرعی حیثیت کے متعلق محترم علامہ ابتسام الٰہی ظہیر نے اپنے خیالات کا اظہار اس طرح کیا:
” توہین رسالت کی سزا پاکستان کے قانون کے مطابق قتل ہے۔کیا یہ سزا قرآن و سنّت سے ثابت ہے؟ اس حوالے سے ایک نئی بحث اس وقت سامنے آئی جب آسیہ نامی عورت کو ڈسٹرکٹ کورٹ ننکانہ نے توہین رسالت کے جرم میں مجرم قرار دیا۔ اس واقعہ کے کافی عرصے کے بعد پنجاب کے مقتول گورنر سلمان تاثیر ڈسٹرکٹ جیل ننکانہ میں گئے جہاں انہوں نے آسیہ سے ملاقات کی اور ملاقات کے بعد عدالتی فیصلے کو غلط قرار دیا اور قانون توہین رسالت کو کالا قانون قرار دیا۔انہوں نے آسیہ کی معافی کی اپیل کو صدر پاکستان تک پہنچانے کے عزم کا بھی اظہار کیا۔بعض علماء نے رسول ﷺکو رحمة اللعالمین قرار دے کر عام معافی کے فلسفے کو پروموٹ کرنے کی کوشش بھی کی اور دانستہ یا نادانستہ گورنر کی رائے کو بھی تقویت دینے کی کوشش کی۔
رسول ﷺکی عزّت و ناموس مسلمانوں کیلئے دنیا کے تمام رشتوں اور مال و متاع سے زیادہ اہم ہونی چاہئے اور قرآن مجید نے رسولﷺ کی مخالفت کرنے والے شخص کی بہت شدید انداز میں مذمّت کی ہے۔سورة مجادلہ کی آیت نمبر20 میں اللہ نے فرمایا ہے۔ترجمہ”یقیناً جو لوگ اللہ اور اس کے رسول کی مخالفت کرتے ہیں وہی ذلیل ترین لوگ ہیں“۔
اسی طرح اللہ نے سورة کوثر کی آخری آیت میں ارشاد فرمایا ہے۔ترجمہ”یقیناً تمہارا دشمن ہی جڑ کٹا ہے“۔
جہاں تک تعلق ہے توہین رسالت کی سزا کا تو میں سب سے پہلے اس بات کو واضح کرنا چاہتا ہوں کہ یہ مسئلہ اجتہادی نوعیت کا نہیں بلکہ قرآن و سنّت کی نصوص سے ثابت یا واضح ہے۔قرآن کی متعدد آیات سے یہی ثابت ہوتا ہے کہ حضورﷺکے گستاخ کی سزاقتل ہے۔
سنن ابوداؤد اور نسائی شریف میں ایک نابینا صحابی کا واقعہ موجود ہے جنہوں نے اپنے دو بیٹوں کی ماں اور خدمت گزار لونڈی کو صرف توہین رسالت کے جرم کی پاداش میں قتل کر دیا تھا۔نابینا صحابی اس کو تنبیہ کرتے رہے جب وہ باز نہ آئی تو انہوں نے گھریلو سطح پر کی جانے والی گستاخی کو بھی برداشت نہ کیا اور اس کا پیٹ چاک کر دیا۔معاملہ جب نبیﷺ کی بارگاہ میں پیش ہوا تو آپﷺ نے کہا گواہ رہو اس خون کا کوئی تاوان اور بدلہ نہیں ہے۔
اسی طرح ایک اور ملعونہ اسماء بنت مروان کو عمیر ابن عدی نے توہین رسالت کے جرم میں قتل کیا تھا۔
فتح مکہ کے روز جبکہ رسولﷺ عفو ودرگزر کے مقام بلند پر فائز تھے اور ہر کسی کو معاف کر رہے تھے، آپﷺ نے توہین آمیز شاعری لکھنے کی پاداش میں عبداللہ بن خطل اور اس کی غلیظ شاعری کو پڑھنے والی اس کی لونڈیوں کے قتل کا حکم جاری کیا۔عبداللہ بن خطل کو اس حالت میں قتل کیا گیا کہ وہ حرم شریف میں پناہ گزین تھا۔
یہیں ایک اور سوال بھی اٹھایا جاتا ہے کہ کیا توبہ سے توہین کا جرم معاف ہو سکتا ہے؟یقیناً سچی توبہ انسان کے اُخروی فائدہ کا سبب بن سکتی ہے لیکن دیگر جرائم کی طرح جب معاملہ عدالتی یا عوامی سطح پر آجائے گا تو دنیا میں اس کو اس جرم کی سزا سہنا ہی پڑے گی، جس طرح سچی یا جھوٹی توبہ سے زنا،قذف،چوری،شراب اور قتل کی سزا معاف نہیں ہو سکتی تو ان سے کہیں زیادہ سنگین جرم کی سزا فقط توبہ سے کس طرح معاف ہو سکتی ہے؟

LAHORE: A Tahaffuz Namoos-i-Risalat conference held in the city on Sunday warned against public rallies and demonstrations praising Governor Salmaan Taseer or protesting his killing. A Mumtaz Qadri, speakers threatened, would be at every corner of the country to stop such displays of solidarity, a reference to the police guard who has confessed to killing the governor.
Maulana Nawaz Kharal, a spokesperson for the Sunni Ittehad Council (SIC), led the chorus while addressing the conference held at Aiwan-i-Iqbal. Kharal also said there should be no protest against Qadri and added, “Don’t associate Mumtaz with any terrorist group. He is a true lover of the Holy Prophet (pbuh).” He said his Sunni followers protect Qadri and his family with their lives.
SIC chairman Fazle Karim too condemned protests in favour of Salmaan Taseer. Karim said the NGOs protesting the governors’ death had never held any protest against the killings at Sunni gatherings after the attacks at Jamia Naeemia, Nishtar Park in Karachi, Data Darbar, shrines of Abdullah Shah Ghazi and Farid Ganj Shakar. He said they had not even raised a voice against the ban on the veil imposed in France. He said his followers would continue “the mission of Ghazi Ilamudin Shaheed.” He said the Sunni Tehrik would provide legal assistance to Qadri.
Dr Muhammad Ashraf Asif Jalali, founder of Idara Sirat-i-Mustaqeem Pakistan, announced the Ghazi Ilmudin Award for Qadri. He said that his group would lay a wreath on Ilmudin’s grave on Qadri’s behalf on January 15. He also said that it would hold a rally on January 19 from Lahore to Qadri’s residence in Rawalpindi.
Jalali then demanded that the government release Qadri as soon as possible and exonerate him from the charge of murder. He said the punishment for a blasphemer against the Holy Prophet (pbuh) was death. He claimed that the inclusion of Section 295-C in the Pakistan Penal Code had brought good luck for the country. He went on to say that all participants in Taseer’s funeral had jeopardised their Islamic faith. He said their participation in the prayers had put a question mark on their commitment to the community of the faithful.
The participants of the conference included Justice (retd) Nazeer Akhtar, former judge Nazeer Ghazi, Pir Sayed Karamat Ali and Dr Raghib Naeemi. After the conference ended, a group of SIC activists headed to the Governor’s House gate on The Mall on a van and chanted slogans in support of Qadri.Earlier, nearly 300 Sunni Tehrik activists had held a protest rally in front of the Lahore Press Club demanding Qadri’s immediate release. Participants of the rally also chanted slogans against the protestors in favour of Taseer.
In the only civil society rally after Taseer’s assassination on January 4, the participants had condemned the murder which they said was a result of religious extremism.

The Tahaffuz Namoos-i-Risalat Mahaz (TNRM) observed Friday as the Tahaffuz Namoos-i-Risalat Day.
In a sermon given at Jamia Masjid Rasulia Sherazia, TNRM president Raza-i-Mustafa Naqshbandi said there could be no compromise about the honour of the Holy Prophet (pbuh). He commended Mumtaz Qadri, Taseer’s confessed assassin, saying that the self-submission had been an act of bravery.
Jamatud Dawa leader Maulana Muhammad Hussnain Siddiqi, who led the Friday prayer at Masjid Qadsia, said the government should seek a quick endorsement of Aasia’s conviction from the Lahore High Court. He said whoever dared support a ‘blasphemer’ would meet the same fate as Taseer.
Human Rights Commission of Pakistan (HRCP) chairman Dr Mehdi Hasan said it was lamentable that there were people ‘celebrating’ a death. He invoked a Punjabi wisdom ‘dushman maray tay khushi na kariay, sajnan vi mar jana’ (don’t celebrate the death of an enemy, as your friends, too, will die), and said that if nothing else they should have considered the pain they would cause to the bereaved family.
“More than ninety five per cent of Pakistan’s population is Muslim,” Dr Hasan said, “Why is then a movement or campaign to protect the honour of the Holy Prophet (pbuh) needed. No one can dare commit blasphemy here.”

KARACHI: Tahaffuz Namoos-e-Risalat, an alliance of religious parties, took out a big rally here on Sunday pressurising the government not to touch the blasphemy law, abolish the committee set up to review the law and withdraw the proposed amendment in the blasphemy bill from the National Assembly.
Hundreds of thousands of people participated in the rally taken out from Numaish Chowrangi to Tibet Centre. Protesters, carrying placards and banners, raised slogans against the United States and the government.
Tahaffuz Namoos-e-Risalat convener and Jamiat Ulema-e-Pakistan chief Dr Abul Khair Muhammad Zubair said that it was a matter of great concern that the present government had tabled a bill to amend the blasphemy law.
Dr Khair gave a deadline of January 30 to the government to dissolve the committee formed to review the blasphemy law, otherwise the next Tahaffuz Namoos-e-Risalat march would be organised in Lahore on Jan 30.
Ameer Jamaat-e-Islami Syed Munawar Hasan said that rulers were intending to amend the blasphemy law on the directives of their Western idols.
He asked Muttahida Qaumi Movement chief Altaf Hussain and Punjab Chief Minister Mian Nawaz Sharif to come forward and take a stand in favour of blasphemy law because it is the matter of belief and religion of each Muslim.
Munawar demanded of Prime Minister Yousaf Raza Gilani to withdraw the bill tabled to amend the blasphemy law.
Jamiat Ulema-e-Islam chief Maulana Fazalur Reham said that the nation would not allow anyone to amend the blasphemy law.
He vowed that the Western agenda would not be allowed in the holy country of Pakistan, which came into being in the name of Allah and Prophet (PBUH).
He alleged that the government was expressing extremism in its struggle against the blasphemy law. It would have to drop its intention in this regard, he warned.
US Congress Requests Revoking Visas For Qadri Supporters

In a letter to US Secretary of State Hillary Clinton on Thursday four American Members of Congress requested the US government to revoke visas to anyone supporting Mumtaz Qadri.
A copy of the letter which has been received by email terms the assassination of Salmaan Taseer “an unspeakable tragedy” and “heinous crime”.
We have now become aware that some of the most prominent clerics, journalists and lawyers who have praised Taseer’s death and have demonstrated support of his murderer, are people who frequently travel to the United States and hold American visas. We urge you to identify those Pakistani citizens that have shown demonstrable support of the assassination of Governor Taseer. We further request that visas not be issued to such people and that applications for new visas from those who have endorsed this heinous crime be denied.
The letter states that “it is imperative that we show our dedication to peace and not further violence” and requests the US State Department to increase diplomatic efforts and investment to support growth of democracy and tolerance in Pakistan.
The letter is signed by two Republicans and two Democrats in the US Congress: Steve Israel, Gary Ackerman, Peter King and Michael McCaul.

US lawmakers seek visa ban for Qadri supporters
WASHINGTON, Jan 18: Four US Congressmen have asked Secretary of State Hillary Clinton to refuse visas to those who praised the assassination of Punjab Governor Salmaan Taseer and showed support for his assassin Mumtaz Qadri.
In a letter sent to Secretary Clinton, Congressmen Gary Ackerman, Steve Israel, Peter King and Michael McCaul said: “Some of the most prominent clerics, journalists and lawyers who have praised Mr Taseer`s death and have demonstrated support of his murderer, are people who frequently travel to the US and hold American visas.
“We urge you to identify those Pakistani citizens that have shown demonstrable support of the assassination of Governor Taseer.

After Governor Taseer`s assassination, thousands of supporters of extremist groups, including Jamaat-ud-Dawah, held rallies in cities to express support for Qadri.
JUI chief Maulana Fazlur Rehman also addressed a rally in Karachi and pledged to defend Qadri in court. He is a frequent traveller to the United States.
The US media noted that lawyers and members of radical groups showered rose petals on Qadri when he was produced in courts in Islamabad and Rawalpindi.
Dozens of lawyers offered to defend him free of charge. The lawmakers said in the letter that their request for denial of visas to supporters of Qadri was “not just a moral issue but also an issue of national security”.
They said it was “shocking” that Mr Taseer, a “strong advocate for religious tolerance, pluralism and democracy,” was “cut down by an assassin`s bullets who opposed changes to statutes against religious minorities.”
“This unspeakable tragedy has been compounded by the public reaction of significant elements of Pakistan`s clerical, journalistic and law community who have praised the murderer and threatened the lives of other Pakistani officials who refuse to comply with the terrorisation of Christians, Ahmedis and women,” the letter said.
“Further problems are plaguing the democracy in Pakistan,” the lawmakers noted, pointing out that PPP MNA Sherry Rehman had also received threats for introducing a bill in the National Assembly, proposing amendments to the controversial blasphemy law.
“Further threats and violence are not the answer,” the letter added.

Blasphemy laws of Pakistan: Indian clerics are no less extremist and obscurantist – Part 1

As the following series of articles by a Deobandi cleric Maulana Nadeemul Wajidi published in several Urdu newspapers show, so-called Ulema in India are no less obscurantist and extremist in their views. They justify killing in the same way as do the Pakistanis. They are as happy at the killing of Salman Taseer, Governor of Pakistani Punjab, as are their Pakistani counterparts.

These articles reveal the way this assassination is being justified in India’s Muslim Press. The minds of common Indian Muslims are being poisoned in the same way as has been done in Pakistan. The couplets by Zafar Ali Khan Zafar the Maulana quotes with approval are enough to reveal his mind. A loose translation is being presented below:
(A blasphemer of the Prophet deserves death every which way,
This is the principle Muslim self-respect has been following since the beginning of Time;
If even one blasphemer of the Prophet remains alive,
God will not accept a single prayer of yours.)
And of course, there is no need for any evidence against a blasphemer. The courts or even media cannot perpetrate the ignominy of asking an accuser to repeat the act of blasphemy. So just if some so-called Muslim accuses any one of blasphemy, he or she should be condemned to death and since the modern courts may not do that in the absence of any evidence (except in Pakistan), so-called Muslims should take the law into their own hands and carry out the act of execution sanctioned by their “faith” or, to be more precise, the interpretation of their faith given by these obscurantist Mullahs.
This is the view being widely propagated. And this at the same time as Maulanas also proclaim that Islam is a religion of peace and amity, fit to be allowed to prosper in the 21st century, even in multi-religious, multi-cultural societies.
Let us hope India’s moderate Muslim intelligentsia is aware of the growing radicalisation of the Indian Muslim society and is ready to face what is coming. As many do not read these articles in the Urdu Press, we are providing an English translation. –- Sultan Shahin, Editor, New Age Islam
