The “Peoples” Prime Minister continues the legacy – by Saria Benazir

Jeay Bhutto is perpetuity; the Pakistan Peoples Party is the exclusive voice of the people of Pakistan and the prior decades have always attested that it is the only party, which had enough valor to defy the most despotic of the repressions – military, civilian or the judicial coups; the Pakistan Peoples Party has always appeared as the emblem of the peoples power – the red, green and black, which is the personification of triumph, and an eternal one – for certain, the uttermost of the firmaments are a witness to the grandeur of this flag – the streamer which has gashed every eye into tears, and moved every heart – of the antagonists and companions alike, with the degree of blood that is obvious in its red. Certainly, had it not been for the adversities the PPP and its leadership endured, Pakistan would not have been on the shell of the globe, and in the pursuit of developing this country, and granting fairness to its population, the “injustices” that it itself has gone through, are carved on the dimmest folios of the history – death sentences, spurious corruption charges, disentitlements and deferments are the course of every day… may be, because the party does not have a “Red Guard” like the others to shield its interests – perceptibly imprudent of them, because they fancy Pakistan to their own lives. Perhaps, they are aberrant, because they are the party of the “poor” and they are the dearest to the leadership – which then turns a matter of ego for the “cream of the crop” benches of Pakistan to eliminate this mere group, which treats a wage laborer and the head of the state alike.

The stories of the vigor of the “Mighty” courts and judges of Pakistan began, when they placed the founder of an independent Pakistan, and it’s first ever democratically elected Prime Minister was placed to scaffold – despite worldwide remonstrations to his imprisonment, they had enough whack to commit a “judicial murder” – They murdered him for the murder he did not commit. They sought to swab off the name of Shaheed Zulfikar Ali Bhutto and the Pakistan Peoples Party – Too pitiable of them that their pens lacked enough ink to give enough influence to their edicts. They could never abolish Bhutto from the hearts of the people. The resentment of the courts of Pakistan persists… but of no avail, too unfortunate they are – tarnish on the name of judiciary!

The clout of the masses became apparent, when Quaid e Awam’s daughter Shaheed Mohtarmah Benazir Bhutto became the first ever woman to become the head of a Muslim country – This is the peoples’ power – Superficial, glorious, inimitable! The Pakistan Peoples Party continues its fight against the forces of bigotry and despotism. The courts were still authoritarian – all they had inherited was carnage, and this is visible on every block of the “Supreme” Court of Pakistan – blood of a PPP worker, whose only peccadillo is the restitution of a democratic process in the country. Its leaders were persecuted – bogus charges were made against them. I bet they are oblivious to the meaning of “corruption” – the only pretext they had to topple elected governments, perhaps, parallel to the Generals’ “doctrine of necessity”.

Ethnically biased courts remain the trademark of Pakistan’s judiciary. President Asif Ali Zardari spent eleven and a half years in prison – in those blistering cells with a temperature of over 48 degrees, and starved of his fundamental human rights – conceivably, his misdemeanor was to join ties with the Bhutto family and the PPP, and because he was a Sindhi and did not come from a larger province. A “convicted” person from Punjab is sent with 40 suitcases to the Kingdom of Saudi Arabia, and a guiltless one from a smaller province is tortured in the most mortifying way – the remuneration for speaking for the people of Pakistan is that his own tongue is cut off. Shaheed Mohtarmah Benazir fought in the same kangaroo courts for 11 and a half years – no case could ever be proved against her but the mania with the Swiss bank accounts prolongs even after decades, despite being well aware of the fact that it hardly exists.

The most recent prey to the prejudice of the Supreme Court of Pakistan is the PPP’s Prime Minister, Syed Yousuf Raza Gillani – the first Prime Minister of Pakistan from the Seraiki belt of Pakistan. The Pakistan Peoples Party has always believed in the autonomy and neutrality of the judiciary – Hundreds of the humble PPP workers laid down their lives for an unbiased judicial system in Pakistan; and instantaneously after becoming the Prime Minister, Syed Yousuf Raza Gillani ordered the reinstatement of the judges who had been dribbled out by the former President, Pervez Musharaf – Perhaps, the boots were well sentient of them! Iftikhar Chaudhry set another “reprehensible” instance to verify that the “Supreme” Court of Pakistan carried zia ul haq’s remains… atrocious as the worst dictator in Pakistan’s history; the Chief Justice introduced the very notion of “judicial coup” in Pakistan’s political system.

What was Gilani’s fault that justified his ineligibility? – He declined to write a letter to the Swiss authorities to re-open the cases against the President of Pakistan, and the Co- Chairman of the Pakistan Peoples Party, Asif Ali Zardari. A lay man is conscious of the fact that the President enjoys imperviousness, which is not granted to him by Mr. Iftikhar Chaudhry that he can withdraw this right whenever he covets – but under Section 248 (2) of the constitution of Pakistan, and under the Geneva Accords. The Prime Minister was not defending his party’s Co – Chairman, but he was debarred for upholding the preeminence of the Parliament and for his venture to save this blossoming democracy. He did set up an example of a Prime Minister, who adhered to the orders of the court, and instead of fighting them, fought his case there, regardless of being well enlightened to the fact that it’s improbable to search for “justice” in zia’s “Supreme” Courts!

Mr. Gillani was incriminated with the “contempt” of the apex court of Pakistan for not writing the letter – I’ve been hearing this from my childhood that you cannot dishonor the once who previously has no esteem – Where does this “contempt” come from then? Perhaps, it was not contempt to take swearword under the PCO and to validate the Martial Law, no contempt to incarcerate people without being convicted of an offense, and no contempt at all to murder the first ever democratically elected Prime Minister of Pakistan…? A sane person would undeniably have NO respect for these courts which are mere spectators to the butchery of the innocent civilians! This is why I’m compelled to call myself a “dissenter”!

“Wo jin k hont ki jambish se, wo jin ki aankh ki larzish se, qanoon badalte rehte hain, aur mujhrim palte rehre hain, in chiriin k sardaron se, insaaf k pahre daron se, main bagi hoon main bagi hoon, jo chahe mujh pe zulm karo”

It seems hard to bring to a close my view without the Chairman PPP, Mr. Bilawal Bhutto Zardari’s articulate and tear-jerking speech on the death anniversary of Quaid e Awam Shaheed Zulfikar Ali Bhutto “The Supreme Court told us Shaheed Bhutto was guilty. They hanged Zulfikar Ali Bhutto of Larkana, but the court of the people and the court of history were on our side and we have been vindicated. Just as Shaheed Bhutto was vindicated, you too shall be vindicated. They can threaten to send Yousuf Raza Gillani of Multan to prison but he is a follower of Bhutto Shaheed. We do not fear prison cells. We do not fear death cells.”

“I have faith in you Mr. Prime Minister. You will make Shaheed Benazir Bhutto and Shaheed Zulfikar Ali Bhutto proud. We will get justice. If not now. If not by this court. We will be vindicated in the courts of history. The people have spoken. We are all agreed.”

The “Supreme” Court of Pakistan proclaimed its decree on June 19, 2012. The court of the people will announce its verdict on July 19, 2012. An unelected Chief Justice had no authority to disqualify an elected Prime Minister – yet, the people of Pakistan and the history never barred Gilani and he emerges as a title holder of democracy and constitutional supremacy by refusing to trial the cadaver of our martyred leader, Shaheed Mohtarmah Benazir Bhutto. The peoples’ Prime Minister continues the legacy!

Perhaps, the court of the people will proclaim a landmark victory for Ali Qadir Gilani on July 19, and he will be voted to the Parliament of Pakistan – Mr Iftikar Chaudhry, what are your plans about the next Gilani? You cannot debar us from the hearts of the people – Isn’t it a “derision” of “your” court – well, please do bewail at zia’s death after your trounce!
